![CDATA[Resolución de concesión de la convocatoria de cooperaciones técnicas del Consejo de Mallorca por el año 2025 relativa a la redacción de proyectos y la dirección técnica de obras municipales]] CAIB 508181 es 2025-07-22 text/html es CAIB 310 703549 CAIB ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Consejera Ejecutiva de Promoción Económica y Desarrollo Local del Consejo Insular de Mallorca día 17 de julio de 2025, ha dictado la siguiente resolución: </span></span></p> <p><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">“Antecedentes de hecho</span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primero.</strong> En fecha 13 de marzo de 2025 se dictó, por la consejera ejecutiva de Promoción Económica y Desarrollo Local, resolución por la cual se aprueba la convocatoria de cooperaciones técnicas del Consell de Mallorca por el año 2025 relativa a la redacción de proyectos y la dirección técnica de obras municipales.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo.</strong> En fecha 17 de julio de 2025, una vez hechas las comprobaciones de viabilidad previstas al apartado 6c) de la convocatoria, por el servicio de asistencia técnica se emitió informe indicando cuales de los proyectos pueden ser objeto de cooperación técnica solicitada y cuales tienen que ser excluidos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercero</strong>. En fecha 17 de julio de 2025, se ha firmado, por parte del secretario técnico del departamento, la propuesta de resolución de concesión de la convocatoria de cooperaciones técnicas del Consell de Mallorca para el año 2025 relativa a la redacción de proyectos y la dirección técnica de obras municipales.</span></span></p> <p><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">I. El artículo 36.1. letra b) de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local, que establece como competencia de los Consejos Insulares la cooperación técnica en los municipios.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">II. El artículo 29, que lleva por título "<em>Planes de cooperación técnica</em>" del Reglamento antes mencionado, dispone en el apartado 1 que "<em>el Consell de Mallorca tiene que hacer una convocatoria de cooperación técnica para la redacción de proyectos como para la dirección técnica de las obras, que no tiene periodicidad preestablecida y se hará en función de las disponibilidades y la carga de trabajo de los servicios</em>".</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">III. Debido a la singularidad de esta convocatoria, el criterio de concesión aplicado se ajusta a lo previsto en el párrafo segundo del artículo 17.1 de la Ordenanza General de Subvenciones, aprobada por Acuerdo de Pleno de fecha 23 de diciembre de 2016, que dispone: “<em>No es necesario fijar un orden de prelación entre las solicitudes presentadas que reúnen los requisitos establecidos si el crédito consignado en la convocatoria es suficiente, atendiendo el número de solicitudes una vez finalizado el plazo de presentación</em>”. En este caso, si bien se realizó informe de valoración de la viabilidad de los proyectos, puntuándolos, el régimen de concesión es de concurrencia no competitiva, porque se concederán las cooperaciones de todos los proyectos que cumplen con las condiciones de viabilidad, sin que ningún beneficiario sea excluido por la falta de capacidad para atender las solicitudes presentadas.</span></span></p> <p style="text-align:center"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución</span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo el expuesto anteriormente, la consejera ejecutiva de Promoción Económica y Desarrollo Local aprueba la siguiente concesión:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.
