39727 39729 ![CDATA[<p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se publica la resolución del consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> ejecutivo de Hacienda y Función Pública dictada por delegación del Consejo Ejecutivo, según el Acuerdo de 28 de septiembre de 2022, BOIB nº. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“Hechos</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.&nbsp;</strong>Por Resolución del consejero ejecutivo de Hacienda y Función Pública, de 2 de diciembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023, de fecha 7 de febrero de 2023 y de fecha 29 de agosto de 2023 (BOIB nº. 13, de 28 de enero de 2023; BOIB nº. 19; de 11 de febrero de 2023 y BOIB nº. 121, de 31 de agosto de 2023, respectivamente) se aprobó la convocatoria del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal laboral fijo de los subgrupos A1, A2, C1 y C2 y grupo AP derivada de la oferta de empleo pública de los Ayuntamientos de Alcúdia, Algaida, Andratx, Artà, Binissalem, Campanet, Capdepera, Consejo, Esporles, Inca, Lloret de Vistalegre, Manacor, Pollença, Sa Pobla, Sencelles, Ses Salines, Son Servera y Valldemossa; de las Mancomunitat des Pla y des Raiguer; de la empresa municipal Servicios Municipales de Porreres, SL, y del Patronato Residencia Cas Metge Rei.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.&nbsp;</strong>En esta Resolución se convocaron: 1 plaza de la categoría de AODL Agente de ocupación y desarrollo local del Ayuntamiento de Algaida (ELO0A1/040), 1 plaza de técnico-a de deportes del Ayuntamiento de Manacor (ELO0A1/293), 1 plaza de profesor-a de violín del Ayuntamiento de Pollença y 1 plaza de psicólogo-a de la Mancomunitat des Pla.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.&nbsp;</strong>Por Acuerdo del Tribunal calificador competente de este proceso selectivo de estabilización, una vez concluida la revisión y la baremación de los méritos de los aspirantes, en fecha 26 de junio de 2025, se publicaron, en el tablón electrónico de anuncios y en la Sede electrónica del Consejo Insular de Mallorca, la lista definitiva de puntuaciones obtenidas por las personas aspirantes, con aplicación de los criterios de desempate y la resolución de las alegaciones formuladas a la lista provisional de puntuaciones, así como el listado de puestos correspondientes a las plazas convocadas. Dado que estas convocatorias tienen una única plaza convocada la asignación del puesto de trabajo se ha hecho de oficio. De conformidad con el punto 14.1 de las bases específicas de la convocatoria, una vez asignados los puestos de trabajo ofrecidos, el tribunal ha de elevado al consejero ejecutivo de Hacienda y Función pública la propuesta de personas aspirantes que han superado el proceso selectivo de concurso oposición, con asignación de puestos de trabajo, desglosada, en su caso, por turnos de acceso.&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.&nbsp;</strong>En fecha 7 de julio de 2025 el Tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero de Hacienda y Función Pública el Acuerdo de la propuesta de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal laboral fijo del subgrupo A1, derivada de la oferta de empleo pública del Ayuntamiento de Algaida (AODL Agente de ocupación y desarrollo local (ELO0A1/040)), del Ayuntamiento de Manacor (Técnico-a de deportes (ELO0A1/293)), el Ayuntamiento de Pollença (Profesor-a violín (ELO0A1/462)) y de la Mancomunitat des Pla (Psicólogo-a (ELO0A1/462)) y de asignación de puestos de trabajo, por turno de acceso, para su contratación como personal laboral fijo, la cual contiene tantas personas aprobadas como el número de plazas convocadas. INFORMAR</strong> a los ayuntamiento que la adjudicación y adscripción definitiva de los puestos de trabajo a las personas aspirantes queda acondicionada a la acreditación de estar en posesión de todos los requisitos específicos para la adscripción al puesto de trabajo, en que tendrá que ser requerida, si procede, por cada ayuntamiento.&nbsp;</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el establecido en la base específica 14.4 de la convocatoria, los puestos de prefecturas orgánicas y puestos singularizados se tienen que adjudicar en adscripción provisional.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. ORDENAR</strong> la publicación de esta Resolución y su Anexo en el tablón de edictos y en la Sede electrónica del Consejo Insular de Mallorca, y en el Boletín Oficial de las Islas Baleares.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos&nbsp;</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra este acto, que no pone fin a la vía administrativa, podéis interponer el recurso de alzada en el plazo de un mes, contador a partir del día siguiente de recibir esta notificación. El recurso se puede interponer formalmente ante el Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación expresa de este recurso de alzada, podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&nbsp;</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si han transcurrido tres meses desde la interposición del recurso de alzada y no habéis recibido la notificación de resolución expresa, se entiende desestimado por silencio y podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante el anterior, podéis interponer, si procede, cualquier otro recurso que consideráis oportuno.
