Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores. La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54).</p> <p>2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos e importes correspondientes.</p> <p>3. El 8 de septiembre de 2022, en el BOIB núm. 118, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, RES1 de fecha 1 de septiembre de 2022, en la que se incluye FRANCESC PASCUAL SUASI (núm. Exp. CEJA2021_1/118), con un importe de 40.000,00 €.</p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p>4. El 25 de abril de 2025 (registro de entrada GOIBE290890), el beneficiario presenta la solicitud del segundo pago y el servicio de gestión de ayudas al desarrollo rural revisa el expediente y se comprueba que no alcanza 25 UBM para ser beneficiario del complemento de orientación ganadera de 5.000,00 € .</p> <p>5. El 23 de septiembre de 2025 se notifica a la persona interesada a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones, mediante publicación en la página web del FOGAIBA, el informe Propuesta provisional de resolución de la revocación parcial por no cumplir con el complemento de orientación productiva ganadera de 25 UBM que había indicado. Una vez transcurridos los 10 días hábiles, la persona interesada no ha presentado alegación alguna.</p> <p>6. Este hecho implica realizar una revocación parcial de 5.000,00 €, por tanto, el importe de ayuda auxiliable es de 35.000,00 € y el pago corre<span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:120%"><span style="color:#000000"><span style="display:inline-block"><span style="color:#000000">spondiente al 2º tramo será de una cuantía de 15.000,00 €.</span></span></span></span></span></span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="color:#000000"><span style="line-height:115%"><span style="display:inline-block"><span style="color:#000000">1. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </span></span></span></span></span></span></p> <p style="text-align:center"><strong>Propuesta de Resolución</strong></p> <p>Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:</p> <p>1. Revocar parcialmente las resoluciones de ayuda concedidas a las personas beneficiarias por el importe y con los plazos detallados en el anexo de esta resolución, que es de 1 expediente y que comienza y termina con FRANCESC PASCUAL SUASI que suma un importe total de 5.000,00 € euros, relativa a la línea de ayuda “Creación de empresas de jóvenes agricultores”.</p> <p>2. Finalizar el procedimiento de revocación del expediente CEJA2019_1/118.</p> <p>3.
