&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha &lt;span style="background-color:#ffffff"&gt;12&lt;/span&gt; de noviembre de 2025, firmó la siguiente resolución,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;PROPUESTA DE RESOLUCIÓN/&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN DE REVOCACIÓN PARCIAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;1. Con fecha de 21 de diciembre de 2021 se publicó, en el Boletín Oficial de las Islas Baleares núm. 174, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias para el año 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;2. El 12 de abril de 2024, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Illes Balears número 52, de 20 de abril de 2024, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;3. El 21 de mayo de 2024, el interesado MIGUEL NADAL VIDAL PERELLÓ, con NIF ***7363**, con registro de entrada núm. GOIBE260958/2025, presentó, dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, la solicitud de pago, así como la documentación exigida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;4. El 23 de septiembre de 2025 se emite el informe de moderación de costes en el que se indica que el importe de la inversión es de un total de 136.228,43 €. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;5. La inversión inicialmente aprobada era de 143.799,43 €, hay una diferencia de 7.571,00 € y por tanto se deben revocar 3.785,50 € de ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;6. El día 25 de septiembre de 2025, se publica en la web del FOGAIBA el informe propuesta provisional de resolución de la revocación parcial por moderación de costes del expediente INEA2021_1_049 con un aviso con el enlace por SMS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;7. Que el beneficiario, e&lt;/span&gt;&lt;span style="color:#000000"&gt;l día 26 de septiembre de 2025, con núm de registro GOIBE 682432/2025 ha presentado alegaciones contra el informe propuesta provisional de resolución parcial y aporta certificado del vendedor con los extras desglosados que justifican que la inversión coincide con el presupuesto aportado &lt;/span&gt;&lt;span style="color:#000000"&gt;en la concesión de la ayuda, por tanto se estima la alegación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;8. Ante todo esto, se propone dejar sin efecto la revocación parcial de la ayuda concedida al beneficiario tal y como se indica en el anexo adjunto de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto , subvenciones para inversiones en las explotaciones agrarias, para el año 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;2. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Propuesta de Resolución &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.&amp;nbsp;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Dejar sin efecto la resolución de revocación parcial de la resolución de ayuda concedida al beneficiario detallado en el anexo adjunto, que es un total de 1 expediente, que comienza y termina por MIGUEL NAVIDAD VIDAL PERELLÓ, con NIF ***7363** (exp. INEA2021_1/049), por un importe de 3.785,50 €, y que corresponde a la financiación FEADER, AGE y CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2. Pagar la ayuda concedida al expediente INEA2021_1/049.&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
