&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Por Resolución de la Presidencia del IMAS, de 15 de julio de 2024, se aprobaron las bases generales que han de regir los procesos selectivos para cubrir las plazas vacantes de personal funcionario de la Administración especial de la oferta de empleo público correspondiente al ejercicio 2024 del Consell de Mallorca y de las ofertas de empleo público correspondientes a los ejercicios 2021 y 2023 del IMAS, así como las ofertas de empleo público derivadas del Plan estratégico para la reducción de la temporalidad del IMAS aprobado por el Consejo Rector el día 15 de diciembre de 2023 (BOIB núm. 94, de 18 de julio de 2024), con las correcciones de errores y modificaciones (BOIB núm. 99, de 27 de julio de 2024 y BOIB núm. 105, de 10 de agosto de 2024). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Mediante la Resolución de la Presidencia del IMAS, de fecha 5 de noviembre de 2024, se aprobaron la convocatoria, las bases específicas y el temario del proceso selectivo por el sistema de concurso oposición, para cubrir las plazas vacantes de la Administración especial, subescala servicios especiales, clase personal de oficios/operario-operaria, especialidad Personal de Servicios, de la Agrupación Profesional, de la oferta de ocupación pública correspondiente a los ejercicios de 2021, 2023 y 2024 del IMAS (BOIB núm. 151, de 19 de noviembre de 2024). En fecha 20 de noviembre de 2024, dicha Resolución fue objeto de una rectificación de errores (BOIB núm. 155, de 28 de noviembre de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De acuerdo con la base 5 del Anexo I de las bases específicas de la convocatoria aprobada por la Resolución de la Presidencia del IMAS de fecha 5 de noviembre de 2024, el Tribunal debe estar constituido por tres miembros titulares, con el mismo nombre de suplentes, y el nombramiento debe publicarse en el Boletín Oficial de les Illes Balears y en la Sede Electrónica del IMAS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, la base 9 del Anexo I de las bases generales que deben regir los procesos selectivos para cubrir las plazas vacantes de personal funcionario de la Administración especial (BOIB núm. 94, de 18 de julio de 2024), determina el régimen aplicable a los tribunales calificadores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La constitución y las normas de funcionamiento y actuación de los tribunales se regulan en el Reglamento de ingreso del personal al servicio de la Comunidad Autónoma de las Illes Balears, aprobado por el Decreto 27/1994, de 11 de marzo, en todo aquello que no contradiga el artículo 8 b) del Decreto ley 6/2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De conformidad con el apartado 1 del artículo 13 del Decreto 27/1994, el nombramiento de los miembros de los tribunales debe publicarse en el Boletín Oficial de las Illes Balears, en la Sede Electrónica del Consell de Mallorca y en el tablón de edictos electrónico del IMAS, una vez finalizado el plazo de presentación de instancias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El artículo 7.2.13 de los Estatutos del IMAS, aprobados por el Pleno del Consell de Mallorca, de fecha 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019) que habilita a la Presidencia para convocar y resolver los procedimientos de selección, establecer las bases, los programas y el contenido de las pruebas y nombrar los miembros de los órganos de selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Designar el Tribunal Calificador del proceso selectivo de la oferta de empleo público del IMAS 2021, 2023 y 2024, para cubrir las plazas vacantes de personal funcionario de la escala de la Administración especial, subescala servicios especiales, clase personal de oficios/operario-operaria, especialidad Personal de Servicios, de la Agrupación Profesional, el cual estará constituido por los miembros que figuran en el Anexo I de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar esta Resolución en el Boletín Oficial de las Illes Balears, en la Sede Electrónica del Consell de Mallorca, en el tablón de edictos electrónico del IMAS y en el Portal de Selección del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Notificar esta resolución a las personas nombradas, haciéndoles saber que la condición de miembro del Tribunal Calificador y la correspondiente obligación de asistencia constituye un deber del personal funcionario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta resolución no agota la vía administrativa y contra la misma puede interponerse, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consell Executiu del Consell Insular de Mallorca, dentro del plazo de un mes, contado a partir del día siguiente al de su publicación en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa del recurso de alzada, podrá interponerse recurso contencioso-administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación de dicho recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación por silencio administrativo del recurso de alzada, podrá interponerse recurso contencioso-administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente al de la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, se puede ejercer, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, y con la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
