&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Mediante Resolución de la consejera de Presidencia, Función Pública e Igualdad, de 19 de diciembre de 2022, se aprobaron la convocatoria, las bases, los ejercicios y temario, y el baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre y por el turno de promoción interna vertical y por el turno de promoción interna cruzada, incluida la reserva para personas con discapacidad, para cubrir plazas de personal funcionario en la Administración de la Comunidad Autónoma de las Illes Balears (BOIB número 165, de 20 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. En fecha 31 de julio de 2025 se publicó en el BOIB nº. 101 la Resolución de la consejera de Trabajo, Función Pública y Diálogo Social por la que se aprueba la lista de aspirantes que han superado las pruebas selectivas para el ingreso, por el turno libre, en el cuerpo de gestión para la isla de Mallorca de la Administración de la Comunidad Autónoma de las Illes Balears y se ofrecen los puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Una vez que las personas aspirantes que han superado el proceso selectivo han presentado la solicitud y se ha comprobado el cumplimiento de los requisitos, deben ser nombradas personal funcionario de carrera del cuerpo de gestión de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. El Decreto 27/1994, de 11 de marzo, por el que se aprueba el Reglamento de ingreso del personal al servicio de la comunidad autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. El artículo 5.2 del anexo del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escola Balear de Administración Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. El Decreto 10/2025, de 14 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. La base 17 de la Resolución de la consejera de Presidencia, Función Pública e Igualdad, de 19 de diciembre de 2022, por la que se aprueban la convocatoria, las bases, los ejercicios y temario, y el baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre y por el turno de promoción interna vertical y por el turno de promoción interna cruzada, incluida la reserva para personas con discapacidad, para cubrir plazas de personal funcionario en la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Adjudicar los puestos de trabajo, de acuerdo con lo que se indica en el anexo de esta Resolución, a las personas aspirantes que han superado las pruebas selectivas para el ingreso, por el turno libre, en el cuerpo de gestión de la Administración de la Comunidad Autónoma de las Illes Balears, después de haber presentado la documentación pertinente, de acuerdo con la petición de destino efectuada y la puntuación obtenida en el proceso selectivo.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. La toma de posesión debe efectuarse en la consejería correspondiente, en el plazo de tres días hábiles a contar a partir del día siguiente de la publicación de esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Antes de tomar posesión del puesto adjudicado, la persona interesada deberá hacer constar que no ocupa ningún puesto de trabajo ni que realiza ninguna actividad en el sector público de las que se comprenden en el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Si realiza alguna actividad privada, incluidas las de carácter profesional, deberá declararlo en el plazo de diez días hábiles a contar desde el día siguiente de la toma de posesión, a fin de que el órgano competente acuerde la declaración de compatibilidad o de incompatibilidad.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Una vez publicado el nombramiento, para adquirir la condición de funcionario de carrera debe efectuarse el juramento o la promesa de acatar la Constitución, el Estatuto de Autonomía de la Comunidad Autónoma de las Illes Balears y el ordenamiento vigente y tomar posesión en el plazo reglamentario.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. Declarar desistidas de su solicitud por caducidad y excluidas del procedimiento, a las personas que no han presentado el escrito de elección de los puestos de trabajo ofrecidos, por orden de preferencia, y la documentación acreditativa del cumplimiento de los requisitos, de acuerdo con la base 16 de la convocatoria.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, en la Sede Electrónica de la Administración de la CAIB y en el Portal del Opositor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra esta Resolución, que pone fin a la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Trabajo, Función Pública y Diálogo Social en el plazo de un mes, a contar a partir del siguiente a su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses a contar a partir del siguiente a la publicación de la resolución, de acuerdo con los artículos 8.2 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
