Propuesta de aprovación inicial del «Plan de actuación de àmbito local frente emergencias por incendios forestales del municipio de es Mercadal» (E0446/2020/778)</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Se tiene en cuenta de la propuesta de aprobación inicial del “Plan de actuación de ámbito local ante emergencias por incendios forestales del municipio de Es Mercadal”, la cual fue dictaminada favorablemente a la comisión informativa ordinaria de Urbanismo y Obras celebrada en fecha 19 de junio de 2025, y fue aprobada por unanimidad (2 votos y 2 votos 1 PSOE)</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>«PROPUESTA DE LA ALCALDIA»</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Considerando que en fecha 8 de octubre de 2020 se firmó el CONVENIO ENTRE EL CONSEJO INSULAR DE MENORCA Y LOS AYUNTAMIENTOS DE LA ISLA PARA LA REDACCIÓN DEL PLAN INSULAR CONTRA INCENDIOS FORESTALES, aprobado por el Pleno municipal en sesión ordinaria el 30 de septiembre de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Dado que en fecha 21 de mayo de 2021, el Ayuntamiento remitió al Consejo Insular de Menorca (CIM) la siguiente documentación como información a efectos de redactar el plan:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>Proyecto de <strong>Gestión Forestal en las Áreas Municipales de la Urbanización Son Parc</strong>, T.M. Es Mercadal, signat per J. Joaquín García García-Roldán en data 28/08/2020.</em></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em><strong>Plan integral de defensa contra incendios forestales para las urbanizaciones ubicadas en la interfase urbano/forestal de Menorca,</strong> firmado por Jose Domingo Yerbes, ingeniero de Montes en fecha 20/01/2013, documento Consell Insular de Menorca i Govern de les Illes Balears</em></span></span></p> </li> </ul> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Dado que en fecha 27 de feber de 2024, el CIME envió el plan elaborado por Tragsa: «PLAN DE ACTUACIÓN DE ÁMBITO LOCAL ANTE EMERGENCIAS POR INCENDIOS FORESTALES DEL MUNICIPIO DE ES MERCADAL (Menorca)», que consiste en 3 documentos: una memoria, 27/04/2023, por Mónica Fernández Ramirez y Carolina Quesada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Dado que en fecha 17 de marzo de 2025, la ingeniera municipal, emitió informe en el que indicó:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">«Para poder estudiar y aprobar el Plan, necesitamos poder analizar los criterios y definiciones de las actuaciones, en concreto se solicita:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. <strong>Aclaración si el Presupuesto total</strong> de ejecución de <strong>560.737,72€,</strong> considera gastos generales, beneficio industrial e IVA.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Documento <strong>Excel con desglosamientos de las unidades de obra</strong> asi como la determinación de los precios i criterios considerables.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Aclaración sobre la diferencia de presupuesto considerado, en concreto por el ambito de Son Parc entre el «PLAN DE ACTUACIÓN DE ÁMBITO LOCAL ANTE EMERGENCIAS POR INCENDIOS FORESTALES DEL MUNICIPIO DE ES MERCADAL (Menorca)», redactat per CIME i el "<strong>Proyecto de Gestión Forestal en las Áreas Municipales de la Urbanización de Son Parc, TM Mercadal</strong>", en fecha 27/07/2020 que fué enviado durante la redacción del Pleno.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Dado que mediante oficio de la Alcaldía de 24 de marzo de 2025 el precedente informe se trasladó al Consell Insular de Menorca.</span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Dado que en fecha 17 de junio de 2025, la ingeniera municipal ha emitido informe en el que concluye:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>«CONCLUSIONES»</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1) De acuerdo con el apartado 3.5. del Real <em>Decreto 893/2013, de 15 de noviembre, por el que se aprueba la Directriz básica de planificación de protección civil de emergencia por incendios forestales </em><span style="color:#000080"><span style="color:#000000"><em>https://www.boe.es/buscar/act.php?id=BOE-A-2013-12823</em></span></span><em> </em>, sobre <em>Los planes de actuación de ámbito local </em>:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>Los planes municipales o de otras entidades locales, </em><strong><em>establecerán la organización y procedimiento de actuación de los recursos y servicios cuya titularidad corresponda a la administración local de que se trate y los que puedan ser asignados al mismo por otras administraciones públicas o por otras entidades públicas o privadas,</em></strong><em> al objeto de hacer frente a las emergencias por incendios forestales, dentro del ámbito territorial de aquella. (3.5.1. Concepto )</em></span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em>Los planes de actuación de ámbito local de emergencia por incendios forestales deberán ser <strong>elaborados e implantados </strong>por el organismo competente en aquellos municipios con riesgo de incendio forestal que así se determinen en el correspondiente Plan de Comunidad Autónoma. Se deberán evaluar si requiere medidas adicionales.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Las actuaciones planeadas, las preventivas sobre el terrritorio (está previsto que las ejecute el CIME mediante Convenio de el ayuntamiento) i las actuaciones organizativas de el ayuntamiento (que las deberá ejecutar el ayuntamiento), han de tner en cuenta todo lo que se especificó en el apartado de consideraciones tecnicas, particularmente:</span></span></p> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En Son Parc se han de revisar las zonas prioritarias que no estan definidas i que por falta de recursos el ayuntameinto no puede ajecutar.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En Arenal de es Castell – Punta Grossa, se considera que se habría de evaluar tambien Zona CASOR- 1 i zonas verdes municipales.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Revisar el número de hidrantes a colocar, ya que hay más núcleos (de los relacionados en el Plan) que no disponen de hidrantes en su red de abastecimiento de agua potable y, además, de los existentes, no todos funcionan correctamente y no cubren todas las zonas. Vigilancia disuasoria, se propone que 2 personas de la brigada y/o voluntarios realicen rutas y visitas en verano. Ubicación de las aguas y los hidrantes del Mercado Excel en Son Park</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Desde el 17 de noviembre de 2020, el Concejal de Medio Ambiente y Territorios del GOIB, resolvió:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">“Determinar los lineamientos para el desarrollo e implementación de los Planes Locales de Prevención de Incendios Forestales (PLPIF) de ámbito municipal, en los siguientes términos:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. El PLPIF tendrá como finalidad elaborar un documento técnico que sirva como mecanismo para establecer, planificar e implementar acciones de prevención de incendios forestales a nivel local, por parte de los distintos actores involucrados, con el objetivo de evitar los incendios forestales, minimizar los daños y garantizar una defensa eficaz contra los mismos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Los PLPIF deberán basarse en el IV Plan General de Defensa contra Incendios Forestales de las Illes Balears (PGIF) y en el Plan insular o autonómico correspondiente vigente. Su contenido debe estar orientado especialmente a especificar y priorizar la planificación de acciones concretas de prevención a escala y por actores locales, mientras que la caracterización del riesgo a escala de condado o isla ya está definida en el resto de planes de nivel superior.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. La dirección general competente en materia de incendios forestales, si así lo solicita la corporación responsable de la elaboración y aprobación del PLPIF, prestará apoyo técnico para la elaboración del plan.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. Los PLPIF serán aprobados por los órganos de las respectivas administraciones locales competentes en cada caso. Se puede solicitar con antelación a la Dirección General de Espacios Naturales y Biodiversidad, del Ministerio de Medio Ambiente y Territorio, que tiene asignadas las funciones de prevención de incendios forestales y forma de adaptación al Plan General de Incendios Forestales de la CAIB y la</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">«Plano de isla correspondiente o plan de condado actual.»</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Dado que el arte. El artículo 26 de la Ley 3/2006, de 30 de marzo, de Gestión de Emergencias de las Illes Balears, dispone que:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">«Artículo 26. Aprobación de planes. Publicación y publicidad</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Los planes municipales y supramunicipales serán aprobados provisionalmente por el Pleno del ayuntamiento o ayuntamientos correspondientes, previo informe de la Junta Local de Protección Civil. La aprobación final corresponderá también al pleno o plenos del ayuntamiento o ayuntamientos afectados, previa aprobación de la Comisión de Emergencias y Protección de las Islas Baleares (CEPIB).</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Los planes insulares serán aprobados por el órgano competente del consejo insular correspondiente, previa aprobación de la CEPIB.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Los planes mencionados en los dos puntos anteriores no podrán ejecutarse hasta su aprobación, que deberá realizarse por la autoridad competente en el plazo máximo de tres meses desde su recepción por dicha autoridad.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los planes que no sean aprobados deberán ser modificados de acuerdo con las observaciones que formule la Comisión de Emergencia y Protección, aplicándose, mientras tanto, el plan de alcance superior.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Los planes de ámbito autonómico se aprobarán por decreto del Gobierno de las Illes Balears, previo informe del CEPIB y aprobación de la Comisión Nacional de Protección Civil, excepto aquellos que no estén regulados por la normativa básica estatal, que requerirán la aprobación del CEPIB.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Los acuerdos o decretos por los que se aprueban y modifican los planes especiales y territoriales de protección civil se publicarán en el Boletín Oficial de las Illes Balears.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Un ejemplar completo de cada plan aprobado estará a disposición de cualquier persona, para su consulta, en la sede del órgano aprobador, sin necesidad de acreditar interés determinado.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">8. Se enviará otra copia a la dirección general competente en materia de emergencias. 9.
