&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. En el BOIB núm. 86, de 5 de julio de 2025, se publicó la Resolución del director general del Servicio de Salud por la que se convocó un proceso simplificado de acceso o progresión en la carrera profesional del personal estatutario dependiente del Servicio de Salud correspondiente a los años 2023, 2024 y 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. En fecha 22 de agosto de 2025, se publicaron en la web de Carrera Profesional las listas provisionales de admitidos y excluidos de este proceso simplificado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Presentaron alegaciones contra la exclusión de la lista provisional, por no haber podido finalizar y registrar la solicitud, las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Los aspirantes fundamentaban las alegaciones en que iniciaron el procedimiento electrónico de solicitud de carrera pero no formalizaron y registraron la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Estas alegaciones se desestimaron y se dictó la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se aprueban las listas definitivas de admitidos y excluidos del proceso simplificado de acceso o progresión en la carrera profesional del personal estatutario dependiente del Servicio de Salud correspondiente a los años 2023, 2024 y 2025 (BOIB núm.&amp;nbsp;122, de 13 de septiembre de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. En fecha 14 de octubre de 2025, el Juzgado de lo Contencioso Administrativo núm. 4 de Palma dictó una sentencia estimatoria sobre las pretensiones de la recurrente en un procedimiento idéntico al actual en el que se le había excluido de la lista definitiva de los aspirantes admitidos y excluidos de la anterior convocatoria extraordinaria de carrera profesional por el mismo motivo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos jurídicos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El artículo 109 de Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (LPAC), establece que las administraciones públicas pueden revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de gravamen o desfavorables, siempre que esta revocación no constituya dispensa o exención no permitida por las leyes y no sea contraria al principio de igualdad, al interés público o al ordenamiento jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. El artículo 110 LPAC establece los límites a esta revisión, que no puede ejercerse cuando, por prescripción de acciones, por el tiempo transcurrido o por otras circunstancias, su ejercicio sea contrario a la equidad, a la buena fe, al derecho de los particulares o a las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. El artículo 69 LPAC establece que si la solicitud de iniciación no reúne los requisitos que señala el artículo 66, y, en su caso, los señalados en el artículo 67 u otros exigidos por la legislación específica aplicable, debe requerirse al interesado para que repare la falta o adjunte los documentos preceptivos en un plazo de diez días, con indicación de que, si no lo hace, se considera que desiste de su petición, previa resolución que debe dictarse en los términos previstos en el artículo 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En virtud de este artículo, debería haberse requerido a las personas interesadas para que enmendaran la solicitud, cosa que no se hizo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. El artículo 35.1 LPAC dispone que los actos que se dicten en el ejercicio de potestades discrecionales deben ser motivados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. La Sentencia 102/2025 dictada por el Juzgado de lo Contencioso-Administrativo 4 en las actuaciones del procedimiento abreviado núm.&amp;nbsp;178/2025 estima las pretensiones de la recurrente porque, aunque acepta que no finalizó ni firmó la solicitud, y, por tanto, no finalizó el proceso, considera que aplicando la jurisprudencia del Tribunal Supremo, se le debería haber dado la posibilidad de enmienda por medio del trámite previsto en el artículo&amp;nbsp;68 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. La Sentencia 954/2022, de 7 de julio, del Tribunal Supremo, citada en el fundamento jurídico segundo, estableció lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Sería sumamente difícil —por no decir imposible— argumentar que la previsión legal del carácter subsanable de la omisión de firma en las solicitudes no es aplicable a las solicitudes presentadas por vía electrónica. Ello vale igualmente para aquellas omisiones que, sin referirse a la firma electrónica propiamente dicha, afectan a la «acreditación de la autenticidad de la voluntad» del solicitante, como podría ser el paso final de validar lo formulado y enviado por vía electrónica.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. El artículo 51 LPAC prevé que el órgano que anule las actuaciones debe disponer siempre la conservación de los actos y trámites cuyo contenido se habría mantenido igual si no se hubiera cometido la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Revocar parcialmente la lista definitiva de los aspirantes admitidos y excluidos del proceso simplificado de acceso o progresión en la carrera profesional del personal estatutario dependiente del Servicio de Salud correspondiente a los años 2023, 2024 y 2025 (BOIB núm. 122, de 13 de septiembre de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Retrotraer el procedimiento simplificado convocado por la Resolución del director general del Servicio de Salud de las Islas Baleares al trámite de alegaciones a la lista provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Estimar las alegaciones presentadas por los aspirantes que se relacionan a continuación y, en consecuencia, requerirles que en un plazo de diez días enmienden la solicitud manifestando la voluntad expresa de firmar y finalizar el proceso: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Conservar el resto de actos y de trámites del procedimiento, de conformidad con el artículo 51 LPAC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Notificar esta resolución a las personas interesadas y a los servicios administrativos que deben dar cumplimiento a la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso potestativo de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo&amp;nbsp;57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente al de la publicación de esta resolución, de acuerdo con los artículos 8 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, sin perjuicio de cualquier otro recurso que se considere procedente interponer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
