    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;En la sesión celebrada el 9 de septiembre de 2025 la Junta de Gobierno Local adoptó un acuerdo cuya parte dispositiva establece lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;Primero&lt;/strong&gt;. Aprobar definitivamente el proyecto técnico de construcción e instalación de una actividad de centro de reciclaje en Portocolom, en una parte de la parcela 1278 del polígono 31 del municipio de Felanitx (referencia catastral 07022A03101278), proyecto integrado por la documentación siguiente que ha redactado el ingeniero industrial Juan Mateo Horrach Torrens:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;El documento ambiental firmado el 26 de julio de 2024&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El proyecto con el visado 151046/0003 de 6 de septiembre de 2024&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La adenda al proyecto con el visado 151046/0004 de 4 de septiembre de 2025&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Sujetar la aprobación municipal del proyecto a las condiciones de los informes que constan en el expediente y, en particular, a las condiciones incluidas en los informes y autorización sectoriales siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El informe relativo a la zona de restricciones moderadas del perímetro de protección de pozos de abastecimiento del 23 de enero de 2025 (Dirección General de recursos hídricos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El informe de impacto ambiental del 2 de junio de 2025 publicado al BOIB n.º 114 de 28 de agosto (Dirección General de armonización urbanística y evaluación ambiental).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La autorización de las instalaciones de almacenamiento y gestión de los residuos del 28 de julio de 2025 (Dirección General de economía circular, transición energética y cambio climático).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Estos informes y autorización sectoriales se adjuntan al acuerdo de aprobación municipal como parte integrante del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;Indicar que el presupuesto de ejecución material (PEM) de la construcción e instalación de la actividad de centro de reciclaje es de 174.895,32 euros. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;El presupuesto de ejecución por contrata (PEC) asciende a la cantidad de 253.289,89 euros, de conformidad con los cálculos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;P.E.M.= 174.895,32 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;B.I. (6%)= 10.493,72 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;G.G. (13%)= 22.736,39 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Total sin I.V.A.= 208.125,43 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;I.V.A. (21%)= 43.706,34 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;TOTAL= 251.831,77 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;El Canon de Gestión residuos asciende a la cantidad de 1.325,57 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;I.V.A. (10%)= 132,57 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;TOTAL Gestión residuos= 1.458,13 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;El plazo de ejecución de las obras es de cuatro meses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; Publicar este acuerdo en el Boletín Oficial de las Illes Balears (BOIB) y en la sede electrónica del Ajuntament (ajfelanitx.eadministracio.cat), a la cual también se puede acceder a través de la página web (www.felanitx.org), con la indicación de los recursos correspondientes.&lt;/span&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin-bottom: 0cm;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno del Ajuntament de Felanitx en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado de lo Contencioso-Administrativo de Palma en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa. Todo ello sin perjuicio de que pueda presentarse cualquier otro recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
