    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Junta de Gobierno de Palma, el día 9 de julio de 2025, adoptó el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar las Bases que se adjuntan en este acuerdo con número de SEFYCU 3986169 y Código Seguro de Verificación:&amp;nbsp;FACA E3HJ ZVRR 7EZE EVV7, que han de regular la convocatoria pública de LA Línea 4 Establecimientos Culturales 2024. (Marginal 2025/100011) para dar apoyo a los establecimientos culturales dedicados a la promoción, la exhibición y/o el comercio cultural de carácter privado para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Autorizar un gasto de 192.000 euros correspondiente a esta convocatoria de subvenciones de la Línea 4 para Establecimientos Culturales 2025. Marginal 2025/100011, con cargo a la aplicación presupuestaria 03.3340048300 del Presupuesto de gastos de 2025 (RC 22025007233 núm. de operación 20250013609.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar estas Bases en el BOIB y conceder un plazo de presentación de solicitudes de 20 días naturales contados desde el día siguiente de su publicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar la convocatoria de referencia en la Base de Datos Nacional de Subvenciones (BDNS) y en la página web del Ayuntamiento de Palma.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Comunicar este Acuerdo al Departamento Financiero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Concejalía de Turismo, Cultura, Deportes y Coordinación Municipal, con el Plan estratégico de subvenciones vigente, dispone del instrumento de gestión para facilitar la planificación, la ejecución y la evaluación de las políticas culturales municipales como factor estratégico en la construcción de la ciudad y en su desarrollo económico, social y territorial, promoviendo y estimulando todas las iniciativas culturales surgidas de la iniciativa colectiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este Plan se recogen los principios y las obligaciones competenciales del Ayuntamiento de Palma establecidas en el artículo 103 del capítulo XII, Cultura, de la Ley 23/2006, de 20 de diciembre, de capitalidad de Palma, como es incentivar la presencia en Palma de equipamientos de uso cultural, así como en la resolución núm. de 10678, de 10 de septiembre de 2024 de modificación de la organización de los servicios administrativos del Ayuntamiento de Palma y la resolución 11129 de 17 de septiembre de 2024, de modificación de la estructura de las áreas y áreas delegadas del Ayuntamiento y la asignación de los concejales titulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La línea 4 del Plan estratégico del Área de Cultura para el periodo 2024-2026 contempla las ayudas a establecimientos culturales dedicados a la promoción exhibición y comercio cultural de carácter privado con el fin de contribuir con su presencia como elementos de riqueza e identidad cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presente línea de subvenciones no pretende el fomento de una actividad&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;relacionada con la producción, el intercambio de bienes y servicios relacionados con el contexto cultural, si no el fomento de la presencia y continuidad de establecimientos culturales que por sus características contribuyen a la promoción de la cultura y conforman parte del patrimonio cultural de la Ciudad de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El concepto de referencia para entender el diseño de esta línea de subvenciones es el de situación, entendido como un conjunto de particularidades que definen una cosa (en este caso un inmueble), y la posición de la misma en relación a un contexto (económico, cultural o social), en este caso consistiría en garantizar la continuidad de determinados establecimientos culturales, su estructura, la ubicación y la actividad que en ellos se desarrolla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La subvención de estos establecimientos se fundamenta en elementos de valor histórico, relevo generacional, tradicional, patrimonial, el entorno en que se ubican, su configuración arquitectónica, en el fomento de la cultura propia de las Islas Baleares, y en especial de la Ciudad de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 2 de la Ley 38/2003 LGS define la subvención como toda disposición dineraria efectuada por una administración pública a favor de personas públicas o privadas que cumplan los siguientes requisitos: b) que la entrega esté sujeta al cumplimiento de un determinado objetivo, la ejecución de un proyecto, la realización de una actividad, la adopción de un comportamiento singular o la concurrencia de una situación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con lo expuesto, nos encontramos con una subvención basada en la concurrencia de una situación, por lo que resultan de aplicación los artículos 30 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (LGS) y 39.7 del Texto refundido de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (LGS) y 39.7 del Texto refundido de la Ley de la CAIB que regulan la justificación de las ayudas en la modalidad prevista en el artículo 2. b) de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 27 de la vigente Ordenanza municipal de subvenciones del Ayuntamiento de Palma prevé que el procedimiento de concurrencia competitiva se iniciará de oficio, a través de convocatoria pública aprobada por el órgano otorgante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria se regirá por los principios de publicidad, transparencia, concurrencia competitiva, objetividad, igualdad de trato y no discriminación, así como por los de eficiencia en el cumplimiento de los objetivos fijados y de eficacia en la asignación y la utilización de los recursos públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto y finalidad de las subvenciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta convocatoria es la de articular ayudas para garantizar la continuidad de establecimientos culturales, dentro del municipio de Palma, dedicados a la promoción, la exhibición y/o el comercio cultural, que tengan carácter privado, con el fin de contribuir con su presencia al fomento de la identidad de la cultura, las tradiciones, y el patrimonio de la Ciudad de Palma, dando cumplimiento al mandamiento del artículo 103. 2 e) de la Ley 23/2006 de capitalidad al disponer que el Ayuntamiento debe incentivar la presencia en Palma de equipamientos de uso cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Consignación presupuestaria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe total que se dedica a esta convocatoria es de 192.000 euros, para las obligaciones de contenido económico que se derivan de la concesión de las subvenciones, con cargo a la aplicación presupuestaria 03.33400.48300 del Presupuesto de gastos de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones queda condicionada a la existencia de crédito adecuado y suficiente en el momento que se resuelva la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Beneficiarios &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pueden optar a estas ayudas las personas físicas, jurídicas y las comunidades de bienes o cualquier otro tipo de unidad económica o patrimonio separado que, incluso, careciendo de personalidad jurídica, cumplan la finalidad de la subvención. Deben estar legalmente constituidas como titulares de la gestión de establecimientos culturales dentro del término municipal de Palma y con domicilio social en las Islas Baleares, dedicados a la promoción, la exhibición y/o el comercio cultural de carácter privado, ya sea en régimen de propiedad como de alquiler. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El receptor de la ayuda será siempre la persona física o jurídica gestora del proyecto o espacio cultural, y por la superficie del espacio correspondiente a los usos culturales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pueden ser beneficiarios de las subvenciones si se encuentran en la situación que motiva la concesión de la subvención y cumplen los requisitos y las obligaciones previstas en los artículos 13 y 14 de la LGS y 10 y 11 de la Ordenanza municipal de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No pueden ser beneficiarias de subvenciones las personas, las entidades o las agrupaciones afectadas por alguna de las prohibiciones establecidas en el artículo 13.2 de la LGS y en el artículo 10.2 de la Ordenanza municipal de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quienes opten a estas subvenciones no pueden tener abiertos expedientes sancionadores por parte de la Administración por incumplimientos de la normativa en intervenciones anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Están excluidos&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; como personas o entidades destinatarias de las ayudas los siguientes espacios: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Espacios de propiedad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Espacios de coworking (espacio de trabajo compartido e inspirador, que impulsa y fomenta la cocreación) que no cumplen los requisitos de destinatarios anteriores. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Espacios culturales no abiertos al público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Escuelas de enseñanzas artísticas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Las entidades públicas, y las privadas que desarrollan su actividad en un equipamiento público en régimen de cesión, concesión o alquiler público. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Las entidades a las que el Área de Cultura del Ayuntamiento de Palma concede una subvención directa nominativa establecida en el Presupuesto propio para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada persona o entidad sólo podrá presentar un máximo de 3 solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Modalidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta línea se estructura en tres modalidades, de acuerdo con las siguientes tipologías de equipamiento y actividad cultural: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;MODALIDAD A - ARTES EN VIVO: espacios estables de exhibición de artes escénicas como teatro, danza, circo, y otras disciplinas de las artes en vivo, así como salas de música en vivo o espacios independientes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A.1. Salas de teatro, danza, circo y otras disciplinas de las artes en vivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A.2. Salas de música en vivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A.3. Espacios independientes de creación y exhibición artística y cultural, entendidos como independientes y multidisciplinarios que apoyan la producción, la investigación y la exhibición artística y cultural, y que ofrecen una programación periódica de actividades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;MODALIDAD B - COMERCIO CULTURAL: establecimientos comerciales del ámbito cultural considerados como pequeño comercio (superficie total inferior a los 500 m2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B.1. Librerías&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B.2. Galerías de arte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;MODALIDAD C: CINES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. Salas de Cine con 7 salas de exhibición o menos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Cuantía de la ayuda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe de la ayuda se determinará tomando como referencia los metros cuadrados de superficie construida del espacio correspondiente a los usos culturales: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hasta 300 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; 3.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 301 a 500 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2 &lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;4.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 501 a 800 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; 5.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 801 a 1.000 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; 6.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 1.001 a 2.000 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2 &lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;15.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Más de 2.000 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; 24.000 € &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el importe de las solicitudes con derecho a subvención supera el máximo de la dotación de la convocatoria se disminuirá proporcionalmente entre el número de estas solicitudes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisitos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para optar a las subvenciones de esta línea los solicitantes deberán acreditar lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades deben estar legalmente constituidas de acuerdo con la normativa vigente, registradas y activas en la fecha de la presentación de la solicitud, y tener capacidad jurídica y de obrar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El funcionamiento estable y con actividad en el local o el establecimiento concreto objeto de la subvención el año anterior a la publicación de la convocatoria de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estar abiertos en el año 2025 antes de finalizar el periodo de presentación de solicitudes y el compromiso de mantener abierto el establecimiento al menos durante los 6 meses posteriores a la resolución de la concesión definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento de Palma se reserva el derecho a solicitar la memoria detallada de la actividad que se haya podido llevar a cabo, que justifique la organización de actividades de interés social y abiertas al público, así como otra que acredite el cumplimiento de los requisitos para ser beneficiario, en cualquiera de las modalidades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Presentación de solicitudes y documentación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Las entidades o personas interesadas que cumplan los requisitos que determinan estas bases deben presentar una solicitud para cada espacio, de acuerdo con el modelo de solicitud normalizado correspondiente a la convocatoria de esta línea de subvenciones que estará disponible en la web municipal, www.palma.cat, en el apartado de Registro de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presentación de la solicitud debe hacerse a través del Registro electrónico del Ayuntamiento de Palma o en el resto de registros electrónicos de cualquiera de los sujetos del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo para presentar solicitudes es de 20 días naturales contados desde el día siguiente al de su publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquier solicitud presentada fuera de este plazo no será admitida a trámite. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 68 de la Ley 39/2015 y el artículo 23.5 de la LGS, si la solicitud de subvención no cumple los requisitos que se indican o no se incluye la documentación que corresponde, con las excepciones no enmendables en cuanto a la presentación de la solicitud con el modelo normalizado previsto en estas bases, se requerirá a la persona o a la entidad que en el plazo de 10 días hábiles improrrogables enmiende la carencia o aporte los documentos preceptivos, con la indicación de que, si no lo hace, se considerará que desiste de su solicitud, previa resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la solicitud se debe indicar la documentación que se adjunta para llevar a cabo la valoración correspondiente, según el impreso de solicitud, así como una dirección electrónica para comunicaciones y el importe de la subvención que se solicita. Además, se debe adjuntar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Instancia normalizada de solicitud que consta como anexo de esta convocatoria y que se puede descargar en formato de web http://www.palma.cat (Registro de Subvenciones, Área de Cultura), con la relación de la documentación que aporta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fotocopia del NIF de la persona o la entidad solicitante. En el caso de las comunidades de bienes, el NIF de todos los comuneros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es una persona jurídica, fotocopia del documento constitutivo de la entidad y de sus estatutos sociales, o escrituras de la entidad, debidamente inscritos en el registro correspondiente, donde se indique claramente el carácter cultural de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es una persona jurídica, fotocopia del NIF del representante de la entidad y documentación que acredite esta facultad de representación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es una comunidad de bienes, documento con los compromisos de ejecución asumidos por cada miembro y el importe de la subvención que se le aplica a cada uno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Escritura pública o contrato privado donde se determinen claramente los metros cuadrados destinados a la actividad objeto de subvención.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documentación que acredite la realización de actividades culturales en el establecimiento identificado, presentando el certificado de situación en el censo de actividades económicas de la AEAT en fecha de presentación de la solicitud, y que figure de alta en 2024.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de estar al corriente en cuanto a las obligaciones fiscales con el Ayuntamiento de Palma, así como declaración de la vigencia de los estatutos y cargos representativos de la entidad solicitante; de no encontrarse en ninguna de las circunstancias del artículo 13.2 de la LGS ni de tener abiertos expedientes sancionadores por parte de la Administración por incumplimientos de la normativa en intervenciones anteriores, y del artículo 10.2 de la Ordenanza municipal de subvenciones (ANEXO I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable en la que se hagan constar todas las subvenciones solicitadas y/o concedidas por otras administraciones públicas para la misma finalidad, justificando debidamente la finalidad y el concepto de las demás subvenciones. En caso negativo, debe manifestarse expresamente que no se ha solicitado ni se ha concedido ninguna otra subvención (ANEXO II).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de desarrollar la actividad en el local o el establecimiento concreto objeto de la subvención, así como de la superficie destinada a uso cultural, respecto de la superficie total del bien (ANEXO III).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de acreditar el funcionamiento estable y con actividad en el local o el establecimiento concreto objeto de la subvención el año anterior a la publicación de la convocatoria de las ayudas, y de estar abiertos en el año 2024 antes de finalizar el periodo de presentación de la solicitud; así como, declaración responsable del compromiso de mantener abierto el establecimiento al menos durante los 6 meses posteriores a la resolución de la concesión definitiva (ANEXO IV).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado bancario de los datos de la cuenta corriente de la entidad donde se solicita que se efectúe el ingreso de la subvención que se conceda (ANEXO V).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado vigente expedido por la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Agencia Tributaria Estatal&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; que acredite que la entidad o persona en cuestión está al corriente de sus obligaciones tributarias.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado vigente expedido por la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Agencia Tributaria de las Islas Baleares&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; que acredite que la entidad o persona en cuestión está al corriente de sus obligaciones tributarias.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado vigente de estar al corriente en cuanto al cumplimiento de las obligaciones con la &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Seguridad Social&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;* Estos certificados, para el procedimiento de subvenciones, sólo tienen una validez de 6 meses.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Otra documentación que la persona solicitante considere adecuado aportar.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Comisión de valoración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dada la cuantía de las ayudas previstas en la presente convocatoria, resulta preceptiva la constitución de una comisión de valoración de las solicitudes de subvención, de conformidad con lo previsto por el artículo 31 de la vigente Ordenanza municipal de subvenciones del Ayuntamiento de Palma, de forma que dicho órgano colegiado, tras la valoración de las peticiones presentadas, emita informe motivado en el que se concrete el resultado de la misma, el cual servirá de base para formular la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Órganos competentes para instruir y resolver el procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor son los servicios administrativos adscritos al Servicio de Cultura que supervisará el cumplimiento de los requisitos mencionados en estas Bases. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dado lo previsto en las vigentes Bases de ejecución del Presupuesto, en relación a los artículos 21.1 y 7.1 de la Ordenanza municipal de subvenciones relativas a la competencia para conceder la subvención, es competencia de la Junta de Gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son aplicables a la instrucción y a la resolución del procedimiento de concesión en régimen de concurrencia competitiva los arts. 27 a 37 de la Ordenanza municipal de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Instrucción, resolución y notificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Instrucción. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El órgano instructor, además de supervisar el cumplimiento de los requisitos exigidos en las Bases, llevará a cabo de oficio las actuaciones necesarias para determinar, conocer y comprobar los datos en virtud de los cuales debe dictarse la resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez recibida la documentación presentada se iniciará la fase de instrucción ordenando los documentos, pre-evaluando las solicitudes y emitiendo un informe vinculante relativo al cumplimiento de los requisitos necesarios para adquirir la condición de beneficiarios. Se puede requerir a los interesados que enmienden las posibles deficiencias en el plazo improrrogable de 10 días, salvo aquella documentación que no se puede subsanar, con la indicación de que si no lo hacen se considerará que han desistido de su solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez finalizada esta primera fase de instrucción se emitirá un informe motivado, de acuerdo con la documentación requerida en esta convocatoria y se enviarán los expedientes a la Comisión Evaluadora, que, tras valorar las solicitudes y los proyectos presentados, deberá emitir un informe motivado con carácter preceptivo y vinculante, de acuerdo con los criterios de concesión fijados en esta convocatoria. Este informe recogerá la puntuación obtenida para cada proyecto y establecerá una prelación. A los efectos del informe mencionado, los miembros de la Comisión podrán requerir a los solicitantes las aclaraciones que estimen oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta provisional.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Visto el expediente y el informe de la Comisión Evaluadora el órgano instructor formulará la propuesta de resolución provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Esta propuesta de resolución se &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;publicará en la web del Ayuntamiento de Palma &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;(www.palma.cat). Se incluirá la lista de entidades o de personas propuestas para el otorgamiento de las subvenciones y su cuantía, así como la lista de excluidos, indicando la causa. Esta publicación abre el trámite de audiencia y se concederá un plazo de diez días hábiles contados desde el día siguiente al de su publicación para poder examinar el expediente en la sede del Negociado de Cultura y presentar alegaciones. El órgano instructor incorporará al expediente la diligencia firmada por la persona responsable del Negociado o, en caso de ausencia, del jefe del Servicio, en el que constan los lugares y las fechas en que se ha producido esta publicación. En cuanto al lugar de presentación de alegaciones, se deberá actuar según la base 7ª de esta normativa, así como se hace con las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se podrá prescindir del trámite de audiencia cuando en el procedimiento no figuren ni se tengan en cuenta otros hechos o alegaciones y pruebas que las que aducen las personas interesadas. En estos casos la propuesta de resolución formulada tendrá el carácter de definitiva. Asimismo, el hecho de que las personas interesadas no aleguen nada en el trámite de audiencia supondrá que están conformes e, igualmente, la propuesta de resolución formulada tiene el carácter de definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta de resolución definitiva&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Una vez concluido el trámite de audiencia y examinadas las alegaciones que presenten las personas interesadas deberá formularse la propuesta de resolución definitiva, que se &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;publicará en la web del Ayuntamiento de Palma&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; (www.palma.cat), y que deberá aprobar el órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;La resolución definitiva se publicará y notificará mediante su publicación en la web del Ayuntamiento de Palma (www.palma.cat) y en el BOIB&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el art. 45 de la Ley 39/2015, incluyendo, como mínimo, la lista de entidades o personas beneficiarias propuestas para el otorgamiento de la subvención y la cantidad definitiva de las mismas, así como la lista de las excluidas, con indicación de la causa de exclusión. Una vez publicada y notificada la propuesta, las entidades o personas beneficiarias deberán comunicar al órgano instructor si aceptan la propuesta de resolución o renuncian a ella. En cualquier caso, se entenderá que la aceptan si en el plazo de diez días naturales desde que se publique la propuesta de resolución definitiva no indican lo contrario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento no puede exceder de seis meses a partir de la publicación de la convocatoria, de acuerdo con el art. 34 de la Ordenanza municipal de subvenciones. Si transcurre este plazo sin que se haya dictado resolución legítima se entenderá desestimada la petición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las propuestas de resolución provisional y definitiva no crean ningún derecho a favor del beneficiario propuesto ante la Administración mientras no se haya publicado en el BOIB la resolución de concesión, de acuerdo con el art. 24.6 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Obligaciones de los beneficiarios y efectos derivados de su incumplimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Son aplicables a los beneficiarios las obligaciones y los efectos previstos en el art. 11 y siguientes de la Ordenanza municipal de subvenciones y los que establecen las Bases de ejecución del Presupuesto vigente; así como cumplir con el objeto de la actividad del espacio cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Mantener su actividad empresarial al menos durante los 6 meses siguientes a la resolución definitiva de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Someterse a las actuaciones de control y comprobación que corresponda al Ayuntamiento de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Las personas o entidades beneficiarias deben conservar los documentos que demuestran que cumplen los requisitos para ser beneficiarias de la ayuda durante un periodo de cinco años desde la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Justificación y Pago. Reglas generales sobre cómo la persona beneficiaria debe justificar el cumplimiento de la finalidad para la que se concede la subvención y la aplicación del fondo percibido&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el marco del artículo 39.7 del Texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, y 30.7 de la LGS, estas ayudas se justifican por el hecho de cumplir los requisitos necesarios para beneficiarse.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas ayudas se conceden en atención a la concurrencia de los requisitos establecidos en esta convocatoria, sin perjuicio de los controles que se puedan realizar con el fin de verificar la certeza de la documentación presentada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez aprobada la resolución definitiva de estas ayudas se harán los trámites adecuados para su abono.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Compatibilidad de la subvención con otras ayudas que se puedan obtener para el mismo fin&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones que se otorguen de acuerdo con estas bases son compatibles con la concesión de otras ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades beneficiarias deben comunicar al Departamento de Cultura, la obtención de cualquier subvención o ayuda para la misma finalidad procedente de cualquier administración o ente privado, en el plazo de diez días hábiles desde su obtención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si se tienen que recibir o se han recibido otros tipos de ingresos o ayudas procedentes del Ayuntamiento de Palma, hay que indicarlo expresamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Régimen jurídico&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para todo lo que no prevén estas bases son de aplicación la Ley 38/2003, de 17 de noviembre, general de subvenciones; el Texto refundido de la Ley de subvenciones, aprobado mediante el Decreto legislativo 2/2005, de 28 de diciembre; la Ordenanza municipal de subvenciones del Ayuntamiento de Palma; el Reglamento de la Ley 38/2003, general de subvenciones, aprobado mediante el Real Decreto 887/2006, de 21 de julio; la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; la Ley 57/2003, de 16 de diciembre, de medidas para la modernización del gobierno local; el Texto refundido de la Ley reguladora de las haciendas locales, aprobado mediante el Real Decreto Legislativo 2/2004, de 5 de marzo; la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares; la Ley 23/2006, de 20 de diciembre, de capitalidad de Palma; las Bases de ejecución del Presupuesto municipal, y el resto de normativa que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria se rige por los principios de publicidad y concurrencia competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Interposición de recursos &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta convocatoria pública de subvenciones, que agota la vía administrativa, se puede interponer un recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. El plazo para interponerlo es de un mes contado desde el día siguiente al de la fecha de publicación o notificación. En este caso no cabe interponer recurso contencioso administrativo hasta que se haya resuelto el de reposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El recurso de reposición puede presentarse en el Registro General de este Ayuntamiento o en las dependencias a que se refiere el artículo 16.1 de la Ley 39/2015, y se considerará desestimado si no se ha resuelto y se ha notificado la resolución en el plazo de un mes contado desde el día siguiente al de su interposición. En este caso queda expedita la vía contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si no se utiliza el recurso de reposición, se puede interponer directamente recurso contencioso-administrativo, de acuerdo con el artículo mencionado anteriormente y el 45 y siguientes de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, ante el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de dos meses contados desde el día siguiente al de la fecha de la publicación sin perjuicio de cualquier otro recurso o acción que se considere pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Protección de datos de carácter personal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el Reglamento UE 2016/679, de 27 de abril y la Ley orgánica 3/2018, de 5 de diciembre de protección de datos de carácter personal y la normativa de desarrollo, los datos que se aporten se incorporarán y se tratarán en el fichero de subvenciones con la finalidad de llevar su gestión. Se puede ejercer el derecho de acceso, rectificación, cancelación y oposición al tratamiento de estos datos según las condiciones previstas en la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
