    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizaran a las personas interesadas mediante su publicación en el Butlletí Oficial de les Illes Balears de acuerdo con los términos que prevé la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha &lt;span style="background-color:#ffffff"&gt;30&lt;/span&gt; de julio de 2025, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Con fecha 27 de diciembre de 2017 se aprobó mediante Resolución de la Autoridad de Gestión del Programa de Desarrollo Rural de las Illes Balears, la Estrategia de Desarrollo Local Participativo (EDLP) en el territorio de Mallorca que contiene las actuaciones que se llevarán a cabo durante el período 2014-2020 en aplicación de la medida 19.2 del PDR en la citada zona rural.&lt;/p&gt;

&lt;p&gt;2. Con fecha 19 de noviembre de 2020 se publicó en el BOIB el anuncio de la convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.&lt;/p&gt;

&lt;p&gt;3. Al amparo de esta convocatoria, en fecha 18 de diciembre de 2020 con NRGE 26158, la Associació Foment Conservació i Producció Vegetals Autòctons i Tradicionals I. Balears presentó una solicitud de ayuda para el proyecto “Promoció i sensibilització de les varietats locals: Exposició de la tomàtiga de ramallet com a patrimoni cultural de Mallorca”. Este proyecto se aprobó mediante la Resolución del vicepresidente del FOGAIBA de fecha 18 de septiembre de 2022 que fue notificada el 29 de septiembre de 2022.&lt;/p&gt;

&lt;p&gt;4. En la citada Resolución de concesión de ayuda, los beneficiarios se obligan, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y a justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.&lt;/p&gt;

&lt;p&gt;5. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, los interesados han presentado las solicitudes de pago adecuadas así como la documentación exigida, pero, revisada ésta, se comprueba que no se ha realizado todo el gasto aprobado.&lt;/p&gt;

&lt;p&gt;6. Visto lo anterior y de acuerdo con el artículo 43 del Decreto legislativo 2/2005, de 28 de diciembre.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;I. Convenio de colaboración entre el Fondo de Garantía Agraria y Pesquera de las Illes Balears como Organismo Pagador, el adjunto a la Gerencia del FOGAIBA como Autoridad de Gestión y el Grupo de Acción Local Asociación Mallorca Rural por lo que se establecen las condiciones para la aplicación de la medida 19 del Programa de Desarrollo Rural de las Illes Balears 2014-2020.&lt;/p&gt;

&lt;p&gt;II.- Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm.1698/2025 del Consejo.&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;III.&amp;nbsp;Reglamento (UE) núm. 1306/2013 del Prlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agraria Común, por la cual se derogan los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm.485/2008 del Consejo.&lt;/p&gt;

&lt;p&gt;IV. Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural.&lt;/p&gt;

&lt;p&gt;V. Real Decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, de la viña.&lt;/p&gt;

&lt;p&gt;VI. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/p&gt;

&lt;p&gt;VII. Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/p&gt;

&lt;p&gt;VIII.- Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones.&lt;/p&gt;

&lt;p&gt;IX. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p&gt;X. Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/p&gt;

&lt;p&gt;XI. Decreto 64/2005, de 10 de junio, de creación del FOGAIBA.&lt;/p&gt;

&lt;p&gt;XII. Orden de la consellera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone que el FOGAIBA asume la ejecución de la política de la consejería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/p&gt;

&lt;p&gt;XIII.- Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la Comunidad Autónoma de las Illes Balears BOIB núm. 082 de 2007; en virtud de la Orden de la consellera de Agricultura y Pesca de 23 de diciembre de 2005, por la cual se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Illes Balears, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consellería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006.&lt;/p&gt;

&lt;p&gt;XIV. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Propuesta de Resolución de Revocación parcial&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Por todo esto, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos :&lt;/p&gt;

&lt;p&gt;1. Proceder a la revocación parcial de la Resolución de ayuda concedida al beneficiario y por el importe detallados en el Anexo I, que son un total de 1 expediente que comienza con la Associació Foment Conservació i Producció Vegetals Autòctons i Tradicionals I. Balears y termina con la Associació Foment Conservació i Producció Vegetals Autòctons i Tradicionals I. Balears, que suma un importe total de 615,23 euros, relativa a la línea de ayuda “Implementación operaciones incluidas en las EDLP”, ya que la justificación del gasto ha sido inferior a la aprobada. El importe total de la ayuda finalmente concedida deberá ser de 5.262,3 euros.&lt;/p&gt;

&lt;p&gt;2. Notificar la resolución a cada un de los beneficiarios del Anexo I.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
