    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;La directora &lt;/span&gt;general del Tesoro&lt;span style="background-color: rgb(255, 255, 255)"&gt;, Política Financiera y Patrimonio ha formulado la propuesta de resolución siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1. En fecha 15 de mayo de 1995, el Ayuntamiento de Palma cedió el edificio del Casal Ernest Lluch a la Consejería de Salud, mediante la firma de un convenio por un periodo de noventa y nueve años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. En la cláusula quinta de este Convenio se autoriza expresamente a la Consejería de Salud a formalizar cesiones de uso gratuitas y temporales de determinadas partes del Casal a otras entidades y asociaciones sin ánimo de lucro y le encomienda el mantenimiento, el funcionamiento y la gestión de los servicios que se tengan que ubicar en el edificio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3. El artículo segundo de la Orden de la consejera de Salud y Consumo, de 10 de marzo de 2020, de modificación de la Orden del consejero de Salud, de 12 de junio de 2014, por la cual se aprueba el Reglamento de organización y funcionamiento del Casal Ernest Lluch, establece que el Casal es un edificio puesto al servicio de entidades sin ánimo de lucro siempre que sus fines, de acuerdo con los estatutos, sean sociales o culturales directamente relacionados con las competencias de la Consejería de Salud, para facilitar el ejercicio de sus funciones y tareas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. El número del activo en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears es el 100000002338 – 0, con referencia catastral 9905710DD6890F0001QH, inscrito en el Registro de la Propiedad núm. 3 de Palma (folio 103, tomo 78, libro 2419, inscripción núm. 2189).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;5. En fecha 2 de marzo de 2023, la Consejería de Hacienda y Relaciones Exteriores del Gobierno de las Illes Balears firmó una resolución por la cual se autorizaba la cesión gratuita y temporal de uso del despacho 208 del Casal Ernest Lluch, situado en la calle de la Rosa, 3, de Palma, a favor de la Asociación Ángeles de azul y verde (BOIB núm. 30, de fecha 09-03-2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;6. En fecha 4 de marzo de 2025, la Consejería de Salud notificó el inicio del procedimiento de pérdida de la condición de entidad usuaria residente del Casal Ernest Lluch a la asociación y se le otorgó un plazo de quince días para que alegara o aportara la documentación que estimase oportuna. Todo esto en cumplimiento del artículo 6.1 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; del Reglamento de organización y funcionamiento del Casal Ernest Lluch: «La pérdida de la condición de entidad usuaria se produce por las circunstancias siguientes: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; La no utilización o utilización esporádica de los despachos privativos durante los últimos seis meses sin justificación previa, salvo los meses de julio y agosto, o la no realización, por parte de la entidad, de actividades relacionadas con los fines que determinaron la cesión de uso. El mismo artículo especifica que se entiende por utilización esporádica la ocupación del despacho privativo durante solamente un 20 % o menos de los días del periodo computado y que se controlará mediante el listado del control de permanencia en el Casal.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;7. En fecha 29 de abril de 2025, transcurrido el plazo de alegaciones sin que la Asociación Ángeles de azul y verde aportara documentación o presentara alegaciones, la Consejería de Salud la requirió para firmar el acta de entrega y recepción a la Comunidad Autónoma de las Illes Balears del despacho 208 del Casal Ernest Lluch. Por correo electrónico se consensuó el 14 de mayo de 2025 como fecha para firmar el acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;8. En fecha 14 de mayo de 2025, no fue posible firmar el acta de entrega y recepción a la Comunidad Autónoma de las Illes Balears del despacho 208 del Casal Ernest Lluch, pero la señora Jennifer Isabel Correia Prata, vocal de atención al Policía y al Guardia Civil de la Asociación Ángeles de Azul y verde, entregó las llaves del despacho 208, y las generales del Casal, al personal del Casal. No fue posible buscar&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;otra fecha para que alguna persona representante de la asociación pudiera firmar el acta de entrega.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;9. En fecha 6 de junio de 2025, la secretaria general de la Consejería de Salud emitió un informe favorable sobre la revocación de la cesión gratuita y temporal de uso del despacho 208 del Casal Ernest Lluch a la Asociación Ángeles de azul y verde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;10. En fecha 12 de junio de 2025, tuvo entrada en la Dirección general del Tesoro, Política Financiera y Patrimonio (VALIB núm. identificador 397343) un oficio de la secretaria general de la Consejería de Salud, acompañado del informe y de la resolución en la que se insta al consejero de Economía, Hacienda e Innovación a iniciar el expediente de revocación de la cesión de uso del despacho 208 del Casal Ernest Lluch a favor de la Asociación Ángeles de azul y verde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;11. En fecha 23 de junio de 2025, la directora general del Tesoro, Política Financiera y Patrimonio dictó una resolución de inicio del expediente de que se trata.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1. Convenio de 15 de mayo de 1995 por el cual el Ayuntamiento de Palma cede el edificio del Casal Ernest Lluch, ubicado en la calle de la Rosa, 3, de Palma, y el espacio ubicado en la calle de Can Campaner, 4, de Palma, a la Consejería de Salud por un periodo de noventa y nueve años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Orden del consejero de Salud de 12 de junio de 2014 por la cual se aprueba el Reglamento de organización y funcionamiento del Casal Ernest Lluch (BOIB núm. 86, de 24 de junio de 2014), modificada por la Orden de la consejera de Salud, de 10 de marzo de 2020 (BOIB núm. 56, de 14 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3. &lt;/span&gt;Los artículos 63 y 64, en relación con los artículos 87.&lt;em&gt;g)&lt;/em&gt;, y 88.&lt;em&gt;f)&lt;/em&gt;, incluidos en la Ley 6/2001, de 11 &lt;span style="background-color: rgb(255, 255, 255)"&gt;de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. Los artículos 128, 129 y 130, por remisión del artículo 142, incluidos en el Decreto 127/2005, de 16 de diciembre, por el cual se aprueba el Reglamento de desarrollo de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;5. El Decreto 8/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 94, de 10 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;6. El Decreto 6/2025, de 2 de junio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 70, de 3 de junio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;7. El Decreto 56/2023, de 21 de julio, por el que se dispone el nombramiento de altos cargos de la Consejería de Economía, Hacienda e Innovación (BOIB núm. 103, de 22 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Propongo al consejero de Economía, Hacienda e Innovación que dicte resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1. Autorizar la revocación de la cesión de uso gratuita y temporal del despacho 208 del Casal Ernest Lluch ubicado en la calle de la Rosa, 3, de Palma, a favor de la Asociación Ángeles de azul y verde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Notificar esta Resolución a las partes interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3. Anotar las características de la revocación de la cesión de uso en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. Publicar esta Resolución en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo &lt;span style="background-color: rgb(255, 255, 255)"&gt;de reposición ante el consejero de Economía, Hacienda e Innovación en el plazo de un mes a contar desde el día siguiente de la publicación en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;el Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de la&lt;/span&gt;s administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos &lt;span style="background-color: rgb(255, 255, 255)"&gt;meses a contar desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;#xa0;&lt;/p&gt;
