&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“Exp. 752/2024. Licitación del proyecto de cambio de forjado y cubierta de Can Vallès”&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El señor Juan Bernardo Ripoll Deyà, concejal delegado en materia de obras públicas y proyectos, presenta para su aprobación la siguiente propuesta de acuerdo:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el proyecto de obra&amp;nbsp;&lt;em&gt;“Cambio de forjado y cubierta de Can Vallès”&lt;/em&gt;, redactado por los arquitectos colegiados Francesc Negre Mas, colegiado nº 638821, y Jordi Creus Sarri, colegiado nº 686352; visado COAIB 11/08700/24 el día 10 de septiembre de 2024.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atendiendo al informe favorable de supervisión y de comprobación del cumplimiento de la normativa sectorial urbanística y medioambiental del proyecto mencionado, emitido por el técnico municipal el 20 de junio de 2024.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DATOS DEL PROYECTO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. CARACTERÍSTICAS, IDENTIFICACIÓN Y ESPECIFICACIONES DEL PROYECTO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1)&amp;nbsp;&lt;strong&gt;PROMOTOR:&amp;nbsp;&lt;/strong&gt;Ayuntamiento de Deià.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2)&amp;nbsp;&lt;strong&gt;EMPLAZAMIENTO:&amp;nbsp;&lt;/strong&gt;Deià.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3)&amp;nbsp;&lt;strong&gt;REDACTOR&lt;/strong&gt;:&amp;nbsp;Francesc Negre Mas y Jordi Creus Sarri.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4)&amp;nbsp;&lt;strong&gt;FECHA DEL PROYECTO:&lt;/strong&gt;&amp;nbsp;Septiembre 2024.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5)&amp;nbsp;&lt;strong&gt;DESCRIPCIÓN:&lt;/strong&gt;&amp;nbsp;Cambio de forjado y cubierta de un edificio aislado.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6)&amp;nbsp;&lt;strong&gt;DOCUMENTACIÓN:&amp;nbsp;&lt;/strong&gt;El proyecto está integrado por los siguientes documentos:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 1: Estudio básico de seguridad y salud.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 2: Asumen dirección.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 3: Proyecto de ejecución: memoria descriptiva y constructiva, CTE, anexos.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 4: Plan de mantenimiento de la estructura.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 5: Planos.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 6: Pliego de condiciones.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 7: Pliego de prescripciones técnicas particulares.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 8: Presupuesto.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento 9: Estudio de gestión de residuos de construcción y demolición.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1)&amp;nbsp;&lt;strong&gt;PLAZO DE EJECUCIÓN APROXIMADO:&lt;/strong&gt;&amp;nbsp;Entre 6 meses y un año, como máximo el 31 de mayo de 2026, dado que este es el plazo máximo para completar las actuaciones según las bases de la convocatoria de subvenciones aprobada.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2)&amp;nbsp;&lt;strong&gt;CLASIFICACIÓN DEL CONTRATISTA:&lt;/strong&gt;&amp;nbsp;Grupo C, Subgrupo 2, Categoría 2, 3 o 4.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3)&amp;nbsp;&lt;strong&gt;PLAZO DE GARANTÍA:&amp;nbsp;&lt;/strong&gt;2 años.&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Presupuesto de licitación: 225.000 € (IVA INCLUIDO).&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Observaciones de la oficina de supervisión de proyectos:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente contratación se regirá por la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PROPUESTA DE APROBACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Proyecto, dado que reúne, en atención a sus características y naturaleza, los requisitos exigidos por la Ley de Contratos del Sector Público, el Reglamento General de Contratos de las Administraciones Públicas y por la normativa técnica existente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cumplimiento del artículo 149.1 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, se considera que el proyecto se ajusta a la legislación general de contratos de las administraciones públicas, así como específicamente a los requisitos de la legislación urbanística, de protección medioambiental y de patrimonio histórico.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe de Patrimonio que obra en el expediente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que la competencia para aprobar los proyectos corresponde al mismo órgano que tiene las atribuciones para aprobar la contratación de fondos, y así consta en el artículo 123 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Teniendo en cuenta lo establecido en el artículo 231&amp;nbsp;&lt;em&gt;"(...) La aprobación del proyecto corresponde al órgano de contratación salvo que esta competencia esté específicamente atribuida a otro órgano por una norma jurídica."&lt;/em&gt;&amp;nbsp;de la Ley 9/2017, de 7 de noviembre, de Contratos del Sector Público, por la que se trasladan al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que se trata de un edificio emblemático o de uso público considerado por tener un impacto significativo en el interés general.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que el artículo 22.2.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, establece que el pleno municipal es competente para aprobar los asuntos de especial trascendencia que afecten al municipio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PROPUESTA DE ACUERDO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt;–&amp;nbsp;&lt;strong&gt;APROBAR INICIALMENTE&lt;/strong&gt;&amp;nbsp;el proyecto de obra&amp;nbsp;&lt;em&gt;“Cambio de forjado y cubierta de Can Vallès”&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.&lt;/strong&gt;–&amp;nbsp;&lt;strong&gt;AUTORIZAR&lt;/strong&gt;&amp;nbsp;la continuidad del procedimiento, incluyendo la elaboración del pliego de condiciones y la licitación del contrato, de conformidad con lo establecido en la Ley de Contratos del Sector Público (LCSP).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.&lt;/strong&gt;–&amp;nbsp;&lt;strong&gt;PUBLICAR&lt;/strong&gt;&amp;nbsp;el presente acuerdo en el Boletín Oficial de las Islas Baleares y en el Perfil del Contratante, garantizando la transparencia y publicidad del procedimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.&lt;/strong&gt;–&amp;nbsp;&lt;strong&gt;REMITIR&lt;/strong&gt;&amp;nbsp;el expediente al departamento correspondiente para la ejecución de los trámites posteriores.&lt;/span&gt;&lt;/p&gt;
