37152 CAIB 702781 CAIB 2025-06-26 ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Se publica la resolución del consejero</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según el acuerdo de 28 de septiembre de 2022, BOIB nº. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“Antecedentes</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Mediante la Resolución del consejero ejecutivo de Hacienda y Función Pública, de 27 de octubre de 2022 (Boletín Oficial de las Islas Baleares nº. 140, de 29 de octubre de 2022), rectificada y modificada por las Resoluciones de día 28 de noviembre de 2022, 14 de diciembre de 2022 y 24 de enero de 2023, se aprobó la convocatoria del proceso selectivo de estabilización para el sistema excepcional de concurso de méritos para cubrir las plazas de personal funcionario de las escalas, subescalas, clases y categorías (o especialidades) de administración general y especial de los subgrupos A1, A2 y grupo B derivada de la oferta de empleo pública extraordinaria del Consejo Insular de Mallorca y de la Agencia de Defensa del Territorio para el año 2022 y acumuladas de 2017 y de 2019.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En esta resolución se convocaron, entre otras, 6 plazas de la categoría Delineante, correspondientes al grupo B de administración especial.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Por acuerdo del tribunal calificador competente de este proceso selectivo de estabilización, una vez concluida la revisión y baremación de méritos de los aspirantes, en fecha 4 de marzo de 2024 se publicó en el tablón electrónico de anuncios y en la Sede electrónica del Consejo Insular de Mallorca la lista definitiva de personas aspirantes que superaron el proceso selectivo por<span style="color:green"><span style="display:none">&lt;A[para|por]&gt;</span></span> el sistema excepcional de concurso de méritos del proceso de estabilización, clase técnico medio del grupo B y ofrecimiento de lugares<span style="color:green"><span style="display:none">&lt;A[lugares|sitios]&gt;</span></span> del Consejo insular de Mallorca y de la Agencia de Defensa del Territorio. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. De conformidad con el punto 8 de las bases específicas de la convocatoria, una vez asignado los puestos de trabajo ofrecidos, el tribunal tiene que elevar al consejero<span style="color:green"><span style="display:none">&lt;A[consejero|conseller]&gt;</span></span> ejecutivo de Hacienda y Función Pública la propuesta de personas aspirantes que han superado el proceso selectivo de concurso de méritos para el ingreso como personal funcionario, con la asignación de puestos de trabajo<span style="color:green"><span style="display:none">&lt;A[lugares|sitios]&gt;</span></span><span style="color:navy">. </span>Esta lista tiene que contener, como máximo, tantas personas aprobadas como el número de plazas convocadas. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En fecha 27 de junio de 2024, se publica en el BOIB nº. 85 mediante la cual se nombran funcionarios de carrera y se adjudican los puestos de trabajo correspondientes al proceso selectivo para<span style="color:green"><span style="display:none">&lt;A[para|por]&gt;</span></span> el sistema excepcional de concurso de méritos del proceso de estabilización de personal funcionario de la escala de administración especial, subescala <span style="color:green"><span style="display:none">&lt;A[escalera|escala]&gt;, su</span></span> técnica, clase técnico medio del grupo B del Consejo insular de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El apartado 8.8.2 de las bases específicas de la convocatoria establece que “...Para garantizar la cobertura real del todos los puestos<span style="color:green"><span style="display:none">&lt;A[lugares|sitios]&gt;</span></span> ofrecidos por <span style="color:green"><span style="display:none">&lt;A[para|por]&gt;</span></span>el Consejo insular de Mallorca y el IMAS se ofrecerán el puesto o los puestos <span style="color:green"><span style="display:none">&lt;A[lugar|sitio]&gt;</span></span> vacantes al siguiente aspirante disponible según el orden de prelación definitivo del proceso donde se produzca la vacante, según la preferencia de elección de puestos<span style="color:green"><span style="display:none">&lt;A[lugares|sitios]&gt;</span></span> y el orden de puntuación establecido a la orden de prelación definitivo, tanto si está vacante se produce por renuncia como si se produce por opción o por otros motivos.”</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. En fecha 14 de marzo de 2025, mediante Acuerdo de la Comisión de Gobierno, se estima<span style="color:green"><span style="display:none">&lt;A[estima|ama]&gt;</span></span> el recurso de alzada interpuesto por el señor Bartolomé Bosch Morata contra la Resolución del consejero<span style="color:green"><span style="display:none">&lt;A[consejero|conseller]&gt;</span></span> ejecutivo de Hacienda y Función pública de 20 de junio de 2024 (BOIB Nº. 85, 27 de junio de 2024) que se modifica únicamente con respecto al nombramiento del Sr. Bartolomé Bosch Morata y las adjudicaciones de puestos de trabajo del Consejo Insular de Mallorca para la categoría de Delineante-a y que a su parte dispositiva aprueba la lista definitiva de personas aspirantes que han superado el proceso de estabilización para el sistema de concurso excepcional para el ingreso como personal funcionario en la escala de administración especial<span style="color:green"><span style="display:none">&lt;A[para|por]&gt;</span></span>, subescala<span style="display:none">&lt;A[subescalera|subescala]&gt;</span> Técnica, clase técnica media de administración especial, grupo B, categoría delineante del Consejo insular de Mallorca, de tal manera que al Sr. Bartolomé Bosch Morata se le adjudica el lugar<span style="color:green"><span style="display:none">&lt;A[lugar|sitio]&gt;</span></span> con código F00120037-1, a la Sra. María Nieves Jiménez Ribas el lugar<span style="display:none">&lt;A[lugar|sitio]&gt;</span> con código F00120062-1 y la Sra. Josefa Gómez Gómez figura nombrada y pendiente de adscribir a un puesto de trabajo del Consejo Insular de Mallorca. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El servicio de Recursos Humanos del Consejo Insular de Mallorca, con número de registro de salida 39792/2025 de fecha 13 de junio de 2025, informa al EMAP y a la Presidenta del Tribunal Calificador que el Acuerdo de la Comisión de Gobierno de fecha 13 de marzo de 2025 que resuelve el recurso de alzada afecta únicamente a las plazas y nombramientos llevados a cabo en relación con el Consejo Insular de Mallorca y que no afecta por lo tanto en las 4 plazas ofertadas por el ADT, por lo tanto, según su criterio. Se tienen que proponer para su nombramiento en ADT lo mismo número de aspirantes que plazas ofertadas por el ADTM, es decir, 4 plazas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. En fecha 23 de junio de 2025 el Tribunal Calificador competente del procedimiento selectivo ha acordado elevar al consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> de Hacienda y Función pública la propuesta de adjudicación de las personas aspirantes para ser nombradas personal funcionario de carrera y por haber superado el proceso selectivo de estabilización para<span style="display:none">&lt;A[para|por]&gt;</span> el sistema de concurso excepcional establecido en las bases específicas de la convocatoria de 27 de octubre de 2022, de acuerdo con la orden de puntuación de la lista definitiva, y comprobados los requisitos específicos para la adscripción a los puestos de trabajo, una vez que los servicios del EMAP han comprobado que se cumplen los requisitos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La base 8.6 del Anexo II Bases Específicas de la Resolución del consejero ejecutivo de Hacienda y Función Pública, de 27 de octubre de 2022, por la cual se aprueba la convocatoria del proceso selectivo de estabilización para el sistema excepcional de concurso de méritos para cubrir las plazas de personal funcionario de las escalas, subescalas, clases y categorías (o especialidades) de administración general y especial de los subgrupos A1, A2 y grupo B derivada de la oferta de empleo pública extraordinaria del Consejo Insular de Mallorca y de la Agencia de Defensa del Territorio para el año 2022 y acumuladas de 2017 y de 2019 (BOIB nº. 140, de 29 de octubre de 2022).<span style="display:block; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo eso, dicto la siguiente</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓN</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la lista definitiva a las personas aspirantes que han superado el proceso selectivo de estabilización para<span style="display:none">&lt;A[para|por]&gt;</span> el sistema de concurso excepcional para el ingreso como personal funcionario en la escala<span style="display:none">&lt;A[escalera|escala]&gt;</span> de administración especial, subescala<span style="display:none">&lt;A[subescalera|subescala]&gt;</span> técnica, clase técnico medio categoría Delineante grupo B de la Agencia de Defensa del Territorio, de acuerdo con lo que se indica al anexo 1 de este documento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como el número de plazas convocadas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Informar en la Agencia de Defensa del Territorio de la adjudicación y adscripción definitiva de los puestos de trabajo a las personas aspirantes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ordenar la publicación de esta Resolución y su anexo I en el tablón<span style="display:none">&lt;A[tablero|tablón]&gt;</span> de edictos y en la Sede electrónica del Consejo de Mallorca, y en el Boletín Oficial de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“Contra este acto, que no pone fin a la vía administrativa, podéis interponer el recurso de alzada en el plazo de un mes, contador a partir del día siguiente de recibir esta notificación. El recurso se puede interponer formalmente ante el Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación expresa de este recurso de alzada, podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&nbsp;</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si han transcurrido tres meses desde la interposición del recurso de alzada y no habéis recibido la notificación de resolución expresa, se entiende desestimado por silencio y podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante el anterior, podéis interponer, si procede, cualquier otro recurso que consideráis oportuno.
