    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizaran a las personas interesadas mediante su publicación en el Butlletí Oficial de les Illes Balears de acuerdo con los términos que prevé la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha &lt;span style="background-color:#ffffff"&gt;30&lt;/span&gt; de julio de 2025, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1.Con fecha 07 de diciembre de 2017 se aprobó mediante Resolución de la Autoridad de Gestión del Programa de Desarrollo Rural de las Illes Balears, la Estrategia de Desarrollo Local Participativo (EDLP), que contiene las actuaciones que se llevarán a cabo durante el período 2014-2020 en aplicación de la medida 19.2 del PDR.&lt;/p&gt;

&lt;p&gt;Esta Estrategia incluye una serie de Proyectos Programados que serán promovidos por el propio Grupo de Acción Local o por otros actores del territorio para conseguir los objetivos que plantea la EDLP aprobada. Aunque según dispone la normativa de aplicación, la selección de los proyectos a financiar en el marco de la EDLP debe realizarse mediante el procedimiento de concurrencia competitiva entre las solicitudes presentadas en los períodos de solicitud que establezca el Grupo, se exceptúan de estas norma los proyectos programados aprobados en la propia EDLP de carácter no productivo, el promotor de los cuales sea una entidad pública con competencias en la materia y el propio Grup d' Accio Local.&lt;/p&gt;

&lt;p&gt;2.Con fecha 3 de febrero de 2021 con NRGE1764, el Sr. JAUME FERRER RIBAS con NIF ***5006**, en nombre y representación del CONSELL DE FORMENTERA con NIF P0702400C, presentó una solicitud de ayuda para el proyecto «Estación de almacenamiento y conservación de grano en Formentera». Este proyecto está incluido en la Estrategia aprobada de Desarrollo Local como proyecto programado y está promovido por el Consell de Formentera, por lo que no era necesario aplicar concurrencia competitiva y se seleccionó individualmente mediante la Resolución del vicepresidente del FOGAIBA de fecha 1 de junio de 2021 que fue notificada el 2 de junio de 2021.&lt;/p&gt;

&lt;p&gt;3.Con fecha 15 de febrero de 2021 con NRGE 2283, la Sra.. ALEJANDRA FERRER KIRSCHBAUM con NIF ***5625**, en nombre y representación del CONSELL DE FORMENTERA con NIF P0702400C, presentó una solicitud de ayuda para el proyecto “Adquisición de aperos por un manejo sostenible del suelo”. Este proyecto está incluido en la Estrategia aprobada de Desarrollo Local como proyecto programado y está promovido por el Consell de Formentera, por lo que no era necesario aplicar concurrencia competitiva y se seleccionó individualmente mediante la Resolución del vicepresidente del FOGAIBA de fecha 1 de junio de 2021 que fue notificada el 1 de junio de 2021.&lt;/p&gt;

&lt;p&gt;4.Dada la citada Resolución de concesión de la ayuda, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.&lt;/p&gt;

&lt;p&gt;5.Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, los interesados han presentado las solicitudes de pago adecuadas así como la documentación exigida, pero, revisada ésta, se comprueba que no se ha realizado todo el gasto aprobado.&lt;/p&gt;

&lt;p&gt;6.Los solicitantes declaran que a pesar de la diferencia, se han alcanzado todos los objetivos previstos en el proyecto aprobado.&lt;/p&gt;

&lt;p&gt;7. Visto lo anterior y de acuerdo con el artículo 43 del Decreto legislativo 2/2005, de 28 de diciembre.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;I. Convenio de colaboración entre el Fondo de Garantía Agraria y Pesquera de las Illes Balears como Organismo Pagador, el adjunto a la Gerencia del FOGAIBA como Autoridad de Gestión y el Grupo de Acción Local para el desarrollo rural y pesquero de Eivissa i Formentera para la aplicación de la medida 19 del Programa de Desarrollo Rural de las Illes Balears 2014-2020.&lt;/p&gt;

&lt;p&gt;II. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm.1698/2025 del Consejo.&lt;/p&gt;

&lt;p&gt;III. Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agrícola Común, por la cual se deroguen los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 i (CE) núm. 485/2008 del Consejo.&lt;/p&gt;

&lt;p&gt;IV. Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural.&lt;/p&gt;

&lt;p&gt;V. Real Decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, de la viña.&lt;/p&gt;

&lt;p&gt;VI. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/p&gt;

&lt;p&gt;VII. Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/p&gt;

&lt;p&gt;VIII.- Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones.&lt;/p&gt;

&lt;p&gt;IX. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p&gt;X. Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/p&gt;

&lt;p&gt;XI. Decreto 64/2005, de 10 de junio, de creación del FOGAIBA.&lt;/p&gt;

&lt;p&gt;XII. Orden de la consellera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone que el FOGAIBA asume la ejecución de la política de la consellería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/p&gt;

&lt;p&gt;XIII. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Illes Balears BOIB núm. 082 de 2007; en virtud de la Orden de la consellera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consellería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Propuesta de Resolución de Revocación parcial&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Por todo esto, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos :&lt;/p&gt;

&lt;p&gt;1. Proceder a la revocación parcial de la Resolución de ayuda concedida al beneficiario y por el importe detallados en el Anexo I, que son un total de 2 expedientes que comienza con el Consell de Formentera y termina con el Consell de Formentera, que suma un importe total de 2.516,80 euros, relativa a la línea de ayuda “Implementación operaciones incluidas en las EDLP”, ya que la justificación del gasto ha sido inferior a la aprobada. El importe total de la ayuda finalmente concedida deberá ser de 131.357,60 euros.&lt;/p&gt;

&lt;p&gt;2. Notificar la resolución a cada un de los beneficiarios del Anexo I.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/p&gt;
