CAIB 2025-10-04 CAIB text/html es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>BDNS840630: </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">El consejero ejecutivo de Presidencia, el día 30 de septiembre de 2025, ha dictado la siguiente resolución:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">"<strong>Antecedentes</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">1. El Consell Executiu de día 28 de mayo de 2025 aprobó el expediente de Convocatoria de subvención 2025 para entidades sin ánimo de lucro que realicen proyectos y actividades dirigidas a la atención y el empoderamiento de las personas en contexto de prostitución de la Part Forana de Mallorca (BOIB núm. 77, de 19 de junio de 2025).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">2. El día 19 de septiembre de 2025, el órgano instructor emitió informe relativo al cumplimiento por parte de las entidades de los requisitos necesarios para acceder a la subvención.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">4. La aportación económica que representa la convocatoria está prevista dentro del presupuesto del Consell de Mallorca para el año 2025 con cargo a la aplicación presupuestaria 00.23168.48901, y se dispone de los correspondientes certificados de existencia de crédito.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">5. La Intervención Delegada ha fiscalizado de conformidad en fecha 24 de septiembre de 2025.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>Fundamentos</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">1. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones, tal como establece la disposición adicional novena de la Ley 4/2022, de 28 de junio, de consells insulars.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">2. La Ordenanza General de Subvenciones del Consell Insular de Mallorca aprobada por el Pleno del Consell de Mallorca, en sesión de día 23 de diciembre de 2016 (BOIB núm. 21, de 18 de febrero de 2017), modificada por Acuerdo del Pleno de 14 de junio de 2018 (BOIB núm. 96, de 4 de agosto de 2018) en la que se establece el régimen jurídico general de las subvenciones otorgadas por el Consell Insular de Mallorca.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">3. La propia convocatoria de subvención para entidades sin ánimo de lucro que realicen proyectos y actividades dirigidas a la atención y el empoderamiento de las personas en contexto de prostitución en la Part Forana de Mallorca (BOIB núm. 77, de 19 de junio de 2025).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">4. Los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, en cuanto al objeto y plazos para interponer recurso de alzada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">5. Disponer un gasto de <strong>54.800,00 €</strong> a favor de las entidades con cargo a la partida presupuestaria 00.23168.48901.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">3. Revertir el sobrante por importe de <strong>45.200,00 €</strong> (A/ 920250012354).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">4. Notificar esta resolución a Intervención General y a las personas beneficiarias y remitir al BOIB y a la BDNS los datos relativos a las subvenciones concedidas para su publicación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Contra esta resolución, que no agota la vía administrativa, se puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">El recurso se puede interponer formalmente ante el consejo ejecutivo del Consell Insular de Mallorca, que es el órgano competente para resolverlo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma que corresponda, en el plazo de dos meses, a contar a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Si han transcurrido tres meses desde la interposición del recurso de alzada y no se ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y se puede interponer el recurso contencioso-administrativo ante el Juzgado de lo Contencioso-Administrativo dePalma que corresponda, sin limitación de tiempo.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">No obstante lo anterior, se puede interponer, en su caso, cualquier otro recurso que se considere oportuno.
