    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Se publica la resolución del consejero&lt;span style="display: none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo de Hacienda, Innovación y Función Pública, por delegación del Consejo Ejecutivo, según el acuerdo de 28 de septiembre de 2022, BOIB nº. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;“Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1.&amp;nbsp;En el BOIB nº. 120 de 13 de septiembre de 2022 se publicó el convenio firmado con el Ayuntamiento de Santa Maria del Camí; por el cual el Consejo de Mallorca se encargaba de la aprobación de las bases, la convocatoria y la gestión de los procesos de estabilización del empleo temporal que establece la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público, que derivan de las ofertas de empleo público aprobadas por el Ayuntamiento de Santa Maria del Camí (BOIB nº. &amp;nbsp;68 de 26 de mayo de 2022, BOIB nº. &amp;nbsp;75 de 9 de junio de 2022, BOIB nº. 124 de 22 de septiembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2.&amp;nbsp;En el BOIB nº. 133, de 10 de octubre de 2024 se publicó la aprobación de la prórroga por un año de la vigencia del convenio relativo al encargo de gestión de la entidad local mencionada, a favor del Consejo de Mallorca, que ratificaron el Ayuntamiento de Santa Maria con fecha de fin de prórroga de 9 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3.&amp;nbsp;Por&amp;nbsp;Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023 y BOIB nº. 19, de fecha 11 de febrero de 2023), y por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB nº. 121, de 30 de agosto de 2023), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del grupo B, del Ayuntamiento de Santa Maria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4.&amp;nbsp;En esta resolución se convocaron ocho plazas de la categoría/especialidad Educador/a escoleta del Ayuntamiento de Santa Maria.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5.&amp;nbsp;Por acuerdo del tribunal calificador competente de este proceso selectivo de estabilización, una vez concluidas la revisión y baremación de los méritos de los aspirantes, en fecha de 20 de mayo de 2025 se publicó, en el tablón electrónico de anuncios y en la sede electrónica del Consejo Insular de Mallorca, la lista definitiva de puntuaciones obtenidas por las personas aspirantes, con aplicación de los criterios de desempates y la resolución de las alegaciones formuladas a la lista provisional de puntuaciones, así como el listado de puestos correspondientes a las plazas convocadas, dando un plazo de 7 días hábiles para comunicar la orden de preferencia de los lugares ofrecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6.&amp;nbsp;Contra este acuerdo se interpusieron nueve recursos de alzada, que afectaban exclusivamente a la convocatoria de educador/a escoleta del Ayuntamiento de Santa Maria, a los cuales se dio trámite de audiencia con fecha de 26 de junio de 2025. Mediante Resolución del consejero ejecutivo de Hacienda y Función Pública, de fecha de 14 de julio de 2025 se estimó el recurso interpuesto por las recurrentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7.&amp;nbsp;Con fecha de 11 de septiembre se publicó la Rectificación del Acuerdo del Tribunal Calificador relativo a las alegaciones a la lista provisional de méritos, resolución de empates, aprobación de la lista definitiva de méritos del proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del grupo B, derivada de la oferta de empleo público extraordinaria de los ayuntamientos de Inca, Pollença y Santa Maria, del turno libre, con una segunda corrección de errores publicada con fecha de 17 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8.&amp;nbsp;Mediante Resolución del consejero Hacienda, Innovación y Función Pública de fecha 20 de septiembre de 2025 se aprobó la lista definitiva de personas aspirantes que han superado el proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del grupo B y ofrecimiento de puestos de trabajo del Ayuntamiento de Santa Maria (Educador/a Escoleta), con asignación de puestos de trabajo por turno de acceso para su contratación como personal laboral fijo.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9.&amp;nbsp;De conformidad con la base 8.8 de la convocatoria, con la finalidad de asegurar que se cubran las plazas convocadas, cuando haya renuncias de aspirantes seleccionados antes del nombramiento o la toma de posesión, el tribunal tiene que elevar al órgano convocante una relación complementaria de los aspirantes que estén situados a continuación de las personas propuestas, por orden de puntuación, para un posible ingreso como personal laboral fijo en sustitución de las que renuncien.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;10.&amp;nbsp;En fecha 23 de septiembre de 2025, sin que la mencionada Resolución se hubiera publicado en el BOIB, con registro de entrada nº. 81907/2025, la señora Isabel Maria Magdalena Gil Terrasa, con opción a la adjudicación como personal laboral fijo en la categoría/especialidad Educador/a Escoleta del grupo B del Ayuntamiento de Santa Maria, renunció a su participación en la convocatoria correspondiente, por lo cual el Tribunal calificador tiene que acordar la adjudicación a la siguiente persona por orden de prelación de la lista definitiva de puntuaciones de méritos del proceso, la señora Catalina Santoyo Isern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;11.&amp;nbsp;En fecha 25 de septiembre de 2025 el tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero de Hacienda, Innovación y Función Pública el Acuerdo de la propuesta de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del grupo B, derivado de la oferta de empleo público extraordinaria del Ayuntamiento de Santa Maria y de asignación de puestos de trabajo, por turno de acceso para su contratación como personal laboral fijo, de acuerdo con el trámite de manifestación de orden de preferencias efectuado, para su nombramiento como personal laboral fijo, la cual contiene tantas personas aprobadas como número de plazas convocadas. En el caso en que no se hubiera efectuado el trámite por parte de la persona aspirante, el puesto de trabajo ha sido asignado de oficio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de derecho&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1.&amp;nbsp;El artículo 91.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2.&amp;nbsp;El artículo 68 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3.&amp;nbsp;La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4.&amp;nbsp;La ley 20/2021 de 28 de diciembre de medidas urgentes para la reducción de la temporalidad en el empleo público&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5.&amp;nbsp;La ley 4/2022, de 28 de junio de consejos Insulares&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6.&amp;nbsp;El artículo 4 del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7.&amp;nbsp;La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023 y BOIB nº. 19, de fecha 11 de febrero de 2023), y por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB nº. 121, de 30 de agosto de 2023), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo (BOIB nº. 158, de 6 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo eso, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1.&lt;/strong&gt;&amp;nbsp;&lt;strong&gt;APROBAR &lt;/strong&gt;la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del grupo B del Ayuntamiento de Santa Maria (Educador-a escoleta); de acuerdo con lo que se indica al anexo I de esta resolución con indicación de la asignación de los puestos de trabajo correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;De conformidad con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2.&lt;/strong&gt;&amp;nbsp;&lt;strong&gt;Asignar los puestos de trabajo &lt;/strong&gt;correspondientes a la categoría del Ayuntamiento de Santa Maria (Educador-a escoleta), del grupo B, a las personas aspirantes que han superado el procedimiento selectivo de estabilización por el sistema de concurso excepcional para la convocatoria de estas plazas, de conformidad con la base 8.8 de la convocatoria y de acuerdo con el trámite de manifestación de orden de preferencias efectuado y la puntuación obtenida en el proceso selectivo. En caso de que no se haya efectuado este trámite por parte de la persona aspirante, el puesto de trabajo será asignado de oficio. Esta información se recoge en el Anexo I de este documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;3.&amp;nbsp;Informar &lt;/strong&gt;que la adjudicación y adscripción definitiva de los puestos de trabajo a las personas aspirantes mencionadas queda acondicionada a la acreditación de estar en posesión de todos los requisitos específicos para la adscripción al puesto de trabajo, que tendrá que ser requerida por cada Ayuntamiento. En caso de no acreditarlos, la adscripción del puesto de trabajo sería con carácter provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;4.&amp;nbsp;ORDENAR &lt;/strong&gt;la publicación de esta resolución y su anexo en el tablón de edictos y en la Sede electrónica del Consejo Insular de Mallorca, y al Boletín Oficial de las Islas Baleares.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra este acto, que no pone fin a la vía administrativa, se puede interponer recurso de alzada en el plazo de un mes, contador a partir del día siguiente de esta publicación. El recurso se puede interponer formalmente ante el Consejo ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación del recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no se ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
