&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Se hace público que en fecha 26 de septiembre de 2025, se ha dictado el Decreto núm. 2025-6783 de fecha 26 de septiembre de 2025 del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;DECRETO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;strong&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;DECRETO POR EL QUE SE DETERMINAN LOS SERVICIOS MÍNIMOS A GARANTIZAR CON MOTIVO DE LA HUELGA, CONVOCADA A PARTIR DEL DÍA 28 DE SEPTIEMBRE DE 2025, EN EL SERVICIO DE VIGILANCIA, SALVAMENTO Y SOCORRISMO EN LAS PLAYAS DEL MUNICIPIO DE EIVISSA PARA LAS TEMPORADAS 2025-2026, ADJUDICADO A LA EMPRESA MARSAVE MALLORCA, S.L. PARA LAS TEMPORADAS 2025-2026. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Con fecha 19 de septiembre de 2025 se ha comunicado por la Dirección General de Trabajo y Salud Laboral, que la empresa MARSAVE MALLORCA SL presentó ante la citada Dirección comunicación de huelga legal, al amparo de lo estipulado en el Real Decreto 17/1997, de 4 de marzo, sobre relaciones de trabajo, Titulo I, sobre derecho de huelga, de forma indefinida y a partir del día 28 de septiembre del año en curso en el horario de prestación de servicio de cada centro de trabajo, afectando a los servicios de salvamento y socorrismo en las playas del municipio de Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La Constitución española reconoce en el artículo 28.2 el derecho a la huelga de los trabajadores para la defensa de sus intereses, disponiendo que la ley que regule el ejercicio de este derecho establecerá las garantías precisas para asegurar el mantenimiento de los servicios esenciales de la comunidad, de lo que se deduce que el derecho de huelga no es absoluto e incondicional, estando sujeto a limitaciones en función del bien común y el respeto al derecho de los demás y así la Constitución permite que, por medio de una ley, se establezcan en caso de huelga las garantías precisas para asegurar el mantenimiento de los servicios esenciales de la comunidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;No habiéndose producido el desarrollo legal exigido por el artículo de la Constitución antes citado, resulta de aplicación lo dispuesto en el artículo 10.2 del Real Decreto Ley 17/1977, de 4 de marzo, según el cual “&lt;em&gt;cuando la huelga se declare en empresas encargadas de la prestación de cualquier género de servicios públicos o de reconocida e inaplazable necesidad y concurran circunstancias de especial gravedad, la Autoridad gubernativa podrá acordar las medidas necesarias para asegurar el funcionamiento de los servicios&lt;/em&gt;”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Los servicios prestados por el Ayuntamiento tiene la consideración de servicios públicos, según se desprende de lo dispuesto en los artículos 25 y 26 de la Ley 7/1985, reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El servicio de salvamento y socorrismo en las playas del municipio de Eivissa, es un servicio esencial, explícito competentemente para los municipios e imprescindible, ya que en caso de no realizarse incumpliría con la Ley 22/0988, de 28 de julio, de Costas, así como del Decreto 2/2005, de 14 de enero, regulador de las medidas mínimas de seguridad y protección que han de cumplir las playas y zonas de baño de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Visto el informe de los servicios técnicos municipales de fecha 24 de septiembre de 2025 del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;“&lt;strong&gt;Informe en relación a la convocatoria de huelga indefinida todos los días sábado y domingo a partir del día 28 de septiembre de los trabajadores de la empresa MARSAVE MALLORCA S.L. por el que se determinan los servicios mínimos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Con fecha 29 de mayo de 2025 se formalizó contrato con la entidad MARSAVE MALLORCA S.L. para la ejecución del “Servicio de vigilancia, salvamento y socorrismo en las playas del municipio de Eivissa para las temporadas 2024-2026”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Con fecha 19 de septiembre de 2025 la Dirección General de Trabajo y Salud Laboral comunica a este Ayuntamiento la convocatoria de huelga de los trabajadores de la empresa MARSAVE MALLORCA SL de los centros de trabajo de Sant Antoni de Portmany, Sant Josep de Sa Talaia i Eivissa, en la cual se insta a este Ayuntamiento a fijar los servicios mínimos necesarios para garantizar la prestación del servicio de socorrismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Informe&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Este Ayuntamiento dispone de dos torres y un módulo de socorrismo en cada una de las playas (Figueretes, platja d&amp;apos;en Bossa y Talamanca), todas ellas clasificadas como de riesgo alto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El decreto 2/2005, de 14 de enero, regulador de las medidas mínimas de seguridad y protección que han de cumplir las playas y zonas de baño de la Comunidad Autónoma de las Illes Balears establece en su artículo 20:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;“Horarios de prestación de los servicios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. En las playas en las que existiere Servicio público de salvamento, los horarios que con carácter general tendrá cada temporada, se adecuarán a las particularidades del entorno, condiciones climatológicas y temporada del año natural con afectación turística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Los horarios de servicio mínimo para cada temporada deberán ser los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;a) Para la temporada alta, al menos desde las 10 horas hasta las 18 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;b) Para la temporada media, al menos desde las 11 horas hasta las 17 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;c) Para la temporada baja, se recomienda desde las 12 horas hasta las 16 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Así mismo establece en su Anexo VI los criterios para el dimensionamiento del equipo humano en función del riesgo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;(…)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Playas de riesgo Alto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En las playas catalogadas de riesgo Alto deberán existir, al menos, las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;a) Un supervisor de playa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;b) Un socorrista de actividades acuáticas de presencia en cada torre o puesto de vigilancia existente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;c) Un socorrista de actividades acuáticas para la atención sanitaria por cada dos torres y como mínimo un socorrista de actividades acuáticas si solo hay una torre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;d) Dos socorristas de actividades acuáticas por cada embarcación de auxilio, uno de los cuales, al menos, estar debidamente acreditado para el manejo de la embarcación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Conclusiones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Dada la clasificación de las todas las playas del municipio como playas de riesgo alto y en base a los criterios que establece el Decreto 2/2005, de 14 de enero, regulador de las medidas mínimas de seguridad y protección que han de cumplir las playas y zonas de baño de la Comunidad Autónoma de las Illes Balears se determinan los siguientes servicios mínimos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Para la playa de Talamanca:3 socorristas, uno por torre y uno en puesto de socorro y 1 supervisor de playa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Para la playa de Figueretes: 3 socorristas, uno por torre y uno en puesto de socorro y 1 supervisor de playa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Para la playa d&amp;apos;en Bossa: 3 socorristas, uno por torre y uno en puesto de socorro y 1 supervisor de playa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Además, y dado que la embarcación de rescate es compartida entre las playas, habrá de haber 2 socorristas más, uno de ellos patrón de embarcación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Estos servicios mínimos constituyen un 93,33% de la plantilla adscrita al contrato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Se establece el horario de servicio mientras dure la huelga en el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Hasta el 15 de octubre incluido, de 11:00 horas hasta las 17:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;- Desde el 16 de octubre hasta el 31 de octubre, ambos incluidos, de 12:00 horas hasta las 16:00 horas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Eivissa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La técnica municipal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;(documento firmado electrónicamente en el margen)”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;A la vista de todo lo expuesto anteriormente y en virtud de las competencias que tengo atribuidas según el artículo 21.1 letra k) de la Ley 7/1985 de 2 de abril, de Bases de Régimen Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; Establecer los servicios mínimos establecidos en el informe de los servicios municipales con la finalidad de garantizar el funcionamiento de los servicios de salvamento y socorrismo durante la huelga fijada de forma indefinida con inicio el día 28 de septiembre de 2025, convocada por la empresa MARSAVE MALLORCA S.L.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt; MARSAVE MALLORCA S.L. deberá comunicar a este Ayuntamiento, antes del inicio de la huelga, la relación nominal de las personas que hayan de prestar los servicios mínimos establecidos en el informe técnico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; El incumplimiento de la obligación de atender los servicios mínimos será sancionado de conformidad en la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Cuarto.-&lt;/strong&gt; Notificar este acuerdo a MARSAVE MALLORCA S.L., y a la Dirección General de Trabajo y Salud Laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Quinto.- &lt;/strong&gt;Ordenar la publicación de la presente resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Sexto.- &lt;/strong&gt;Contra el presente Decreto que pone fin a la vía administrativa se podrá interponer, potestativamente, recurso de reposición ante el órgano que ha dictado la resolución de conformidad con el que dispone en los artículos 123 y 124 de la Ley 39/2015 1 de octubre de Procedimiento Administrativo Común de las Administraciones Públicas en el plazo de un mes a contar desde el día siguiente a la notificación, o directamente un recurso Contencioso-Administrativo, por el procedimiento especial para la protección de los derechos fundamentales ante la Sala de este Orden Jurisdiccional del Tribunal Superior de Justicia de Islas Baleares,en el plazo de 10 días hábiles que se computará desde el siguiente al de la notificación del presente Decreto de acuerdo con el que prevén los artículos 114 y 115 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa . Todo esto sin perjuicio de poder interponer cualquier otro recurso que estime procedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
