El &lt;span style="background-color:#ffffff"&gt;1&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;0 &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;octubre&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;2025&lt;/span&gt;, las organizaciones sindicales y empresariales firmantes del Convenio Colectivo del sector de Hostelería&lt;span style="background-color:#ffffff"&gt; de la Comuni&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;dad&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;Autónoma&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; de l&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s I&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;l&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;as&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; Balear&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt; se reunieron para constituir la Comisión paritaria del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El &lt;span style="background-color:#ffffff"&gt;16 d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;octubre de 2025&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Tatiana Manuela Muñoz Sánchez&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;,&lt;/span&gt; en representación de la Comisión Paritaria del Convenio Colectivo, solicitó el registro, el depósito y la publicación de la citada Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El artículo 90.3 del Texto Refundido de la Ley del Estatuto de los Trabajadores, aprobado por el Real Decreto Legislativo 2/2015, de 23 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios, acuerdos colectivos de trabajo y planes de igualdad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El artículo 45 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Inscribir y depositar el Acta de constitución de la Comisión Paritaria del Convenio colectivo del sector de Hostelería&lt;span style="background-color:#ffffff"&gt; de la Comuni&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;dad&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;Autónoma&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; de l&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s I&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;l&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;as&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; Balear&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;, de 10 &lt;span style="background-color:#ffffff"&gt;d&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;e &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;octubre &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;2025 &lt;/span&gt;, en el Registro de Convenios Colectivos de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Disponer la publicación del acta en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Ordenar la traducción del texto a la lengua catalana y hacer constar que la versión castellana del texto es la original firmada por la Comisión Paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Notificar esta Resolución a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En Palma, a 10 de octubre 2025 a las 10.00 horas, se reúnen las anteriores personas en la sede social del TAMIB de Mallorca, en respuesta a la convocatoria efectuada por UGT de las organizaciones firmantes del Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se deja constancia de que la organización empresarial ASHOME ha manifestado su adhesión al XVII CCHIB. Se hace entrega a los asistentes de dicha comunicación, y se toma nota por todas las partes de dicha adhesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se acuerda constituir y celebrar la primera reunión de la Comisión Paritaria del Convenio Colectivo Sectorial de Hostelería de la Comunidad Autónoma de las Illes Balears (en adelante, "&lt;strong&gt;Comisión Paritaria&lt;/strong&gt;") por las personas arriba relacionadas para el ejercicio de las funciones no normativas, de acuerdo con lo previsto en la Disposición adicional segunda del texto convencional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No ha sido posible constituir la Comisión dentro de los quince días que establece la disposición referida, debido a problemas de agenda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se deja constancia de que el texto articulado del convenio colectivo de referencia se ha publicado en el Boletín Oficial de les Illes Balears (BOIB), el pasado día 5 de agosto de 2025, núm. 104.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Miembros de la Comisión Paritaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las organizaciones firmantes del convenio colectivo designan como miembros de la comisión paritaria a las personas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por la parte Sindical:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por &lt;strong&gt;UGT&lt;/strong&gt;, que ocupará las cuatro plazas que consta la parte sindical, se designa a Cecilia Brizuela Mosquera, Esther Martín Molina, Antonio Sánchez Campillo y José García Relucio y como asesor Lorenzo Navarro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por &lt;strong&gt;ABONE&lt;/strong&gt; se designa a Miguel Pérez Marsá y asesor D. Miguel Planas Font.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sin perjuicio de lo expuesto en el párrafo anterior, los designados como miembros de la Comisión podrán ser sustituidos, previa comunicación escrita a la Comisión Paritaria. Asimismo, podrán comparecer suplentes puntualmente, debidamente acreditados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se debate acerca de la secretaría de la comisión paritaria, proponiéndose por UGT que dicha función se asuma por parte de FEHM. Se acuerda que la secretaría de actas se asuma por Javier Sola, secretaría de FEHM.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se acuerda que la persona que actúe como Secretario/a redacte el acta de cada reunión dentro de los siete días siguientes a su celebración y la circule a las partes para su revisión. El acta se aprobará y firmará en la reunión siguiente de la Comisión, por los asistentes a la misma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las actas recogerán los asistentes, el orden del día y los acuerdos o desacuerdos que se adopten, y se adjuntarán los documentos que se aporten o acuerden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las manifestaciones de parte serán dictadas por el ponente que las quiera realizar y, si son extensas, las hará aportando escrito firmado. El acta de la presente reunión es aprobada y firmada en el día de la fecha.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Javier Sola Ortiz, con DNI 50.981.058-V y a Dña. Tatiana Manuela Muñoz Sánchez, con DNI 05290154- Q para que cualquiera de ellos indistintamente proceda a los trámites de inscripción y registro de la misma ante la autoridad laboral, y solicitud de su publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como Vds. conocen, el pasado 8 de julio de 2025 se alcanzó un acuerdo en el marco del proceso de negociación iniciado para la aprobación del XVII Convenio Colectivo sectorial de hostelería de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Asociación Hotelera a la que represento decidió de acuerdo a sus estatutos trasladar el preacuerdo a la Asamblea para su valoración. Tras este proceso de votación interna, se ha tomado la decisión de adherirse al XVII Convenio Colectivo Sectorial de Hostelería de las Illes Balears, lo que se les comunica a los efectos legales oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D. Luis Huerta Pérez, actuando en nombre y representación de la entidad &lt;strong&gt;ARABELLA HOTELS, S.L.U&lt;/strong&gt;, con domicilio en C/ Raixa, 2 - Urbanización Son Vida, 07013, Palma de Mallorca; email luis.huerta@buadeslegal.com y teléfono 971.229.353 ante la Comisión paritaria del XVII Convenio Colectivo del sector de la Hostelería de les Illes Balears (2025-2028) comparece a los efectos de realizar la siguiente CONSULTA sobre la interpretación y aplicación del artículo 25 del propio convenio:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I. El artículo 25 del Convenio Colectivo regula las situaciones especiales que afectan al salario base, refiriendo que, en relación a las empresas de hospedaje y alojamiento, las personas trabajadoras que ocupen el puesto de “Jefe/A de Bares”, se incluirá en el nivel salarial I. Asimismo, prevé que las personas que ocupen el puesto de “Segundo/a jefe/a de bares”, se incluirán en el nivel salarial II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ambas referencias se realizan en plural. Es decir, refiriéndose a más de un bar. En el convenio anterior (XVI Convenio Colectivo Illes Balears 2023-2025), como situación especial que afectara al salario base, se incluía también a las personas trabajadores que ocuparan el puesto de "Jefe/a de Bares”, indicando expresamente que ocupa dicho puesto quien contara con responsabilidad departamental directa y al mando de arios puntos de venta. Referencia a varios puntos de venta que no se realiza en la redacción del actual Convenio Colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A razón de ello, se plantea ante esta Comisión Paritaria si el citado artículo 25 del nuevo convenio debe interpretarse en el sentido de que únicamente se incluirán en el nivel salarial I a las personas que ocupen el puesto de Jefe/a de bares, y en el nivel salarial II a quienes ocupen el puesto de Segundo Jefe/a de bares, siempre y cuando estos se encuentren al mando de varios puntos de venta o si, por el contrario, la simple ocupación del puesto de trabajo en cuestión, da derecho a percibir el señalado nivel retributivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;II. Para el supuesto de que se interprete el citado artículo 25 del Convenio en el sentido de no exigir que dichos trabajadores se encuentren al mando de varios puntos de venta, se consulta qué sentido tiene incluirlo como una "situación especial que afecta al salario base” si las propias tablas salariales ya incluyen a dichos puestos (“Jefe de Bar” y “Segundo Jefe de Bar”) y esta vez en singular, como adscritos al nivel retributivo I y II, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SOLICITA. -&lt;/strong&gt; Que, teniéndose por formulada la presente consulta a la Comisión paritaria del XVII Convenio Colectivo del sector de la Hostelería de les Illes Balears (2025-2028) se proceda a interpretar el artículo 25 del Convenio en el sentido expuesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
