    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El Estatuto de autonomía de las Islas Baleares, aprobado por la Ley orgánica 1/2007, de 28 de febrero, en el artículo 36.2 establece que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Islas Baleares la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades, de acuerdo con lo dispuesto en el artículo 27 de la Constitución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La creación de centros públicos corresponde al gobierno autonómico, de acuerdo con el artículo 17 de la Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación, el artículo 102 de la Ley 1/2022, de 8 de marzo, de educación de las Islas Baleares, y el artículo 3 del Decreto 4/2023 de 13 de febrero, por el que se aprueba el Reglamento orgánico de las escuelas infantiles públicas,&amp;nbsp; los colegios de educación primaria, los colegios de educación infantil y primaria, los colegios de educación infantil y primaria integrados con enseñanzas elementales de música, los colegios de educación infantil y primaria integrados con educación secundaria y los institutos de educación secundaria de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El artículo 105 de la Ley 1/2022, de 8 de marzo, de educación de las Islas Baleares, establece que los municipios deben poner a disposición de la administración educativa los terrenos necesarios para construir los centros educativos públicos de educación infantil y primaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;De acuerdo con lo establecido en el artículo 29.2 &lt;em&gt;d &lt;/em&gt;de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, y el artículo 25.2 puntos &lt;em&gt;d&lt;/em&gt; y &lt;em&gt;n&lt;/em&gt;, de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, el municipio ejerce las competencias propias que le corresponden en gestión del patrimonio municipal,&amp;nbsp; regulación de su uso o destino, conservación y mantenimiento; infraestructura vial y otros equipamientos de los que es titular; en la cooperación con la Administración educativa en la obtención de solares para la construcción de nuevos centros docentes, y en la conservación, el mantenimiento y la vigilancia de los edificios de titularidad local destinados a centros públicos de educación infantil, educación primaria o educación especial. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La tendencia al crecimiento de la población del municipio de Felanitx, el progresivo aumento del número de alumnos para escolarizar y el alto índice de matrícula de los últimos años en el centro de educación infantil y primaria Inspector Joan Capó, de Felanitx, evidencian la necesidad de disponer de un nuevo centro educativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Este centro es ahora el centro público de educación infantil y primaria con más alumnado de las Islas Baleares y se hace necesario que pueda volver a su configuración de dos líneas lo antes posible. Por ello se considera conveniente, como ya se ha hecho en otros casos parecidos, acelerar la creación y el funcionamiento del nuevo CEIP de Felanitx.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La previsión es que las obras del nuevo CEIP de Felanitx estén concluidas el curso 2027-2028.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Con el fin de atender las necesidades de escolarización, el nuevo centro educativo de Felanitx debería empezar a desarrollar su actividad el próximo curso 2026-2027 con dos unidades de 4º de educación infantil en las instalaciones del CEIP Inspector Joan Capó y funcionar como una extensión de este centro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo ello, el Consejo de Gobierno, a propuesta del consejero de Educación y Universidades, en la sesión de día 28 de noviembre de 2025, adoptó entre otros el siguiente Acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Primero&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Crear el centro de educación infantil y primaria siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
