    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizaran a las personas interesadas mediante su publicación en el Butlletí Oficial de les Illes Balears de acuerdo con los términos que prevé la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha &lt;span style="background-color:#ffffff"&gt;13&lt;/span&gt; de noviembre de 2025, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;PROPUESTA DE RESOLUCIÓN/&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN DE REVOCACIÓN PARCIAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Con fecha de 21 de diciembre de 2021 se publicó, en el Boletín Oficial de las Islas Baleares núm. 174, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias para el año 2021.&lt;/p&gt;

&lt;p&gt;2. El 12 de abril de 2024, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Illes Balears número 52, de 20 de abril de 2024, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto, por un importe de 116.559,98€.&lt;/p&gt;

&lt;p&gt;3. Dada la Resolución de concesión de la citada ayuda, y de acuerdo con lo establecido en el apartado undécimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.&lt;/p&gt;

&lt;p&gt;4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida.&lt;/p&gt;

&lt;p&gt;5. El 16 de julio de 2025, se emite el informe de moderación de coste por un importe elegible total de 166.718,55 €.&lt;/p&gt;

&lt;p&gt;6. El importe elegible inicial era de 194.266,63 € por tanto la diferencia es de 27.548,08 € que corresponden a una revocación parcial de 16.528,85 €.&lt;/p&gt;

&lt;p&gt;7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos de los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”.&lt;/p&gt;

&lt;p&gt;8. El 18 de septiembre se dio trámite de audiencia al interesado para poder consultar el expediente y el informe de moderación de costes. 9.Dado todo esto, se propone hacer la revocación parcial de la ayuda concedida al beneficiario como se indica en el anexo adjunto de esta resolución.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias, para el año 2021.&lt;/p&gt;

&lt;p&gt;2. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020.&lt;/p&gt;

&lt;p&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Propuesta de Resolución &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="color:#000000"&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="color:#000000"&gt;1. Revocar parcialmente la ayuda concedida &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;al beneficiario detallado en el anexo adjunto, que es un total de 1 expediente, que comienza y termina por PERE JOSEP CALAFAT VICH, con NIF ***0387** (exp. INEA2021_1/139), por un importe de 16.528,85 €, y que corresponde a la financiación TOP UP CAIB. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="color:#000000"&gt;2. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
