    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por acuerdo de Pleno de 9 de octubre de 2025, el Pleno del Consejo Insular de Mallorca aprobó definitivamente el reglamento por el que se regula el uso de la marca de garantía "Moda Artesana de Mallorca", que fue publicado en el BOIB núm. 138, de 18 de octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta marca tiene como objetivo principal promover y proteger la producción artesana del sector de la moda en Mallorca, reforzar al mismo tiempo su calidad, origen y autenticidad, así como permitir que cualquier persona o empresa que cumpla con los requisitos técnicos y de procedencia pueda adherirse, sin que se reserve el uso de la marca a determinados productores, para garantizar. Esta marca también busca consolidar la identidad cultural de Mallorca y promover el desarrollo sostenible del sector.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El artículo 7 del reglamento establece que la solicitud de autorización de uso debe presentarse al departamento competente en materia de artesanía a través del Registro electrónico del Consejo Insular de Mallorca, en los términos que regula la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El apartado cuarto del artículo 66 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, dispone que las administraciones públicas deben establecer modelos y sistemas de presentación masiva que permitan a los interesados ​​presentar sus solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Estos modelos estarán a disposición de los interesados ​​en las correspondientes sedes electrónicas y en las oficinas de asistencia en materia de registros de las administraciones públicas. Por su parte, el apartado 6 establece que cuando la Administración en un procedimiento concreto establezca expresamente modelos específicos de presentación de solicitudes, éstos serán de uso obligatorio por los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;De acuerdo con las competencias que le son propias en materia de artesanía, según se dispone en el decreto de presidencia por el que se establecen las competencias de los departamentos del Consejo Insular de Mallorca (BOIB núm. 106, de 29 de julio de 2023; BOIB núm. 136, de 5 de octubre de 2023; de BOIB núm. 2; BOIB núm. núm. 131, de 5 de octubre de 2024, BOIB núm.25, de 25 de febrero de 2025; BOIB nº. 94, de 17 de julio de 2025; BOIB nº. 97, de 24 de julio de 2025), así como en el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, la vicepresidenta primera y consejera ejecutiva de Cultura y Patrimonio dicta la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Aprobar el modelo de solicitud de uso de la marca Moda Artesana de Mallorca que se incluye en el anexo de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Publicar esta resolución en el Boletín Oficial de las Illes Balears y en la sede electrónica del Consejo Insular de Mallorca, para general conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;SOLICITO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;INFORMACIÓN SOBRE PROTECCIÓN DE DATOS PERSONALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Los datos que contenga la solicitud de admisión, la documentación que se adjunte o la documentación que se genere a partir de este trámite, se incorporan en un fichero de datos personales, inscrito en la Agencia Española de Protección de Datos, del que es responsable el Consell Insular de Mallorca. Este fichero sirve, por un lado, para conceder la autorización de uso prevista, para alcanzar los objetivos y finalidades recogidos en el reglamento correspondiente , y en su caso, para llevar a cabo la tramitación del resto de actuaciones indicadas en el reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. Cesiones de los datos previstos: las publicaciones previstas (BOIB, tablón de anuncios del Centro Cultural la Misericordia, página web del Consell de Mallorca, www.conselldemallorca.net ); según lo que prevé en relación con la publicación de los actos administrativos el artículo 45.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Escriba preferentemente en mayúsculas, sobretodo en el apartado de datos personales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1.&amp;nbsp; Los sujetos a los cuales hacen referencia los apartados 2 y 3 del artículo 14 de la Ley 39/2015, de 1 de octubre, están obligados a relacionarse a través de medios electrónicos con las administraciones, por lo que, de conformidad con lo que establece el artículo 68.4 de la mencionada ley, si alguno de estos sujetos presenta la solicitud presencialmente, la Administración Pública tiene que requerirle para que lo subsane a través de su presentación electrónica. A este efecto, tiene que considerarse que la solicitud se ha presentado en la fecha de su presentación electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;REQUISITOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Los requisitos necesarios para obtener la autorización de uso de la marca son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Disponer de la carta de artesano o artesana (CA), la carta de maestro artesano o maestra artesana (CMA) o el documento de calificación artesanal (DQA), que haya expedido el Consejo Insular de Mallorca, en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. Desarrollar la producción mayoritariamente en Mallorca, garantizando que al menos un 75% del proceso productivo, incluido el diseño, tenga lugar en la isla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. Elaborar productos con su nombre o marca de su titularidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. Crear productos que cumplan los estándares de calidad y autenticidad especificados en este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. Los productos deben ser manufacturados por los artesanos o artesanas solicitantes o en talleres dirigidos por los artesanos o artesanas solicitantes, sin poder subcontratar el grosor de la producción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;6. Operar bajo una estructura legal y estar debidamente registrado o registrada en las actividades económicas correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DOCUMENTACIÓN QUE SE ADJUNTA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;- Anexo I: Declaración responsable de conocimiento y cumplimiento del reglamento de uso de la marca Moda Artesana de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;- Memoria descriptiva del proceso productivo y fotografías del taller. La memoria debe mostrar el proceso y técnicas artesanales que se siguen para producir al menos una de las piezas, que acredite que se cumple con los requisitos indicados en el reglamento en cuanto a representatividad, diferenciación, uso de los materiales, sostenibilidad y técnicas artesanales. Además es importante acreditar gráficamente el espacio donde se desarrolla la actividad en cuanto a ser visitable y cumplir con el resto de normativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;- Listado con fotografías de los productos por los que se solicita el uso de la marca. El listado debe acreditar cuáles son los productos que se quieren dejar sujetos a la marca. Si bien el carácter artesano hace que ninguna pieza sea igual, sí que el listado debe servir de referencia para controlar el uso que se hace de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Que los productos objeto de la marca cumplen los criterios del artículo 6 del Reglamento: representatividad, coherencia, diferenciación, uso de materiales sostenibles, técnicas artesanales, innovación, sostenibilidad y disponer de un espacio visitable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;4. Que conozco y acepto los derechos y obligaciones establecidos en los artículos 12 y 13, y en particular se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Utilizar la marca de forma visible y correcta en todos los productos autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Garantizar el permanente cumplimiento de los requisitos técnicos y de calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Permitir inspecciones o controles por parte del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Estar al corriente de sus obligaciones tributarias, laborales y con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Informar a cualquier cambio en los procesos productivos o en la titularidad de la empresa en el plazo establecido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Mantener la coherencia y el correcto uso del distintivo según el Manual de Identidad de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;5. Que acepto el régimen de control y seguimiento establecido en el artículo 14 del Reglamento, y me comprometo a facilitar toda la información, documentación y visitas de inspección que me puedan requerir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;6. Que soy consciente de que el incumplimiento de las obligaciones puede comportar la suspensión o revocación de la autorización de uso de la marca, de acuerdo con lo que establece el artículo 16 del Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;7.
