&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1.El Decreto 10/2025, de 14 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, establece que el Instituto Balear de Infraestructuras y Servicios Educativos (IBISEC) es un ente del sector público instrumental adscrito a la Consejería de Educación y Universidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2.El 21 de agosto de 2025, el presidente del Instituto Balear de Infraestructuras y Servicios Educativos (IBISEC) y consejero de Educación y Universidades, emite Resolución por la cual se nombra a la gerente de este ente público (BOIB núm. 112, de 23 de agosto de 2025) quien, de acuerdo con el artículo 14 de los Estatutos del IBISEC, ostenta la calidad de órgano de contratación, correspondiéndole, por tanto, la facultad de nombrar a los miembros de la Mesa de Contratación del ente, así como dictaminar su carácter de permanente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público (LCSP).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público (LRJSP).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto 14/2016, de 11 de marzo, por el que se aprueba el texto consolidado del Decreto sobre Contratación de la CAIB (Decreto 14/2016).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 26/2016, de 13 de mayo, de aprobación de los nuevos estatutos del IBISEC (Decreto 26/2016), modificados por el Decreto 33/2019.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. El Decreto 10/2025, de 14 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Consideraciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El artículo 326 de la LCSP, que no tiene carácter básico conforme la disposición final primera de esta Ley, regula las Mesas de Contratación como órgano colegiado de asistencia al órgano de contratación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 3.1 del Decreto 14/2016 determina quiénes deben ser los miembros necesarios de la Mesa de Contratación para los organismos públicos de la CAIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.El artículo 3.2 del Decreto 14/2016 confiere expresamente, igual que la LCSP, la potestad de nombramiento de los miembros de la Mesa al órgano de contratación. A su vez,&amp;nbsp; la Mesa podrá constituirse para cada licitación o bien ser permanente, caso este en el que la normativa autonómica exige la publicación de la designación de sus miembros en el BOIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.Todo lo expuesto en el párrafo anterior se recoge en los artículos 14.2 &lt;em&gt;b)&lt;/em&gt; y 15 de los Estatutos del IBISEC regulados por el Decreto 26/2016, y modificados mediante el Decreto 33/2019.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo anterior, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:12.0pt"&gt;1.Constituir la Mesa de Contratación Permanente del IBISEC, de acuerdo con lo que establece el artículo 3 del Decreto 14/2016 por el que se aprueba el texto consolidado del Decreto sobre Contratación de la CAIB, compuesta por los siguientes miembros:&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:12.0pt"&gt;Presidente: Mateo Suñer Servera, Secretario Autonómico de Desarrollo Educativo de la Consejería de Educación y Universidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:12.0pt"&gt;2.&amp;nbsp; Dejar sin efecto las anteriores resoluciones sobre designaciones de miembros de la Mesa de Contratación Permanente del IBISEC.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:12.0pt"&gt;3.&amp;nbsp; Publicar esta Resolución en el BOIB y en el perfil del contratante del IBISEC.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:12.0pt"&gt;4.Esta Resolución entrará en vigor a partir de su publicación en el perfil del contratante del IBISEC, localizado en la Plataforma de Contratación del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
