Comprobaciones documentales y técnicas:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Se ha revisado la solicitud y la documentación que debe constar en el expediente y en el archivo del centro y de la entidad de formación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Se ha realizado visitas técnicas al centro para comprobar el cumplimiento de los requisitos relativos a las instalaciones y equipamientos en fecha 05/08/2025 y en fecha 07/08/2025, y se han cumplimentado las actas de visita correspondientes, que constan en el expediente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Una vez hechas la visita y, si ha sido el caso, subsanadas las incidencias o carencias detectadas, se ha comprobado que las instalaciones, los equipamientos y el resto de estructura de medios del centro cumplen los requisitos exigidos.</span></span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley orgánica 3/2022, de 31 de marzo, de ordenación e integración de la formación profesional, integró la formación conducente a certificados de profesionalidad en el Catálogo nacional de ofertas de formación profesional, como ofertas de grado C (con la nueva denominación de «certificados profesionales»), y establece que la impartición de ofertas de formación profesional está sujeta a previa autorización e inscripción registral por parte de la administración competente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Servicio de Empleo de las Islas Baleares (SOIB) tenía atribuida la formación profesional en los grados A, B, C impartida en los centros que no pertenecen al sistema educativo, de acuerdo con el Decreto 1/2024, de 4 de enero, de la presidenta de las Islas Baleares, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la CAIB. Una vez derogado el Decreto 12/2023 por medio del Decreto 10/2025, de 14 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, la competencia de la autorización de centros para ofertas de grado C corresponde a la Consejería de Educación y Universidades.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Real Decreto 659/2023, de 18 de julio, por el que se desarrolla la ordenación del Sistema de Formación Profesional, deroga el Real Decreto 34/2008 de 18 de enero, por el que se regulan los certificados de profesionalidad, pero sin perjuicio del mantenimiento en vigor de los requisitos recogidos en el Real Decreto 62/2022, de 25 de enero. Por lo tanto, el Real Decreto 34/2008 y la normativa de desarrollo son todavía aplicables con respecto a los requisitos generales que deben cumplir los centros. Es aplicable, por tanto, la Orden TMS/369/2019, de 28 de marzo, por la que se regulan el Registro Estatal de Entidades de Formación del sistema de formación profesional para el empleo, así como los procesos comunes de acreditación e inscripción de las entidades de formación para impartir especialidades formativas incluidas en el Catálogo de especialidades formativas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Las especificaciones de los certificados profesionales para el que se solicita la autorización se contienen en el real decretos por el que se establece, citado en la tabla incluida en el punto 1 del apartado de Hechos. De acuerdo con la disposición transitoria primera del citado Real Decreto 659/2023, hasta que no se proceda reglamentariamente a su modificación, permanecerá vigente la ordenación de los certificados de profesionalidad recogida en cada uno de los reales decretos por los que se establecen.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las disposiciones generales sobre los procedimientos administrativos se contienen en la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común; y las especificaciones procedimentales de la Administración de la CAIB se contienen en la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la CAIB.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, y de acuerdo con la propuesta formulada por el Servicio de Empleo de las Islas Baleares 16 de septiembre de 2025, dicto la siguiente </span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Autorizar, con efectos 1 de septiembre de 2025, para impartir la oferta formativa de Grado C (certificado profesional) que figura en la ficha de oferta formativa anexa, en el centro denominado CASAL JOVE ALAIOR HOGAR CENTRE FP SOIB con la distribución de espacios y número de alumnos que se indican.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Inscribir y actualizar esta autorización en el Registro General de Centros de Formación Profesional del Ministerio de Educación, Formación Profesional y Deportes y en el Registro autonómico de la Consejería de Educación y Universidades.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Dar al centro mencionado que queda obligado a cumplir la legislación vigente y a solicitar la revisión oportuna de su configuración cuando deba modificarse cualquiera de los datos que figuran en esta Resolución. En caso contrario, se revocará la autorización otorgada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.
