Con fecha de 21 de diciembre de 2021 se publicó, en el Boletín Oficial de las Islas Baleares núm. 174, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias para el año 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 12 de abril de 2024, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Illes Balears número 52, de 20 de abril de 2024, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto, por un importe de 59.377,50€.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Dada la Resolución de concesión de la citada ayuda, y de acuerdo con lo establecido en el apartado undécimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y a justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 16 de enero de 2025 se efectuó el pago de la solicitud parcial por importe de 46.552,50 €, el importe elegible remanente de justificar era de 28.500, 00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El 18 de enero de 2025, el beneficiario registra la solicitud de pago final con un cambio de inversión en el rastrillo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El 1 de septiembre de 2025 presenta por registro con GOIBE núm. 607714/2025 los 2 presupuestos alternativos necesarios para realizar el cambio de inversión.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El 12 de septiembre de 2025, se emite el informe de moderación de coste por cambio de inversión del rastrillo por un importe elegible total de 24.000,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. El importe elegible inicial era de 131.950,63 € por tanto la diferencia es de 4.500,00 € que corresponden a una revocación parcial de 2.025,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionado a los que está condicionado a la concesión de los mismos. de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. El día 16 de septiembre de 2025, se publica en la web del FOGAIBA la notificación de la deficiencia al beneficiario con un aviso con el enlace por SMS. El interesado no presenta alegaciones en el plazo establecido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. Ante todo esto, se propone realizar la revocación parcial de la ayuda concedida al beneficiario como se indica en el anexo adjunto de esta resolución.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de Resolución </span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Revocar parcialmente la ayuda concedida a AGROCOLL BALEAR, SAT con NIF V57414849 (exp.: INEA2021_1/268), por un importe de 2.025,00 €.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Finalizar el procedimiento y archivar el expediente INEA2021_1/268. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares. </span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interposición de recursos</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas. </span></p> <p><span style="font-family:Times New Roman,Times,serif;
