    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que el Consejo Ejecutivo de este Consejo Insular, en sesión de carácter ordinario de 16 de diciembre de 2024, aprobó la convocatoria de las ayudas de minimis para la creación en artes visuales y proyectos audiovisuales y de la convocatoria para el año 2024 (BOIB núm. 13, de 28 de enero de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que el plazo de presentación de solicitudes finalizó el día 28 de marzo de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que una vez revisada la documentación de los solicitantes por la instructora de la convocatoria, se han convocado las dos comisiones evaluadoras previstas en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista el acta de la comisión evaluadora de las líneas 1 a 4, reunida el 18 de agosto de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista el acta de la comisión evaluadora de la línea 5, reunida el 2 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la nota jurídica con fecha 7 de octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que la convocatoria prevé un presupuesto de 10.000€ para las líneas 1, 2 y 4, de 15.000€ para la línea 3 y de 45.000€ para la línea 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que en caso de que no se agote la consignación presupuestaria de una línea, la cantidad sobrante se asignará a una de las otras líneas de ayudas por el siguiente orden de preferencia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Investigación 2. Formación 3. Producción de obra 4. Producción de exposiciones y 5. Proyectos audiovisuales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la propuesta de la instructora de la convocatoria que consta en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que la interventora accidental ha fiscalizado favorablemente la concesión de las ayudas, mediante firma de la propuesta de la instructora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que el artículo 33.2.K de la Ley 4/2022, de 28 de junio, de consejos insulares, establece como atribución de los consejeros ejecutivos resolver las convocatorias de ayudas y subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como titular del Departamento de Cultura, Educación, Juventud y Deportes, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, en relación al Decreto de presidencia núm. 91/2023 de 10 de julio, de creación de los departamentos (BOIB núm. 95 de 11 de julio de 2023);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESUELVO&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;Conceder las ayudas a los proyectos de investigación artística (línea 1) correspondientes al año 2024 que seguidamente se relacionan:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;BENEFICIARIO: Cristòfol Pons Bendito&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MOTIVO: La comisión evaluadora ha revisado este proyecto, y después de valorarlo según los requisitos de la convocatoria, ha valorado que no llega a la puntuación mínima de 10 puntos, requerida en el punto 7 A) de las bases, en cuanto a la calidad de la propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;Desestimar la ayuda a la siguiente solicitud de proyecto de investigación artística (línea 1) correspondiente al año 2024 por el motivo que se especifica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SOLICITANTE: Núria Marquès Marroquín&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MOTIVO: La solicitante presenta una instancia genérica, pero no aporta la documentación requerida de acuerdo con las bases de la convocatoria. Con fecha 19 de junio de 2025, la instructora de la convocatoria requiere a la solicitante que subsane la solicitud. Pasado el plazo de diez días hábiles, contados desde el día siguiente de haber recibido el requerimiento de subsanación de la solicitud, la persona interesada no ha presentado la documentación requerida. Por tanto, se entiende que ha desistido de su petición de conformidad con el artículo 68 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe total concedido de la línea 1 es de 10.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto. &lt;/strong&gt;Conceder las ayudas a las siguientes solicitudes para proyectos de formación artística (línea 2) correspondientes al año 2024 que seguidamente se relacionan:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con la base octava de la convocatoria, «el remanente que pueda quedar a consecuencia de esta situación podrá concederse a los solicitantes siguientes de la misma línea de ayudas. Si ese importe es inferior a un 50% del presupuesto del proyecto, la Comisión Evaluadora podrá proponer destinarlo a otra línea de ayudas de acuerdo con las condiciones que se prevean en la convocatoria».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MOTIVO: La comisión evaluadora ha revisado este proyecto, y después de valorarlo según los requisitos de la convocatoria, ha valorado que no puede ser beneficiario de la ayuda con motivo de que no llega al mínimo de 25 puntos en lo que respecta a la calidad e interés del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe total concedido de la línea 5 es de 45.143,01 €, resultado de la suma de los 143,01 € de remanente que ha quedado de las líneas 1 a la 4 y de los 45.000 € que, de acuerdo con el crédito presupuestario establecido en las bases de la convocatoria, deben destinarse para la línea 5 de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Undécimo. &lt;/strong&gt;Determinar que el importe total de las ayudas concedidas a la convocatoria asciende al importe de 90.000 € con cargo al programa presupuestario 33400 Creación y Promoción Cultural (aplicación presupuestaria 4-33400-4890006).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Duodécimo. &lt;/strong&gt;La resolución del expediente de concesión o denegación de las ayudas se remitirá a la Base de Datos Nacional de Subvenciones, en cumplimiento del art. 20.8 b de la LGS y se publicará en el Boletín Oficial de las Illes Balears y en la web del Consejo Insular de Menorca www.cime.es, y figurarán los datos identificativos de las personas interesadas. La publicación en el BOIB tiene los efectos de notificación de acuerdo con el art. 45.1 b de la LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra este acuerdo – que no agota la vía administrativa – puede interponerse recurso de alzada ante el Consejo Ejecutivo en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dicho recurso se entenderá desestimado, si no se notifica la correspondiente resolución, cuando hayan transcurrido tres meses desde su interposición. Contra la desestimación del recurso de alzada por silencio administrativo podrá interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
