&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En fecha 27 de agosto de 2024 se publicó en el BOIB núm. 112 la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se convoca un proceso extraordinario de acceso o progresión en la carrera profesional del personal estatutario dependiente del Servicio de Salud correspondiente a los años 2018-2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En fecha 19 de noviembre de 2024 se publicó la lista provisional de admitidos y excluidos en la convocatoria mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los aspirantes siguientes presentaron alegaciones contra su exclusión de la lista provisional:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Los aspirantes fundamentaban las alegaciones en el hecho de que iniciaron el procedimiento electrónico de solicitud de carrera pero no formalizaron y registraron la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Estas alegaciones se desestimaron por medio de la Resolución del director general del Servicio de Salud por la que publicaba en el BOIB núm. 164, de 14 de diciembre de 2024, la lista definitiva de personas que adquieren o progresan de nivel en la carrera profesional, la lista de excluidos y la lista de inadmitidos en la convocatoria extraordinaria mencionada. Posteriormente, las listas definitivas se modificaron en dos ocasiones, por medio de resoluciones del director general del Servicio de Salud publicadas en el BOIB núm. 89, de 12 de julio de 2025, y en el BOIB núm. 121, de 11 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Contra la Resolución del director general del Servicio de Salud publicada el 14 de diciembre de 2024 se interpusieron los recursos de reposición siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. En fecha 14 de octubre de 2025, el Juzgado de lo Contencioso-Administrativo núm. 4 de Palma dictó una sentencia estimatoria de las pretensiones de la señora Josefa Endrina Martín.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El resto de los recursos contencioso-administrativos mencionados están pendientes de resolución judicial&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos jurídicos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 109 de Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (en adelante, LPAC), establece que las administraciones públicas pueden revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de gravamen o desfavorables, siempre que esta revocación no constituya dispensa o exención no permitida por las leyes, ni sea contraria al principio de igualdad, al interés público o al ordenamiento jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 110 de la LPAC establece los límites a esta revisión, que no puede ejercerse cuando, por prescripción de acciones, por el tiempo transcurrido o por otras circunstancias, su ejercicio sea contrario a la equidad, a la buena fe, al derecho de los particulares o a las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El artículo 69 de la LPAC establece que si la solicitud de iniciación no reúne los requisitos que señala el artículo 66, y, en su caso, los señalados en el artículo 67 u otros exigidos por la legislación específica aplicable, debe requerirse al interesado para que, en un plazo de diez días, repare la falta o adjunte los documentos preceptivos, con indicación de que, si no lo hace, se considera que desiste de su petición, previa resolución que debe ser dictada en los términos establecidos en el artículo 21.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtud de este artículo, debería haberse requerido a las personas interesadas para que enmendaran la solicitud, lo cual no se hizo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El artículo 35.1 de la LPAC dispone que los actos que se dicten en el ejercicio de potestades discrecionales deben ser motivados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Sentencia 102/2025 dictada por el Juzgado de lo Contencioso-Administrativo núm. 4 en las actuaciones del procedimiento abreviado núm. 178/2025 estima las pretensiones de la recurrente Josefa Endrina Martín porque —aunque acepta que no completó ni firmó la solicitud y, por tanto, no finalizó el proceso— considera que aplicando la jurisprudencia del Tribunal Supremo se le debería haber dado la posibilidad de enmienda por medio del trámite que se prevé en el artículo 68 de la Ley 39/2015. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Sentencia 954/2022, de 2 de julio, del Tribunal Supremo, citada en el fundamento jurídico segundo de la Sentencia 102/2025, estableció lo siguiente [texto original]:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Sería sumamente difícil -por no decir imposible- argumentar que la previsión legal del carácter subsanable de la omisión de firma en las solicitudes no es aplicable a las solicitudes presentadas por vía electrónica. Ello vale igualmente para aquellas omisiones que, sin referirse a la firma electrónica propiamente dicha, afectan a la "acreditación de la autenticidad de la voluntad" del solicitante, como podría ser el paso final de validar lo formulado y enviado por vía electrónica."&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El artículo 51 de la LPAC determina que el órgano que anule las actuaciones debe disponer siempre la conservación de aquellos actos y trámites cuyo contenido se habría mantenido igual si no se hubiera cometido la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El artículo 76 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa (en adelante, LJCA) prevé que si, una vez interpuesto recurso contencioso-administrativo, la administración demandada reconoce totalmente en vía administrativa las pretensiones del demandante, cualquiera de las partes puede ponerlo en conocimiento del juzgado con el objeto de que dicte un auto por el que declare terminado el procedimiento y ordene el archivo del recurso, si el reconocimiento no infringe manifiestamente el ordenamiento jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Estimar los anteriores recursos de reposición interpuestos contra la Resolución del director general del Servicio de Salud por la que se publicó la lista definitiva de admitidos (BOIB núm. 164, de 14 de diciembre de 2024), y anularla parcialmente, por ser contraria a derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Retrotraer el procedimiento extraordinario convocado por la Resolución del director general del Servicio de Salud de las Islas Baleares de fecha 26 de agosto de 2024 al trámite de alegaciones contra la lista provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Estimar las alegaciones presentadas por los aspirantes mencionados y, en consecuencia, requerirlos para que en un plazo de 10 días enmienden la solicitud manifestando la voluntad expresa de firmar y finalizar el proceso. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Conservar el resto de actos y de trámites del procedimiento, de conformidad con el artículo 51 de la LPAC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Notificar esta resolución a las personas interesadas y a los servicios administrativos para que le den cumplimiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Comunicar esta resolución a la Abogacía de la CAIB y al Juzgado de lo Contencioso-Administrativo núm. 4 a efectos de que se archiven las actuaciones judiciales por causa del reconocimiento extraprocesal de las pretensiones de los recurrentes, de conformidad con lo que se establece en el artículo 76 de la LJCA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso potestativo de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente a la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También puede interponerse directamente un recurso contencioso administrativo ante la jurisdicción de lo contencioso-administrativo en el plazo de dos meses a contar desde el día siguiente a la notificación, de acuerdo con el artículo 46 de la Ley&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
