El 24 de junio de 2025, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución 1 de la ayuda temporal excepcional a las explotaciones del sector de ovino afectadas por la lengua azul, 2025, que se publicó en el Boletín Oficial de las Islas Baleares núm. 82, de 26 de junio de 2025, donde también constaban los denegados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En los anexos de la mencionada resolución se ha observado un error referente a 1 expediente que aparecen en el anexo II “Denegados y motivo de denegación” donde se indica que la explotación ES070300000057 queda denegada por no tener foco. Una vez revisada la información, se comprueba que sí que tiene foco y se concluye que tiene derecho a ayuda y por tanto es necesario modificar los anexos I, II. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otra parte, la resolución de rectificación de errores de fecha 10 de julio de 2025 del vicepresidente en materia agraria del FOGAIBA incluía a otros cuatro beneficiarios, así como recalculaba el importe total de la ayuda. </span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece que las administraciones públicas pueden rectificar en cualquier momento, de oficio o/a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Por otra parte, el artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, también establece que la rectificación de los errores materiales, aritméticos y de hecho en actas y disposiciones administrativas corresponde al órgano que haya dictado el acto o disposición</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propuesta de Resolución</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, se informa favorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los términos siguientes:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.
