CAIB 57731 700024 2025-10-04 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Pleno del Ayuntamiento de Ciutadella de Menorca, en sesión ordinaria celebrada con fecha de 18 de septiembre de 2025, aprobó inicialmente la modificación de la ordenanza fiscal núm. 15, reguladora de la tasa para la prestación del servicio de grúa municipal y custodia vehículos o de otros objetos voluminosos, retirados de la vía pública, así como para la utilización de aparatos inmovilizadores de vehículos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cumplimiento de lo dispuesto en el artículo 17.2 del Texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, el artículo 49.b) de la Ley 7/1985, reguladora de las Bases de Régimen Local y el artículo 102.1.b) de la Ley 20/2006 municipaly de Régimen Local de las Islas Baleares, se somete el expediente a información pública durante el plazo de 30 días a contar desde el día siguiente de la inserción de este anuncio en el BOIB para que los interesados puedan examinar y presentar las reclamaciones que consideren oportunas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Según el artículo 17.3 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real Decreto Legislativo 2/2004, finalizado el periodo de exposición pública, el Ayuntamiento de Ciutadella adoptará el acuerdo definitivo que sea procedente, resolviendo las reclamaciones que se hayan presentado y aprobando la redacción definitiva de la ordenanza en correspondencia con el acuerdo provisional. En caso de que no se pesenten reclamaciones, se entenderá definitivamente aprobado el acuerdo, hasta entonces provisional, sin necesidad de acuerdo plenario.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Ordenanza fiscal número 15</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tasa para la prestación del servicio de grúa municipal y custodia de vehículos o de otros objetos voluminosos, retirados de la vía pública, así como para la utilización de aparatos inmovilizadores de vehículos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.&nbsp;Fundamento y naturaleza</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En uso de las facultades otorgadas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y de conformidad con lo dispuesto en los artículos que van del 15 al 27 del texto refundido de la Ley reguladora de las haciendas locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, este ayuntamiento impone la tasa para la prestación del servicio de grúa municipal y custodia de vehículos u otros objetos voluminosos, retirados de la vía pública, así como para la utilización de aparatos inmovilizadores de vehículos, que se regirá por la presente ordenanza fiscal, cuyas normas se atienen a lo previsto en el artículo 57 en relación con el artículo 20.4, del citado texto refundido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.&nbsp;Hecho imponible</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constituye el hecho imponible de la tasa la prestación de servicios de carácter especial, tales como:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.La actividad de retirada por parte de la grúa municipal, provocada por quien haya estacionado indebidamente un vehículo o haya dejado en la vía pública cualquier objeto pesado o voluminoso, que perturbe la fluidez de la circulación rodada o de peatones. Y el traslado al depósito municipal o al lugar que se determine a tal efecto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.La estancia o la custodia del vehículo o del objeto retirado de la vía pública en el depósito municipal o lugar designado a tal efecto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.La utilización de aparatos inmovilizadores de vehículos, en las condiciones reglamentarias.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.</strong>&nbsp;<strong>Sujeto pasivo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Son sujetos pasivos los contribuyentes, las personas físicas o jurídicas y las entidades a las que la normativa tributaria impone el cumplimiento de obligaciones tributarias que den lugar a la prestación del servicio y, con carácter subsidiario, las que resulten propietarias del vehículo o del objeto retirado.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.</strong> <strong>Responsables</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Son responsables de las deudas tributarias, junto con los deudores principales, las personas físicas o jurídicas, así como entidades a las cuales se refiere la Ley General Tributaria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Tendrán que responder solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las cuales se refieren la Ley General Tributaria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Serán responsables subsidiarios los administradores de las sociedades y los síndicos, los interventores y liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con el alcance que señala el artículo 43 de la Ley General Tributaria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.&nbsp;Exenciones y bonificaciones</strong></span></p> <p style="margin-bottom:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Estarán exentos del pago de la tasa regulada en esta ordenanza los siguientes supuestos de retirada de vehículos de la vía pública:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Accidentes de tráfico: vehículos retirados como consecuencia directa de un accidente de tráfico, siempre que la retirada sea realizada por los servicios municipales competentes o por indicación expresa de la autoridad policial interviniente en el atestado. La excepción se aplica únicamente a la primera retirada del vehículo derivada del accidente a un lugar donde no estorbe la circulación.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Obras urgentes, acontecimientos deportivos, culturales o sociales no señalizados previamente: vehículos retirados por necesidades derivadas de la ejecución de las restricciones antes mencionadas en la vía pública que, por su naturaleza imperiosa o imprevista, no hayan permitido la señalización previa y adecuada de la prohibición de estacionamiento con la antelación mínima establecida en la normativa vigente. La urgencia tendrá que ser debidamente justificada por el servicio municipal o por la empresa responsable de su ejecución.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Orden o requerimiento judicial o administrativo: vehículos retirados en cumplimiento de una orden o de un requerimiento expreso de una autoridad judicial o administrativa competente, siempre que este requerimiento no sea consecuencia directa de una infracción imputable al titular o al conductor del vehículo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Fuerza mayor o catástrofe natural: vehículos retirados a consecuencia de situaciones de fuerza mayor, calamidad pública o catástrofe natural que afecten gravemente la seguridad o el orden público y requieran la intervención urgente de los servicios municipales para limpiar la vía.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) En los casos de utilización ilegítima del vehículo: vehículos que han sido sustraídos por parte de la persona que lo estacionó en el lugar de donde sea retirado por la grúa, siempre que el propietario haya denunciado la desaparición del vehículo o bien quede bastante probada la ilegitimidad de la utilización.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En todos los casos de aplicación de las excepciones mencionadas, la autoridad municipal o el agente actuante tendrá que dejar constancia expresa y motivada de la causa de la exención al correspondiente expediente o informe de retirada del vehículo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Ajuntament podrá establecer bonificaciones a esta tasa por motivos sociales debidamente justificados por parte del Àrea de Serveis Socials del Ajuntament.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;<strong>6.&nbsp;Obligación del contribuyente</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La obligación de contribuir nace en el momento de la inmovilización del vehículo u objeto, o bien cuando se inicia su retirada de la vía pública; y subsistirá aunque esta retirada no llegue a hacerse porque el conductor u otra persona autorizada se persone en el lugar y se adopten otras medidas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.&nbsp;</strong> <strong>Base del gravamen</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se toma como base del gravamen y objeto de cálculo de las cuotas:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.El precio de la unidad del servicio de grúa.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Si el servicio se realiza en el casco urbano y o fuera de este.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.La hora del servicio.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.Los días de estancia en el depósito municipal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.&nbsp;</strong> <strong>Cuotas tributarias</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuota tributaria será el resultado de aplicar las tarifas siguientes:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Retirada de vehículos o de otros objetos de la vía pública:</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; Devengo e ingreso</strong>​​​​​​​</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Se merita la tasa y nace la obligación de contribuir, en los servicios señalados en el artículo 2, cuando se inicia la prestación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.En el supuesto al que se refiere el artículo 2.2., el meritaje tiene lugar cuando se inicia la prestación efectiva del servicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.La Administración municipal, con el informe técnico de evaluación previo de los servicios prestados, determinada la cuota tributaria definitiva conforme al artículo 8, y se practicará liquidación con carácter definitivo, que será notificada a la persona interesada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.Por los servicios inconclusos establecidos en el artículo 8.a), para evitar la prosecución de la retirada, se tendrá que abonar la tasa correspondiente en el mismo momento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.Cuando los servicios impliquen el depósito de cualquier tipo de objeto o de vehículo, previamente a la retirada de los artículos por parte del interesado, se exigirá la liquidación de las tasas oportunas con el consiguiente ingreso de la cuota resultante, así como de las sanciones que, si procede, sean procedentes y sean legalmente exigibles para la devolución del vehículo, sin perjuicio del derecho del interesado a recorrer tanto la retirada del vehículo como la liquidación de la tasa de acuerdo con la normativa vigente. </span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>​​​​​​​</strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10.</strong> <strong>Infracciones y sanciones tributarias</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo lo relativo a la calificación de las infracciones tributarias y a sus distintas calificaciones, así como a las sanciones que correspondan en cada caso, se aplicarán las normas de la Ordenanza fiscal general y de la Ley general tributaria, y de las disposiciones que la complementen y desarrollen.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>11.</strong> <strong>Definiciones</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se establecen las siguientes definiciones de los servicios de grúa:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.Servicio completo (SC):</strong> servicio que, a requerimiento de la Policia Local, la grúa se desplaza hasta el lugar de la petición de retirada de un vehículo, y este lo traslada hasta el depósito municipal.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.Servicio sin finalizar o incompleto (SI):</strong> servicio que, a requerimiento de la Policia Local, la grúa se desplaza hasta el lugar del requerimiento; y, ya sea en el trayecto o en el lugar del servicio, el servicio es anulado por la Policía Local en el momento previo al enganche del vehículo, y finalmente no hay traslado al depósito.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.Servicio en el casco urbano:</strong> todas las calles, las vías y las carreteras incluidas dentro del perímetro marcado por la ronda sur y la ronda norte (RC-1 y RC-2, ambas incluidas dentro de esta definición).</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.Servicio fuera del casco urbano:</strong> todas las calles, las vías y las carreteras no incluidas dentro de la definición del punto 3 de este artículo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.Horario diurno:</strong> de las 7:00 a las 21:00 horas.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.Horario nocturno: </strong>de las 21:01 a las 6:59 horas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposiciones</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposiciones derogatorias</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición derogatoria única.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Con la aprobación definitiva de la presente ordenanza fiscal se deroga expresamente la anterior, publicada en el BOIB número 188 de 17 de diciembre de 2011, así como todas las disposiciones del mismo rango, o de rango inferior, que sean incompatibles con lo que establece esta norma, que se opongan o que la contradigan.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposiciones finales</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición final única.
