En fecha de 19 de diciembre de 2023 se publicó, en el Boletín Oficial de las Islas Baleares núm. 171 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), por la que se convocan, mediante el procedimiento anticipado de gasto y para los años 2023 y 2024, subvenciones para la creación de empresas de jóvenes agricultores y agricultoras.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes finalizó el día 29 de febrero de 2024.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. En fecha de 14 de junio de 2025 se publicó, en el Boletín Oficial de las Islas Baleares núm. 75 la notificación de deficiencias a los beneficiarios de las ayudas, de fecha 9 de junio de 2025, al amparo de la Resolución del presidente del Fondo de Garantía. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados ​​señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. Corresponde proponer para denegar los expedientes señalados en el Anexo I por los motivos indicados en el citado anexo. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Fundamentos de derecho </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), por la que se convocan, mediante el procedimiento anticipado de gasto y para los años 2023 y 2024, subvenciones para la creación de empresas de jóvenes agricultores y agricultoras. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Orden 10/2023 de la consejera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2023-2027, corresponde aprobar la convocatoria de estas ayudas mediante resolución. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Ley 39/2015 de 1 de octubre de régimen jurídico de las administraciones públicas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por todo ello, se informa desfavorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Denegar la ayuda solicitada por los interesados ​​que figuran en el Anexo I , que son un total de 14 expedientes y que comienza con JAUME CANTALLOPS GELABERT y termina con JESUS ​​IGNACIO FEDELICH TALTAVULL, relativa a la línea de ayudas «Creación de empresas de jóvenes agricultores», por se especifican en el citado anexo. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.
