66812 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes&nbsp;</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 24 de mayo de 2025 se publicó en el BOIB núm. 66 la Resolución del director general del Servicio de Salud de las Islas Baleares, de 21 de mayo de 2025, por la que se aprueban la convocatoria, las bases, los ejercicios, el temario y el baremo de méritos que deben regir los procesos de selección, por la modalidad concurso-oposición, para cubrir las plazas vacantes de personal estatutario fijo de las categorías profesionales y especialidades siguientes: facultativo/facultativa especialista de área (FEA), médico/médica de urgencia hospitalaria y otras categorías de personal estatutario sanitario (subgrupo A1) del Servicio de Salud de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dicha Resolución incluía, en estas categorías profesionales, las plazas que no se cubrieron después de que concluyesen los procesos de selección derivados de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización correspondiente al personal estatutario del Servicio de Salud para el año 2022 y que quedaron desiertas, además de la totalidad de las plazas contenidas en las ofertas de empleo público para los años 2023 y 2024, 330 de ellas por el sistema de turno libre y 17 por el de promoción interna.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 4 de noviembre de 2025 se publicó en el BOIB núm. 146 la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se corrigen los errores detectados en la Resolución de 21 de mayo de 2025 en cuestión. La corrección de errores afectó a los anexos I y IV, correspondientes a las bases de la convocatoria y al baremo de méritos, respectivamente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Una vez concluida la negociación en la Mesa Sectorial de Sanidad entre representantes de la Administración y de las organizaciones sindicales, en el BOIB núm. 141, de 25 de octubre de 2025, se publicó el Acuerdo del Consejo de Gobierno de 24 de octubre de 2025 por el que se aprueba la oferta de empleo público para 2025 del personal estatutario dependiente del Servicio de Salud de las Islas Baleares, que prevé una oferta de 1.779 plazas para las diferentes categorías profesionales, 177 de las cuales corresponden a las categorías profesionales que ahora nos ocupan, 176 del turno libre y 1 del turno de promoción interna.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En el apartado 4 del anexo I de la Resolución de 21 de mayo de 2025 se prevé que el Servicio de Salud, ejerciendo la potestad de autoorganización, puede ampliar el número de plazas convocadas correspondientes a las categorías profesionales y las especialidades previstas en esa convocatoria con las plazas que se aprueben en la oferta de empleo público de 2025, siempre que esta modificación se realice antes de que empiece el plazo para presentar solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En la presente adición y modificación de la convocatoria se indica el número de plazas vacantes que proceden de las ofertas de empleo público indicadas que corresponden a las categorías profesionales y especialidades de facultativo/facultativa especialista de área (FEA), médico/médica de urgencia hospitalaria y otras categorías de personal estatutario sanitario (subgrupo A1) por el turno libre, el turno de promoción interna y, en su caso, el número de plazas reservadas para cubrirlas con personas con discapacidad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La disposición adicional cuarta de la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares, establece que al consejero o consejera competente en materia de función pública sanitaria le corresponde convocar y resolver los procesos de selección en relación con el personal estatutario al servicio de la sanidad pública autonómica —en coordinación con el consejero o consejera competente en materia de función pública—, establecer las bases, los programas y el contenido de las pruebas y designar a los miembros de los órganos de selección.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. En materia competencial también es aplicable el punto 1 de la Resolución de la consejera de Salud de 10 de julio de 2025, por la que se delegan diferentes competencias en materia de personal estatutario en los órganos del Servicio de Salud de las Islas Baleares (BOIB núm. 94, de 17 de julio de 2025).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. El artículo 70 del Texto refundido de la Ley del estatuto básico del empleado público (TREBEP) establece que las necesidades de recursos humanos con asignación presupuestaria que deban proveerse incorporando personal nuevo deben ser objeto de una oferta de empleo público o de otro instrumento similar de gestión de la provisión de las necesidades de personal, lo cual supone la obligación de convocar los correspondientes procesos de selección para las plazas comprometidas y hasta un 10 % adicional, y fijar el plazo máximo para convocarlos. En cualquier caso, la ejecución de la oferta de empleo público o del instrumento similar debe hacerse dentro del plazo improrrogable de tres años.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. El artículo 37.1.c del TREBEP dispone que son objeto de negociación —en su ámbito respectivo y en relación con las competencias de cada administración pública y con el alcance que legalmente sea procedente en cada caso— las normas que establecen los criterios generales en materia de acceso. Por otro lado, el artículo 38.3 establece que los acuerdos deben versar sobre materias que sean competencia de los respectivos órganos de gobierno y que es necesario que dichos órganos los aprueben de forma expresa y formal para que tengan validez y eficacia.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Por otro lado, en el punto 10 del anexo 1 de la Resolución del director general del Servicio de Salud de las Islas Baleares de 21 de mayo de 2025 se determina que hay que dictar unas instrucciones junto con la apertura de plazo para presentar las solicitudes, que empieza el 17 de noviembre de 2025 y vence el 16 de diciembre de 2025, inclusive.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello dicto la siguiente</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Determinar que las plazas de las categorías profesionales y especialidades de FEA, médico/médica de urgencia hospitalaria y otras categorías de personal estatutario sanitario (subgrupo A1) del Servicio de Salud de las Islas Baleares aprobadas en la oferta de empleo público para 2025 del personal estatutario del Servicio de Salud (176 de las cuales corresponden al turno libre y 1 al turno de promoción interna) se rigen por la Resolución del director general del Servicio de Salud de las Islas Baleares, de 21 de mayo de 2025, por la que se aprueban la convocatoria, las bases, los ejercicios, el temario y el baremo de méritos que deben regir los procesos de selección, por la modalidad concurso-oposición para cubrir las plazas vacantes de personal estatutario fijo de esta categorías (BOIB núm. 66, de 24 de mayo de 2025), así como por las disposiciones que se establecen a continuación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Modificar el objeto de la convocatoria de la Resolución de 21 de mayo de 2025 en cuestión (punto 4 del anexo 1) según la redacción que figura en el anexo 1 de la presente resolución, con el fin de incorporar el número de plazas correspondientes a la oferta de empleo público de 2025, distribuidas por categorías profesionales y especialidades previstas en esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Modificar la distribución de las plazas indicadas en la Resolución de 21 de mayo de 2025 según consta en los anexos 2 y 3 de la presente resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Abrir el plazo para presentar solicitudes de participación en el proceso de selección, que se inicia el 17 de noviembre de 2025 y vence el 16 de diciembre de 2025, inclusive.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Aprobar las instrucciones para cumplimentar la solicitud y presentar la documentación acreditativa de los requisitos, que figuran en el anexo 4 de la presente resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Aprobar las instrucciones para presentar presencialmente la documentación acreditativa de los requisitos, que figuran en el anexo 5.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Publicar esta resolución en el Boletín Oficial de las Islas Baleares (BOIB), en el web www.ibsalut.es y en la Sede Electrónica de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente al de la notificación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; En caso contrario, si se ha pagado la tasa se puede recuperar el trámite en la Carpeta Ciudadana o bien se puede iniciar un nuevo trámite.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.&nbsp; &nbsp; Procedimiento y requisitos de participación</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El hecho de presentar la solicitud para participar en este proceso de selección supone conocer y aceptar las bases reguladoras y declarar que se cumplen todos los requisitos en la fecha de vencimiento del plazo para presentar solicitudes y durante todo el proceso de selección.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para tener la condición de aspirante y ser admitido en este proceso de selección es necesario cumplir los requisitos establecidos en los apartados «Requisitos y condiciones de los aspirantes», «Turno de promoción interna» y «Turno de reserva para personas con discapacidad» (según sea el caso) de la Resolución por la que se aprueban las bases de esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para ser admitido en cualquiera de los turnos es necesario cumplir cada uno de los requisitos correspondientes. Algunos serán comprobados de oficio, otros deberán acreditarse expresamente y respecto de algunos otros será necesario suscribir una declaración responsable junto con la solicitud de participación, sin perjuicio de que se compruebe o deba acreditarse posteriormente, en otra fase del proceso de selección, todo ello de conformidad con las bases reguladoras y esta resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tal como establece el artículo 69.4 de la Ley 39/2015, si una persona presenta una declaración responsable o una comunicación con datos falsos, incorrectos o con omisiones importantes, o no aporta la documentación que le requieran para comprobar lo que ha declarado, no puede continuar la actividad o el derecho relacionado desde que la Administración detecta el hecho. Además, esto puede suponer responsabilidades penales, civiles o administrativas.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Requisitos para el turno libre:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener la nacionalidad española o la de cualquier estado de la Unión Europea o la de algún estado al que sea aplicable la libre circulación de trabajadores en virtud de los tratados internacionales subscritos por la Unión Europea y ratificados por España.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– También pueden participar (cualquier que sea su nacionalidad) los cónyuges de españoles y de ciudadanos de otros estados de la Unión Europea siempre que no estén separados de derecho, además de sus descendentes si tienen menos de veintiún años o si tienen la condición de dependientes y superan dicha edad.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener cumplidos dieciséis años y no sobrepasar la edad máxima de jubilación forzosa.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener la titulación oficial mínima exigida para cada categoría profesional y especialidad, que se detallan en el anexo 5 de la resolución que contiene las bases reguladoras, o bien estar en condiciones de obtenerla dentro del plazo para presentar solicitudes.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener la capacidad funcional necesaria para desempeñar las funciones que se deriven del nombramiento correspondiente, que debe acreditarse una vez superado el proceso de selección por medio de un reconocimiento médico en el centro o servicio que se determine.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– No haber sido separado del servicio —por medio de un expediente disciplinario— de cualquier servicio de salud o administración pública, organismo público o entidad de derecho público dependiente o vinculado a aquel, ni de las entidades públicas sujetas a derecho privado ni de las fundaciones sanitarias en los seis años anteriores a la convocatoria específica, ni estar inhabilitado con carácter firme para desempeñar funciones públicas ni, en su caso, para la profesión correspondiente.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– En los casos de las personas de otros estados mencionados en el primer párrafo, no estar inhabilitado por una sanción o pena para el ejercicio profesional o para acceder a funciones o servicios públicos en un estado miembro de la Unión Europea, ni haber sido separado por una sanción disciplinaria de alguna de sus administraciones o servicios públicos en los seis años anteriores a la convocatoria específica.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– No haber sido condenado de forma que no se pueda ejercer la profesión con menores de edad, de conformidad con el artículo 57 de la Ley orgánica 8/2021; es decir, no haber sido condenado por una sentencia firme por algún delito contra la libertad y la indemnidad sexual tipificado en el título VIII del Código penal y por tráfico de seres humanos, tipificados en el título VII bis del Código penal.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Haber pagado la tasa (o las tasas) para participar en el proceso de selección, salvo en los casos de exención previstos en el apartado 10.7 de las bases de la Resolución de convocatoria.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– No tener la condición de personal estatutario fijo en la misma categoría y especialidad a la que se opta, cualquiera que sea su situación administrativa.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– No estar implicado en ninguna causa legal de incapacidad o incompatibilidad según la normativa vigente en el momento de la incorporación efectiva a la plaza adjudicada, manteniendo el derecho de opción permitido legalmente.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Requisitos para el turno de promoción interna (además de los descritos en el apartado anterior):</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener la condición de personal estatutario fijo del Servicio de Salud de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Pertenecer a una categoría profesional y especialidad diferente a la convocada del mismo grupo de clasificación o de uno inferior.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Estar en la situación de servicio activo o en otra situación que genere reserva de plaza.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Acreditar la titulación exigida para acceder la categoría profesional o especialidad a la que quiere promocionar.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– No tener la condición de personal fijo de la misma categoría.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener un nombramiento fijo con una antigüedad mínima de dos años en la categoría de procedencia.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Requisitos para el turno de reserva para personas con discapacidad:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Tener reconocida la condición legal de discapacidad en un grado igual o superior al 33 %, con efectos al último día del plazo para presentar solicitudes, y también cumplir los requisitos de los apartados «Requisitos y condiciones de los aspirantes» y «Turno de promoción interna» de las bases reguladoras, según sea el caso.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Acreditar la condición de discapacidad por medio de la resolución de reconocimiento expedida por el órgano competente de la Administración, excepto si la ha reconocido el órgano competente de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– De acuerdo con artículo 35.1 del Texto refundido de la Ley general de derechos de las personas con discapacidad y de su inclusión social, las personas con discapacidad tienen derecho al trabajo en condiciones que garanticen la aplicación de los principios de igualdad de trato y no discriminación. A tal efecto, tienen la consideración de personas con discapacidad los pensionistas de la Seguridad Social que tengan reconocida una pensión de incapacidad permanente en los grados de total, absoluta o gran invalidez, y los pensionistas de clases pasivas que tengan reconocida una pensión de jubilación o de retiro por incapacidad permanente para el servicio o inutilidad. Por lo tanto, se equipararán automáticamente y a efectos laborales los pensionistas mencionados con el reconocimiento del grado de discapacidad igual o superior al 33 %. Por lo tanto, es necesario acreditar esta condición para poder participar en este turno.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.&nbsp; &nbsp; Comprobación de los requisitos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el apartado «Norma general» de las bases de la Resolución de convocatoria, el Servicio de Salud comprobará de oficio los aspectos siguientes, salvo que el aspirante manifieste expresamente que se opone a ello (en este caso tendría que aportar la documentación acreditativa de esos requisitos):</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– El pago de la tasa correspondiente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– El cumplimiento de los requisitos relativos a la nacionalidad, la edad y la titulación, por medio de la Plataforma de Interoperabilidad de las Islas Baleares (PINBAL) de los aspirantes que tengan la nacionalidad española y los que hayan obtenido las titulaciones en España.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– El cumplimiento de los requisitos específicos señalados en el apartado «Turno de promoción interna» de la Resolución de convocatoria, a excepción de las titulaciones cursadas fuera de España que den acceso a la categoría a la que se quiere acceder (siempre que sea distinta a la exigida en la categoría de origen).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– El cumplimiento de los requisitos específicos señalados en el apartado «Turno de reserva para personas con discapacidad» de las bases reguladoras siempre que se haya reconocido la discapacidad en las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si el Servicio de Salud no puede comprobar estos requisitos de oficio, requerirá a los aspirantes que aporten la documentación acreditativa, tal como dispone el artículo 28 de la Ley 39/2015.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el formulario de solicitud de participación es necesario declarar que se cumplen el resto de los requisitos de participación correspondientes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la fase de adjudicación, los aspirantes tendrán que suscribir una declaración responsable relativa a los requisitos de los puntos e), f), i) y j) del apartado «Requisitos y condiciones de los aspirantes» de las bases de la Resolución de convocatoria, En esa misma fase tendrán que acreditar el requisito relativo a la capacidad establecido en el punto d) del apartado «Requisitos y condiciones de los aspirantes» por medio de un certificado expedido por el Servicio de Prevención de Riesgos Laborales del Servicio de Salud de las Islas Baleares, que será trasladado al órgano competente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otro lado, por lo que respecta al requisito mencionado en el apartado g) del apartado «Requisitos y condiciones de los aspirantes» de las bases de la Resolución de convocatoria, relativo a los delitos de naturaleza sexual, para los aspirantes con nacionalidad española este requisito será comprobado de oficio por el Servicio de Salud en la fase de adjudicación, salvo que el aspirante manifieste expresamente en la solicitud que se opone a ello; en este caso tendría que aportar la documentación acreditativa en el plazo que se indique en la fase de adjudicación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En los casos de aspirantes extranjeros o con otra nacionalidad además de la española, tienen que aportar también un certificado negativo de antecedentes penales de su país de origen o del estado del cual tengan la nacionalidad, traducido y legalizado de acuerdo con los convenios internacionales. A tal efecto únicamente se valorarán los delitos previstos en el artículo 57.1 de la Ley orgánica 8/2021.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Particularidades sobre los requisitos de nacionalidad</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dado que no puede comprobarse de oficio si un aspirante que no tenga la nacionalidad española cumple algún otro requisito de nacionalidad y en ese caso tampoco pueden comprobarse ni su edad ni las titulaciones que haya obtenido fuera de España, en estos casos los aspirantes deben acreditarlos expresamente dentro del plazo para presentar solicitudes, telemáticamente si la documentación lo permite o presencialmente (véase el anexo 5).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por lo que respecta a la nacionalidad y la edad, además de lo que establece el apartado «Documentación acreditativa del vínculo de parentesco» de las bases reguladoras, estos aspirantes tienen que presentar una copia de la tarjeta de identidad de extranjero o de la tarjeta de residencia de familiar de ciudadano de la Unión Europea o, en su caso, un certificado de matrimonio o del hecho de vivir a expensas o estar a cargo de la persona que tenga la nacionalidad de un estado de la Unión Europea con quien tenga este vínculo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los cónyuges de las personas con nacionalidad de un estado de la Unión Europea o de algún estado donde sea aplicable la libre circulación de los trabajadores tienen que suscribir una declaración responsable en que expresen que no ha recaído acuerdo o declaración de nulidad del vínculo matrimonial, separación de derecho o divorcio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas con nacionalidad de un estado de la Unión Europea o de algún estado donde sea aplicable la libre circulación de los trabajadores tienen que aportar una copia del certificado de registro acompañada de una copia de su documento de identidad o pasaporte en vigor.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Particularidades sobre los requisitos de titulación</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por lo que respecta a las titulaciones obtenidas fuera de España, además de lo que establece el apartado «Acreditación de las titulaciones académicas y/o especialidades en los casos en que sea procedente» también son aplicables los requisitos siguientes:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Formación académica: en los casos de titulaciones obtenidas fuera de España, es necesario aportar la credencial de reconocimiento, homologación o validación, según sea procedente, de la titulación expedida por el ministerio español que sea competente en materia de educación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Formación especializada: debe acreditarse con el título de especialista en Ciencias de la Salud expedido por el órgano competente de cualquier otro estado siempre que se acompañe del reconocimiento y/o la homologación expedida por dicho ministerio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El personal especialista interno residente que haya completado la formación y que en la evaluación final haya obtenido la calificación positiva puede acreditar este mérito con un certificado expedido por el jefe de estudios o el presidente de la comisión de docencia y con el visto bueno del gerente del centro sanitario donde haya cursado la especialidad, en el cual debe constar expresamente la fecha de finalización del programa formativo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dado que las titulaciones obtenidas fuera de España no pueden comprobarse de oficio, los aspirantes tienen que acreditarlas dentro del plazo para presentar solicitudes, telemáticamente si la documentación lo permite o presencialmente (véase el anexo 5) y según lo que establece el apartado «Acreditación de las titulaciones académicas y/o especialidades en los casos en que sea procedente» de las bases de la Resolución de la convocatoria.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.&nbsp; &nbsp; Inicio del trámite telemático y presentación de documentación acreditativa</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El trámite telemático consta de las fases siguientes:</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Fase 1 («Debe saber»): se informa sobre la disponibilidad de las instrucciones generales del trámite.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">– Fase 2 («Rellenar»): se consignan los datos personales (pueden corregirse o completar los datos si se detecta algún error u omisión o si ha habido algún cambio, pero teniendo en cuenta que los efectos de la corrección se circunscriben a este proceso de selección) y los datos de la convocatoria concreta, con los que se identifican estos aspectos:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1) Categoría y/o especialidad a la que se opta.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2) Sector/isla a la que se opta:</span></span></p> <ol class="nobullet" start="1" style="margin-left:80px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Sector: si se concurre a las categorías facultativo/facultativa de área o médico/médica de urgencia hospitalaria hay que seleccionar el sector sanitario (o sectores) al que se opta.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Isla: si se concurre a las categorías de médico/médica de familia en equipo de atención primaria, facultativo/facultativa especialista en pediatría y puericultura de área y en equipo de atención primaria, farmacéutico/farmacéutica de área de atención primaria o médico/médica de urgencias en atención primaria hay que seleccionar la isla (o islas) a la que se opta.</span></span></li> </ol> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes pueden inscribirse a más de un sector o isla, no obstante, el día del examen tendrán que escoger el sector o isla a la que finalmente optan. No pudiendo optar a más de uno.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3) Turno: solo un turno por cada sector o isla (turno libre, turno libre para personas con discapacidad, turno de promoción interna o turno de promoción interna para personas con discapacidad).</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4) Nivel de estudios y titulación académica y/o especialidad: en cuanto a los títulos universitarios, hay que indicar el país y la fecha de obtención del título, del reconocimiento o de la homologación. Si se selecciona la especialidad hay que indicar la vía de obtención, de reconocimiento o de homologación.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5) Isla (Mallorca, Menorca o Ibiza) e idioma en que se quiere hacer el examen de la fase de oposición.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6) Declaración responsable y autorizaciones:</span></span></p> <ol class="nobullet" start="1" style="margin-left:80px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Hay que señalar que se declara que todos los datos consignados son ciertos y que se cumplen todos los requisitos establecidos en los apartados «Requisitos y condiciones de los aspirantes», «Turno de promoción interna» y «Turno de reserva para personas con discapacidad» (según cada caso proceda) de las bases de la Resolución de convocatoria, que se pueden acreditarse documentalmente y que la documentación aportada es auténtica.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7) Se puede dar consentimiento para que el Servicio de Salud obtenga datos sobre inscripciones y anotaciones, experiencia profesional, conocimientos, formación, docencia, actividades científicas y de difusión del conocimiento, investigación, cooperación al desarrollo y ayuda humanitaria que estén relacionados con este proceso de selección y que figuren en registros de las administraciones públicas y de sus entes instrumentales (organismos públicos, de naturaleza privada y titularidad pública y consorcios), universidades públicas, corporaciones de derecho público (colegios profesionales, cámaras oficiales y federaciones deportivas, etc.), o cualquier otro ente público.</span></span></p> <p style="margin-bottom:0px; No obstante, están exentos de pagar la tasa quienes acrediten un grado de discapacidad igual o superior al 33 % en el momento de cursar la solicitud.
