    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La industria es reconocida como un sector clave para el desarrollo económico de las regiones. La expansión de la actividad industrial ha sido trascendental para impulsar la innovación tecnológica, la capacidad exportadora, la sofisticación de los procesos productivos y, en definitiva, para aumentar el crecimiento económico. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El desafío de las Illes Balears es la adaptación de la estructura productiva a un marco mundial en permanente movimiento, para generar más bienes y servicios, y más complejos, en una variedad limitada de actividades que favorezcan la diferenciación, garanticen la presencia y la posición del archipiélago en las cadenas globales de valor y permitan incrementar la productividad del sistema regional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con el convencimiento de que hay un espacio de competitividad para la industria balear, se aspira a acelerar la transformación de los entornos productivos considerados prioritarios hacia actividades y modelos de negocio de más valor añadido. Es por eso que se desarrollan y se implementan nuevas herramientas para contribuir a la generación de un ecosistema dinámico que fomente el crecimiento de las empresas y la ocupación industrial en condiciones de competitividad internacional y productividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Ley 4/2017, de 12 de julio, de Industria, establece en su artículo 9 que la Administración tiene que llevar a cabo una política adecuada de promoción y modernización industrial, a fin de contribuir al desarrollo de un modelo económico de crecimiento sostenible que permita avanzar en competitividad, productividad, solidaridad y equilibrio territorial, y favorecer así la innovación, el crecimiento empresarial y la creación de ocupación de calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Plan Director de Industria de las Illes Balears 2018-2025, aprobado por el Consejo de Gobierno en la sesión de 26 de enero de 2018, señaló que cada vez era más difícil para las empresas y los territorios mantener las ventajas competitivas, y se marcó como reto impulsar la mejora de la productividad de las empresas de manera permanente, como única vía para mantener ventajas competitivas y valor para la empresa misma y para la sociedad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este contexto se sitúa el Programa de Mejora de la Competitividad y la Productividad Industrial para el año 2025, aprobado por la Resolución del consejero de Empresa, Empleo y Energía de fecha 17 de noviembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estos programas de promoción y modernización persiguen fundamentalmente los siguientes objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;La implantación de sistemas de calidad total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;El desarrollo de servicios especializados para el apoyo en el ámbito de la capacidad comercial, del marketing, de la gestión de recursos humanos y de la planificación de la producción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; El apoyo al desarrollo de instrumentos de financiación para las entidades que tengan por objeto la promoción industrial y el desarrollo tecnológico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La promoción, en sectores o en áreas de actividad emergentes, o insuficientemente dimensionados, de una capacidad competitiva idónea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;El impulso de infraestructuras físicas y de ámbitos tecnológicos que posibiliten un desarrollo competitivo idóneo de proyectos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La especialización en actividades de más demanda, con valor añadido e intensidad tecnológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La formación en capital humano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; La aplicación de cualquier proceso de sofisticación empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En particular, y en el marco de sus competencias, la Consejería de Empresa, Autónomos y Energía, con el paquete de ayudas que aprueba, pretende apoyar a las entidades que, directamente con las empresas de los sectores productivos, puedan avanzar en competitividad y productividad; favorecer la innovación y el crecimiento empresarial, con el objetivo de dotar a este territorio de capital productivo, elevar el nivel de renta y desarrollar las infraestructuras industriales, y, a la vez, hacer atractiva y promover la inversión empresarial generadora de empleo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Comunidad Autónoma de las Illes Balears asumió, de acuerdo con el artículo 30.34 del Estatuto de Autonomía, según la redacción hecha por la Ley Orgánica 1/2007, de 28 de febrero, las competencias exclusivas en materia de industria, y, de acuerdo con los artículos 30.21 y 42, las del fomento del desarrollo económico y la promoción de la competencia, aspectos en los que está de nuevo implicada la actividad industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Orden 9/2024 del consejero de Empresa, Ocupación y Energía por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de industria (BOIB n.º 40, de 23 de marzo) establece las bases reguladoras para las subvenciones en materia de fomento de la actividad industrial que convoque el órgano competente en materia de industria. El artículo 4.1 de esta Orden prevé que puede ser objeto de subvención cualesquiera agrupaciones de personas físicas o jurídicas relacionadas con la actividad industrial. Por su parte, el artículo 5 de la misma Orden dispone que la persona titular de la consejería competente en materia de industria tiene que aprobar, por medio de una resolución, las convocatorias correspondientes, que deben ser publicadas en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, el artículo 15 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, establece el contenido mínimo de la convocatoria de ayudas, que tiene que ser aprobada por el órgano competente y publicada en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas subvenciones se han incluido en el Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2024-2026, aprobado por el Acuerdo del Consejo de Gobierno de día 19 de abril de 2024 (BOIB n.º 52, de 20 de abril), en concreto en el objetivo I.2.15. «Ayudas destinadas a fomentar e impulsar la competitividad de los sectores productivos empresariales dirigidos a los centros de desarrollo industrial balear».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar la convocatoria para conceder ayudas destinadas a fomentar e impulsar la competitividad de los sectores productivos empresariales, dirigidos a centros de desarrollo industrial balear para el año 2025 incluida dentro del anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y disponer que tendrá efectos el día siguiente de la publicación; y comunicarla a la Base de datos nacional de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Autónomos y Energía en el plazo de un mes a contar desde el día siguiente de la publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el artículo 123 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta resolución es regular la concesión de subvenciones destinadas a fomentar e impulsar la mejora de la cooperación empresarial y de la competitividad de los sectores productivos empresariales de las Illes Balears a través de la incentivación y de la consolidación de los centros de desarrollo industrial balear y de los proyectos colaborativos que desarrollan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Beneficiarios y requisitos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Son beneficiarios de estas ayudas las personas jurídicas sin ánimo de lucro consideradas como «centros de desarrollo industrial balear» que estén establecidos físicamente en las Illes Balears, que tengan su domicilio fiscal en ellas, que desarrollen sus acciones en el ámbito territorial de la comunidad autónoma de las Illes Balears y cuyas actividades coincidan con el objeto de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los centros de desarrollo industrial balear, a efectos de esta convocatoria, son organismos de investigación sin ánimo de lucro que disponen de los recursos materiales y humanos propios necesarios para llevar a cabo actividades destinadas tanto a la generación de conocimiento tecnológico como a facilitar la explotación de este conocimiento, ya sea por centros existentes o bien mediante la generación de nuevas iniciativas empresariales, que contribuyan a la mejora competitiva de las empresas y al desarrollo económico de su entorno y que tengan entre sus representados o asociados como mínimo un 20% de empresas con IAE comprendido entre los epígrafes 2, 3, 4 y 5, ambos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los solicitantes de estas ayudas tienen que cumplir con los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Deben estar al corriente de las obligaciones con la Seguridad Social y de las obligaciones tributarias con el Estado y con la Comunidad Autónoma de las Illes Balears. La solicitud de las ayudas comportará la autorización para que la Consejería de Empresa, Autónomos y Energía pueda comprobar de oficio que la entidad solicitante está al corriente de estas obligaciones, excepto en caso de denegación expresa. En este caso, el solicitante tiene que aportar los certificados correspondientes, junto con la solicitud de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;El centro de trabajo tiene que estar ubicado en el territorio de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Entre sus representados o asociados tiene que haber, como mínimo, un 20 % de empresas con IAE comprendido entre los epígrafes 2 a 5, ambos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Tienen que presentar la solicitud en los términos y con los requisitos que establecen los puntos séptimo y octavo de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quedan excluidos como beneficiarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Los solicitantes en los que se dé alguna de las circunstancias previstas en el artículo 13.2 la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y el artículo 10 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre. Tampoco pueden tener la condición de beneficiarios los solicitantes que hayan sido sancionados de acuerdo con el artículo 11 de la Ley 11/2016, de 28 de julio, de Igualdad de Mujeres y Hombres, o con el artículo 37 de la Ley 8/2016, de 30 de mayo, para garantizar los derechos de lesbianas, gays, trans, bisexuales e intersexuales, y para erradicar la LGTBI-fobia, o con el artículo 37 de la Ley 15/2022, de 12 de julio, integral para la igualdad de trato y la no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Las sociedades públicas y entidades de derecho público, así como cualquier empresa u organización en la que su participación sea mayoritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Las entidades que no tengan el domicilio fiscal y el centro de trabajo en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Las agrupaciones empresariales innovadoras, de acuerdo con el Decreto 83/2023, de 20 de octubre, por el que se modifica el Decreto 6/2019, de 1 de febrero, por el que se crea y regula el Registro de agrupaciones empresariales innovadoras de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Las uniones temporales de empresas (UTE).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Actuaciones subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son subvencionables los conceptos y las actividades que han de estar ejecutados y pagados entre el 1 de noviembre de 2024 y el 31 de octubre de 2025 i estén incluidos en las siguientes líneas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Gastos de funcionamiento de las estructuras de coordinación y gestión de la entidad, mediante la financiación de parte de los costes del personal y de los gastos de administración y funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Gastos corrientes directamente vinculados al funcionamiento ordinario de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Colaboraciones externas, como por ejemplo gastos externos de consultoría y otros servicios que se especifiquen de manera detallada en la solicitud de ayuda y sean necesarios para la buena gestión y el funcionamiento de la entidad, así como gastos para llevar a cabo acciones de promoción de la misma entidad: material promocional (catálogo o folleto promocional) y acciones de difusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se consideran gastos subvencionables los destinadas al diseño de páginas y entornos web.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuantía de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las ayudas que se regulan revisten la modalidad de entrega dineraria sin contraprestación y tienen que instrumentarse en forma de subvenciones, como se indica a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Gastos de funcionamiento de las estructuras de coordinación y gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta línea es otorgar ayudas para las cargas económicas salariales y de la Seguridad Social derivadas de la gerencia y la estructura de personal de las entidades beneficiarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son subvencionables los gastos salariales y de la Seguridad Social de la gerencia y del personal laboral contratado por la entidad beneficiaria, en la siguiente proporción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Subvención del 80% de los gastos salariales y de la Seguridad Social de la gerencia y del personal laboral contratado por la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Gastos corrientes directamente vinculados al funcionamiento ordinario de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son subvencionables los gastos de funcionamiento ordinario, como por ejemplo el alquiler de las sedes de las organizaciones y los gastos de suministros y comunicaciones. No son subvencionables los gastos financieros ni de inversión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Subvención del 50 % de los gastos justificados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Colaboraciones externas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son subvencionables los gastos externos de consultoría y otros servicios que se especifiquen de manera detallada en la solicitud de ayuda y sean necesarios para la buena gestión y el funcionamiento de la entidad, así como gastos para la realización de acciones de promoción de la misma entidad: material promocional (catálogo o folleto promocional) y acciones de difusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Subvención del 50 % de los gastos justificados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe máximo subvencionable por los tres conceptos descritos en los apartados &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; es de 40.000 euros por beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El solicitante tiene que declarar todas las ayudas que haya solicitado u obtenido por el mismo concepto, tanto al iniciar el expediente como en cualquier momento del procedimiento en qué esto se produzca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Cualquier alteración de las condiciones tenidas en cuenta para la concesión y, en todo caso, la obtención concurrente de subvenciones otorgadas por cualquier entidad pública o privada, nacional o internacional, puede dar lugar a la modificación de la subvención otorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Normativa reguladora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria se rige por las bases reguladoras aprobadas mediante la Orden 9/2024 del consejero de Empresa, Ocupación y Energía por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de industria (BOIB nº 40, de 23 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También por el Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre; la Ley 38/2003, así como el resto de normativa comunitaria, estatal o autonómica aplicable a las subvenciones otorgadas por la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Importe económico y partida presupuestaria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El crédito asignado a esta convocatoria es de ciento veinte mil euros (120.000,00 €), con cargo a la partida presupuestaria 19401 723A01 48000 00 de los presupuestos generales de la Comunidad Autónoma de las Illes Balears para el ejercicio del año 2024, prorrogados de acuerdo con el artículo 47 de la Ley 14/2014, de 29 de diciembre, de Finanzas de la CAIB y la Orden 1/2025 del consejero de Economía, Hacienda e Innovación de 9 de enero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Siempre que la disponibilidad presupuestaria lo permita, puede incrementarse el importe de esta convocatoria. El importe consignado inicialmente puede ampliarse mediante una resolución de ampliación del crédito asignado. Esta ampliación, salvo que se establezca otra cosa, no implica que el plazo para presentar solicitudes se amplíe y no afecta a la tramitación ordinaria de las solicitudes presentadas y no resueltas de forma expresa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Documentación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los solicitantes tienen que presentar, junto con el trámite de solicitud, la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Documento constitutivo de la entidad inscrita adecuadamente en el registro correspondiente, con las modificaciones necesarias, si procede, para la acreditación de la personalidad jurídica del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Poder suficiente a favor del firmante, en caso de que este no figure acreditado en la escritura, o certificado actualizado del registro correspondiente, en el que se especifiquen, en los supuestos en que sea procedente, la fecha de constitución, el objeto, el capital y la sede social, composición del consejo de administración o junta directiva, los apoderados y los socios que dispongan de más de un 10% de las participaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Declaración responsable que, como mínimo, un 20% de los asociados o representados de la entidad son empresas con IAE comprendido entre los epígrafes 2 a 5, ambos incluidos, que se encuentra incluida en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Declaración responsable, que se encuentra incluida en la solicitud, de que no se encuentran en ninguna de las circunstancias enumeradas en el artículo 13 de la Ley 38/2003 y en el artículo 10 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre. Y tampoco de haber sido sancionado de acuerdo con lo establecido en el artículo 11 de la Ley 11/2016, o el artículo 37 de la Ley 8/2016, o el artículo 37 de la Ley 15/2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Declaración en la que se hagan constar las subvenciones o las ayudas obtenidas o solicitadas para la misma finalidad, procedentes de cualquier administración o ente público o privado nacional, de la Unión Europea o de organismos internacionales o, si procede, una declaración expresa de no haber solicitado ninguna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Por lo que respecta a la cuantía, y de acuerdo con el artículo 40.3 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, para los proyectos de cuantía superior o igual a 40.000 euros en caso de ejecución de obras, o de 15.000 euros en caso de suministro de bienes de equipamiento o prestación de servicios por una empresa de consultoría o asistencia técnica, el beneficiario tiene que presentar, como mínimo, tres ofertas anteriores a la ejecución del proyecto de proveedores diferentes, salvo que por sus características especiales no haya entidades suficientes para poder realizarlas, o salvo que el gasto se haya efectuado antes de la solicitud de la subvención. La elección de las ofertas presentadas tiene que hacerse de conformidad con los criterios de eficacia y de economía, y se tiene que justificar expresamente en caso de que la elección no recaiga en la propuesta económica más ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Memoria explicativa y económica, en la que se especifiquen las actividades que desarrolla la entidad, la localización, el alcance, las características y la repercusión de la entidad sobre el sector, así como detallar y definir claramente en qué consisten los gastos de funcionamiento, estructura y suministros, y consultoría, con el IVA desglosado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Declaración de datos bancarios que se encuentra incluida en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Plazo y presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El plazo para presentar las solicitudes es de treinta días naturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este plazo empieza el décimo día natural a contar desde el día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la cuantía consignada en esta convocatoria se agota antes de la expiración del plazo para presentar las solicitudes, tiene que suspenderse la concesión de las ayudas mediante la publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la resolución correspondiente del consejero de Empresa, Autónomos y Energía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si finalizado el plazo de presentación de las solicitudes, y una vez resueltas todas las solicitudes, no se ha agotado el crédito dispuesto en la convocatoria, puede ampliarse el plazo inicialmente previsto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Todos los solicitantes de estas ayudas están obligados a presentar la solicitud mediante el trámite telemático específico disponible en la Sede Electrónica de la Administración de la Comunidad Autónoma de las Illes Balears, junto con la documentación prevista en el punto séptimo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. No se tendrán por presentadas en el registro las solicitudes y otra documentación que se presenten por cualquier otra vía telemática diferente de este trámite telemático. En caso de hacerlo se requerirá al solicitante para que lo subsane a través de la presentación electrónica. A tal efecto, se considera como fecha de presentación de la solicitud aquella en la que se haya llevado a cabo la subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Cuando el solicitante sea una persona jurídica tiene que presentar la solicitud de la ayuda por medio de su representante legal, acreditado adecuadamente, como puede ser la firma de la solicitud con el certificado digital de representación de la empresa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La solicitud de ayuda implica la autorización para que la Administración de la Comunidad Autónoma de las Illes Balears pueda verificar los datos y afirmaciones declaradas por la persona o la entidad solicitante, excepto en caso de denegación expresa. En este caso, la persona o la entidad solicitante tiene que aportar los certificados y la documentación correspondientes, junto con la solicitud de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La Consejería de Empresa, Autónomos y Energía puede solicitar toda la documentación complementaria que considere necesaria para evaluar correctamente los expedientes o para comprobar los datos presentados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. En caso de que alguno de los documentos requeridos para tramitar la subvención ya se haya aportado a la Administración de la Comunidad Autónoma de las Illes Balears, no es necesario aportarlo de nuevo, siempre que se haga constar la fecha y el órgano o dependencia en el que se presentó y que no haya sufrido modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Si la solicitud no cumple los requisitos legales y los exigidos en la Orden de bases reguladoras y en esta convocatoria, tiene que requerirse una sola vez a la persona interesada para que subsane las deficiencias dentro de un plazo de diez días, de acuerdo con el artículo 68 de la Ley 39/2015, con la indicación que, si no lo hace así, se considerará que desiste en su petición, con la resolución previa que tiene que dictarse en los términos previstos en el artículo 21 de la mencionada Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Noveno&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Criterios para seleccionar a los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Para la concesión de las ayudas que establece esta convocatoria se aplicará un criterio de resolución por riguroso orden de entrada de las solicitudes en el registro correspondiente, dado que, de acuerdo con su naturaleza, no son necesarias ni la comparación ni la prelación de las solicitudes en un único procedimiento, según el artículo 6.8 de la Orden del consejero de Empresa, Empleo y Energía por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de industria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las solicitudes de ayudas pueden resolverse individualmente aunque no haya acabado el plazo de presentación hasta que se agote el crédito destinado a la convocatoria y, si no es así, hasta que se resuelvan todos los expedientes presentados dentro del plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el supuesto de que dentro del expediente no conste la documentación que se requiere en esta convocatoria, y una vez que haya sido requerida de acuerdo con el apartado 9 del punto octavo, la fecha de presentación de la subsanación establece el orden de prelación para el otorgamiento de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Instrucción y resolución del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En aplicación del artículo 9.2 de las bases reguladoras, corresponde a la Dirección General de Industria y Polígonos Industriales la tramitación de las solicitudes, y a su personal adscrito la ordenación e instrucción. El director general de Industria y Polígonos Industriales tiene que emitir una propuesta de resolución provisional, la cual tiene que comunicarse a todos los interesados para que en el plazo máximo de diez días puedan alegar lo que consideren oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cuando las personas interesadas no efectúen alegaciones en el plazo otorgado al efecto a la propuesta de resolución provisional y no figuren en el procedimiento, ni se tengan en cuenta otras alegaciones y pruebas que las aducidas por los interesados, la propuesta de resolución provisional formulada y notificada se convertirá en definitiva. En caso contrario, el director general de Industria y Polígonos Industriales tendrá que dictar una propuesta de resolución definitiva de acuerdo con las alegaciones formuladas, la cual tendrá que notificarse a todas las personas interesadas para que en el plazo máximo de diez días puedan alegar lo que consideren oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el artículo 9.1 de las bases reguladoras, el órgano competente para resolver es el consejero de Empresa, Autónomos y Energía, que tiene que dictar una resolución motivada en la que tiene que fijarse, con carácter definitivo, la cuantía de la subvención concedida. Así mismo, la resolución tiene que especificar los siguientes aspectos: beneficiario, descripción e importe de la actividad que se subvenciona, cuantía, partida presupuestaria a la que se aplica, forma de pago, plazo para llevar a cabo la actividad, justificación de las actividades objeto de ayuda y plazos para presentar los justificantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Todas las notificaciones tienen que realizarse telemáticamente y con las exigencias y en la forma establecidas en los artículos 40 y siguientes de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El plazo para dictar y notificar la resolución expresa es de seis meses desde la fecha en la que finaliza el plazo para presentar las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Contra las resoluciones que concedan o denieguen la subvención cabe interponer un recurso potestativo de reposición o bien un recurso contencioso-administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En caso de que se agote el crédito de la convocatoria, para todas las solicitudes que no hayan recibido concesión tiene que emitirse una propuesta de resolución colectiva de agotamiento de crédito que tiene que publicarse en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y en la web &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;industria.caib.es&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el artículo 45.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Una vez transcurrido el plazo de alegaciones a la propuesta de resolución colectiva de agotamiento de crédito, tiene que emitirse una resolución colectiva que igualmente tiene que publicarse en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y en la web &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;industria.caib.es&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimoprimero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Justificación y pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La actividad subvencionada tiene que entenderse justificada con la acreditación de la realización efectiva de la misma y el cumplimiento de la finalidad para la que se ha concedido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los gastos objeto de las ayudas tienen que ejecutarse y pagar en el periodo comprendido entre el 1 de noviembre de 2024 y el 31 de octubre de 2025 (ambos incluidos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El plazo para justificar la realización de los conceptos subvencionables y solicitar el pago de la subvención, mediante el trámite telemático específico, finaliza el 5 de noviembre de 2025, o en la fecha que establezca la resolución de concesión, si es posterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. No deben tenerse en consideración como justificantes de los gastos subvencionados las facturas emitidas o los pagos realizados con anterioridad al 1 de noviembre de 2024, ni posteriores al 31 de octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La justificación de la actividad ejecutada y solicitud de pago tiene que presentarse de forma electrónica mediante el trámite telemático, a tal efecto, que está disponible en el procedimiento publicado en la Sede Electrónica de esta Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se tendrán por presentadas en el registro las solicitudes y otra documentación que se presenten por cualquier otra vía telemática diferente de este trámite telemático. En caso de hacerlo, se requerirá para que lo subsane a través de su presentación electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los beneficiarios de las ayudas para justificar la aplicación de los fondos tienen que presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Memoria técnica justificativa del cumplimiento de las condiciones impuestas a la concesión de la subvención, en que se describan de manera detallada las actividades que desarrolla la entidad, los medios para conseguirlo y los resultados que se han obtenido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Memoria económica justificativa de los costes de funcionamiento y suministro, que debe contener:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1º Una relación clasificada de los gastos de la actividad, con la identificación del acreedor y del documento, el importe, la fecha de emisión y la fecha de pago. En el supuesto de que la subvención se otorgue de acuerdo con un presupuesto, tienen que indicarse las desviaciones producidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2º Una relación detallada de otros ingresos o subvenciones, con la indicación del importe y la procedencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Las facturas o los documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa que justifiquen los gastos y especifiquen claramente los gastos correspondientes al objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;En caso de los gastos de estructura, tienen que presentarse las nóminas del personal laboral y de la gerencia por el periodo subvencionable. En el supuesto de que se incluyan los gastos del alquiler se tendrá que aportar la copia del correspondiente contrato de alquiler.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Para justificar el pago de las facturas objeto de la subvención se tiene que presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1º Una copia del documento bancario que acredite la transferencia o el pago domiciliado, en el que figuren la fecha del pago, el importe pagado, el concepto del pago de forma que se identifique este con la factura, y también los datos del ordenante y del destinatario, que tienen que coincidir con el beneficiario y con el emisor de la factura correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2º Un extracto bancario del beneficiario de la ayuda en el que figuren los cargos de los pagos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En caso de que el expediente de pago no tenga la documentación necesaria para comprobar que se ha justificado y aplicado la subvención, el órgano competente tiene que solicitar al beneficiario que subsane los defectos de la justificación dentro de los diez días siguientes a contar a partir del día siguiente de la recepción del requerimiento de subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En el supuesto de que no se justifique totalmente la realización de la actividad subvencionada, pero se haya cumplido parcialmente la finalidad para la que se concedió la subvención, esta tiene que revisarse y minorarse proporcionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Cualquier alteración de las condiciones que se han tenido en cuenta para conceder la subvención y, en todo caso, la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones o entes, públicos o privados, nacionales o internacionales, puede dar lugar a la modificación de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La falta de justificación en los términos y en los plazos que establezca la resolución de otorgamiento de la subvención, la modificación significativa del proyecto presentado sin que esta Consejería la haya aprobado previamente, y también la desviación de las subvenciones o la aplicación diferente a la que establece la norma determinan la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimosegundo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Concurrencia de ayudas o subvenciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El importe de las ayudas o subvenciones que establece esta convocatoria no puede ser, en ningún caso, de una cuantía que, aisladamente o en concurrencia con subvenciones o ayudas de otras administraciones públicas u otros entes públicos o privados, nacionales o internacionales, supere el 100% del coste de la actividad que tenga que desarrollar la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A los beneficiarios de esta convocatoria se les tiene que aplicar la norma de las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; regulada por el Reglamento (CE) 2023/2831 de la Comisión, de 13 de diciembre (DOUE, serie L, de 15 de diciembre), en que se establece una cuantía total de ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; no superior a 300.000 euros por beneficiario durante un periodo de tres años anteriores a la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimotercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son obligaciones de los beneficiarios de las ayudas las establecidas en el artículo 11 del Texto refundido de la Ley de Subvenciones. Los beneficiarios tienen que cumplir, además de las obligaciones que se establecen en el artículo mencionado, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Acreditar ante el órgano concedente de la subvención el cumplimiento efectivo de los requisitos y las condiciones exigidas para conceder las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Llevar a cabo una actividad de apoyo al tejido productivo que fomente la concesión de la subvención en la forma y dentro del plazo establecido en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Destinar el importe de la subvención a la financiación de la actuación para la que se ha solicitado, y mantener la actividad subvencionada, en la forma y dentro del plazo que se indica en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Comunicar al órgano concedente de la subvención la modificación de cualquier circunstancia que afecte a alguno de los requisitos exigidos para conceder la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Someterse a las actuaciones de comprobación que realice el órgano gestor de las ayudas y a las actuaciones de control financiero de la Intervención General de la Comunidad Autónoma de las Illes Balears y la Sindicatura de Cuentas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Comunicar la obtención de otras subvenciones o ayudas para la misma finalidad procedentes de cualquier administración o entidad pública o privada, nacional o internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 del Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimocuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interpretación y ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El consejero de Empresa, Autónomos y Energía puede dictar las resoluciones, las circulares y las instrucciones que sean necesarias para interpretar y ejecutar esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
