    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTES DE HECHO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Por decreto de Alcaldía de fecha 15/10/2020 se aprobaron las bases de concesión de las autorizaciones de venta ambulante en los mercados anuales del término municipal de Calvià ( BOIB nº 179, de 17 de octubre de 2020)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;En el artículo 11.2 de las citadas bases se establecían las siguientes categorías permitidas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;1.- ALIMENTACIÓN. Frutas y verduras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;2.- ALIMENTACIÓN. Pan y repostería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;3.- ALIMENTACIÓN. Charcutería y conservas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;4.- ALIMENTACIÓN. Frutos secos, encurtidos y golosinas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;5.- ALIMENTACIÓN. Carnes “al ast” y comidas preparadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;6.- PLANTAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;7.- TEXTILES. Ropa de calle.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;8.- TEXTILES. Ropa interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;9.- TEXTILES. Ropa de hogar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;10.- CALZADO.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;11.- MARROQUINERÍA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;12.- JOYERÍA Y COMPLEMENTOS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;13.- BAZAR. Menaje de hogar y decoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;14.- BAZAR. Productos electrónicos, accesorios y papelería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;15.- PRODUCTOS ARTESANALES Y ECOLÓGICOS NO COMESTIBLES.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Por decreto de Alcaldía de fecha 13 de junio de 2024 (BOIB nº 88, de 4 de julio de 2024) se aprobó la creación de tres nuevos mercados periódicos semanales en el municipio de Calvià. En el apartado tercero del citado decreto se resolvió autorizar una serie de categorías dado su interés y atractivo, conforme la previsión del artículo 17.1.h del reglamento municipal de mercados, que eran las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;1.- ALIMENTACIÓN. Frutas y verduras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;2.- ALIMENTACIÓN. &lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;5.- ALIMENTACIÓN. &lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;7.- PRODUCTOS ARTESANALES Y ECOLÓGICOS NO COMESTIBLES. Los productos artesanales con carta de artesano vigente otorgada por el Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;8.- TEXTIL. Ropa interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Por Decreto de Alcaldía de fecha 28 de octubre de 2024 (BOIB nº142, de 29 de octubre de 2024) se aprobó autorizar una nueva categoría de productos para estos tres mercados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;9. VENTA ARTESANAL DE PRODUCTOS. En esta categoría se incluyen: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;Productos de artesanía creativa, que es aquella cuya creación, producción, transformación o restauración de productos estéticos con características específicas inspiradas en formas, modelos, elementos decorativos y estilos, dependen del vendedor que se encarga de su confección, construcción o realización. Dentro de esta categoría se incluye: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;ol class="lower-alpha" start="1" style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Producto balear en su más amplia gama de artículos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Productos derivados del sector de la piel balear&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Otros productos que por su interés y atractivo puedan ser autorizados por la Alcaldía. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:null"&gt;Por Decreto de Alcaldía de fecha 29 de noviembre de 2024 ( BOIB nº 15 de 1 de febrero de 2025) se aprobó la ampliación de las categorías de los nuevos mercados implantados en el término de Calvià. En esta resolución se detallaban ampliación las siguientes categorías:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;10. TEXTIL. Ropa de calle. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;11. TEXTIL. Ropa de hogar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;12. MARROQUINERÍA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;13. CALZADO.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;14. JOYERÍA Y COMPLEMENTOS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;15. BAZAR. Menaje de hogar y decoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;16. BAZAR. Productos electrónicos, accesorios y papelería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;Con la puesta en marcha del plazo de presentación de solicitudes de renovación de los puestos de los mercados y de las nuevas solicitudes, al presentarse la misma solicitud para todos los mercados ambulantes del municipio, se ha detectado que la numeración de las categorías permitidas no es exactamente la misma en los mercados tradicionales ambulantes ya implantados hace tiempo y los mercados de nueva implantación, llevando a la posible confusión. Por ello, se considera necesario unificar las categorías en un único listado que sea de aplicación tanto para los mercados tradicionales ya existentes y los de nueva implantación,todo ello conducente a mejorar la gestión a la hora de la organización de los puestos de los mercados ambulantes semanales municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;VALORACIÓN JURÍDICA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El artículo 17 del Reglamento municipal, en el punto 1.h establece la posibilidad de que por Alcaldía se puedan autorizar por su interés y atractivo, una serie de productos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:95%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El artículo 88.6 de la Ley 39/2015 dispone que “la aceptación de informes o dictámenes servirá de motivación a la resolución cuando se incorporen al texto de la misma”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;Examinada la normativa anterior, al amparo del artículo 13 del reglamento municipal y demás normativa aplicable, en virtud de la facultad conferida en el artículo 21 de la Ley 7/1985, de 2 de abril, de Bases de Régimen Local, y en virtud de la delegación conferida por decreto de Alcaldía de fecha 12/01/2024,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.- UNIFICAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;las categorías de productos permitidos en los mercados ambulantes municipales, estableciendo las siguientes categorías: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Pan y repostería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;03.- ALIMENTACIÓN. Charcutería y conservas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;04.- ALIMENTACIÓN. Frutos secos, encurtidos y golosinas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;05.- ALIMENTACIÓN. Carnes “al ast” y comidas preparadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;06.- PLANTAS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ropa Interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;PIE DE RECURSO.&lt;/strong&gt; -Lo que traslado a Vd. a los efectos que procedan, significándole que, contra la presente resolución, que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con lo dispuesto en el art. 123 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas. El plazo para interponerlo es de un mes a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto expresamente el de reposición o se haya producido la desestimación presunta del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;El recurso de reposición deberá presentarse en el Registro General de este Ajuntament o en las dependencias y medios a que se refiere el art. 16.4 de la Ley 39/2015 antes citada, y se entenderá desestimado cuando no se resuelva y notifique en el plazo de un mes, a contar del día siguiente a su interposición, quedando en este caso expedita la vía contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;De no utilizar el recurso potestativo de reposición, cabe interponer directamente recurso contencioso-administrativo, conforme a lo establecido en el artículo 123 anteriormente citado, y en los artículos 45 y siguientes de la Ley 29/98, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa, ante los Juzgados de lo Contencioso-Administrativo de los de Palma de Mallorca en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación. Ello sin perjuicio de cualquier otro recurso o acción que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
