71659 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">A fecha de la firma electrónica, el director general de Economía Circular, Transición Energética y Cambio Climático ha formulado la siguiente propuesta definitiva:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El 28 de diciembre de 2024, en el BOIB n.º 170, se publicó la Resolución del consejero de Empresa, Autónomos y Energía de 23 de diciembre de 2024 por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2025 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas dentro del Programa FEDER 2021-2027.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas que figuran en el anexo de esta Resolución obtuvieron una subvención para la implantación de instalaciones renovables.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las personas que figuran en el anexo de esta propuesta presentaron la documentación justificativa de las actuaciones realizadas, en que se acredita que el importe de la actuación ha sido inferior al previsto inicialmente o se ha reducido la instalación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los servicios técnicos competentes han informado favorablemente sobre el pago de las subvenciones descritas en el anexo, en que se incluye una aminoración del importe proporcional a las modificaciones efectuadas, las cuales se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 12 de noviembre de 2025, se emitió una propuesta de resolución de aminoración de la cantidad de la ayuda del director general de Economía Circular, Transición Energética y Cambio Climático (BOIB núm. 151, de 15 de noviembre de 2025) y se ha agotado el plazo de diez días hábiles que se concedía para presentar alegaciones sin que se hayan presentado.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 2 de septiembre de 2004).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Resolución del consejero de Empresa, Autónomos y Energía de 23 de diciembre de 2024 por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2024 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas dentro del Programa FEDER 2021-2027.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución definitiva</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al consejero <span style="color:black">de Empresa, Autónomos y Energía </span>que dicte una resolución en los términos siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Reconocer la obligación y proponer el pago de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el importe que se indica.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Revocar parcialmente la subvención concedida puesto que la cantidad de coste elegible ha sido inferior a lo previsto.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Autorizar y disponer negativamente el gasto a revocar parcialmente de los beneficiarios y por los importes detallados en el anexo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Establecer que los beneficiarios están obligados a cumplir lo que dispone el apartado once de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 23 de diciembre de 2024, así como los supuestos establecidos en el apartado decimotercero en relación con la concurrencia de ayudas.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, como también la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, da lugar a la revisión parcial o total de la subvención y, por lo tanto, al reintegro de la cantidad correspondiente más los intereses de demora.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="margin-bottom:0px; font-size:12px"><span style="color:black">Manifestar la conformidad con la propuesta de resolución y dictar su resolución en los mismos términos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Interposición de recursos</span></strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes a contar desde el día siguiente de la notificación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></p> <p style="margin-bottom:0px;
