&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;strong&gt;1.&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Mediante Resolución núm. 4532, de 10 de marzo de 2023, la Presidencia del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó el expediente de convocatoria de la concertación social del servicio de función tutelar para personas con discapacidad intelectual y/o trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca (BOIB núm. 34, de 16 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Los precios establecidos para la prestación del servicio objeto de esta concertación social vienen fijados por Resolución de la Presidencia del IMAS, núm. 21525 de 2 de diciembre de 2022, de actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB núm. 158, de 6 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Mediante Resolución núm. 7403, de 24 de abril de 2023 (BOIB núm. 55, de 29 de abril de 2023), la Presidencia de IMAS adjudicó la concertación social del servicio de función tutelar para personas con discapacidad intelectual y/o trastorno del desarrollo, según el siguiente detalle:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;8. Consta&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; en el expediente informe del Servicio de Compatibilidad y Presupuestos del Consell de Mallorca autorizando el gasto plurianual&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;9. &lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Servicio Jurídico-Administrativo y la Intervención delegada del IMAS han emitido sendos informes favorables a la propuesta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB núm. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB núm. 29, de 28 de febrero de 2008), en concreto el artículo 70.4 relativo a la competencia propia de los consejos insulares en materia de servicios sociales y asistencia social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. La Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, establece en el artículo 14 la potestad reglamentaria normativa atribuida a los consejos insulares en materia de servicios sociales, dentro del marco de la regulación básica establecida por el Gobierno de las Islas Baleares (BOIB núm. 135, de 10 de noviembre de 2001 y BOE núm. 284, de 27 de noviembre de 2001).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3.&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB núm. 89 de 18 de junio de 2009 y BOE núm. 163 de 7 de julio de 2009) prevé en el artículo 27 y en la disposición final cuarta, que cada Consejo Insular, en el marco de sus competencias, debe definir las prestaciones propias de servicios sociales, complementando la cartera básica de servicios sociales que aprueba el Gobierno de las Islas Baleares, la cual fue aprobada mediante el Decreto 66/2016, de 18 de noviembre, por el que se establecen principios generales para las carteras insulares y locales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;4. &lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consell de Mallorca de fecha 11 de abril de 2019, en especial lo establecido en el artículo 2 de acuerdo con el cual el IMAS, como organismo autónomo creado por el Consell de Mallorca, adscrito al Departamento de Bienestar Social del Consell de Mallorca, es el organismo que ejerce las competencias atribuidas por cualquier título al Consell de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;5. &lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Decreto de la Presidencia del Consell de Mallorca por el que se nombran los miembros del Consejo Ejecutivo de 10 de julio de 2023 (BOIB núm. 95, de 11 de julio de 2023) por el que se nombra al señor Guillermo Sánchez Cifre consejero ejecutivo de Bienestar Social.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;6&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB núm. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física u otra causa legal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;9. &lt;/strong&gt;Resolución de la Presidencia del IMAS núm. 7403, de 24 de abril de 2023, de adjudicación de la concertación social del servicio de función tutelar para personas con discapacidad intelectual y/o trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca 2023 (BOIB núm. 55, de 29 de abril de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En todo caso, el cambio de finalidad de la entidad o de control financiero obliga a la revisión del acuerdo inicial de acción concertada.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;No obstante, el gasto previsto para el año 2026 queda condicionado a la existencia de crédito suficiente y efectivo en el presupuesto del IMAS.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Tercero&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. UNIFICAR la documentación contable del expediente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Cuarto&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. NOTIFICAR esta Resolución a las entidades afectadas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Quinto&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. INFORMAR a las entidades concertadas que, dada su conformidad expresa, esta resolución se incluirá como adenda a sus acuerdos de acción concertada, rigiéndose el concierto por el Acuerdo de acción concertada suscrito con el IMAS modificado el precio plaza y presupuesto total, de acuerdo con esta resolución. No obstante, la entidad puede instar la firma de una adenda específica en el plazo de cinco días desde la notificación de esta resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Sexto.&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; DAR traslado de esta resolución a la Dirección insular de Personas con Discapacidad, a la Intervención delegada del IMAS y a la Dirección insular de Hacienda y Presupuestos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Séptimo. &lt;/strong&gt;PUBLICAR esta resolución en el Boletín Oficial de las Islas Baleares, así como en el Tablón de Anuncios del IMAS y Sede Electrónica del Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consell Executiu del Consell Insular de Mallorca, dentro del plazo de un mes, contador a partir del día siguiente al de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del citado recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;No obstante lo anterior, puede ejercitarse, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
