![CDATA[Resolución del consejero de Educación y Universidades por la que se establece el procedimiento para que los centros concertados de primer ciclo de educación infantil soliciten la autorización en relación con los servicios escolares complementarios que ofrecen]]
![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El artículo 7 de la Ley 1/2022, de 8 de marzo de las Illes Balears, establece que el objetivo de la regulación del primer ciclo de educación infantil es universalizar este ciclo, hacerlo gratuito progresivamente y garantizar una educación equitativa y de calidad.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El artículo 51 de la Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (LODE), establece para el régimen de conciertos y con carácter general, lo siguiente:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Artículo cincuenta y uno</span></strong></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. El régimen de conciertos que se establece en el presente Título implica, por parte de los titulares de los centros, la obligación de impartir gratuitamente las enseñanzas objeto de dichos conciertos.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">2. En los centros concertados, las actividades escolares complementarias, las extraescolares y los servicios escolares no podrán tener carácter lucrativo. El cobro de cualquier cantidad a los alumnos en concepto de actividades escolares complementarias deberá ser autorizado por la Administración educativa correspondiente.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3. En los centros concertados, las actividades extraescolares, así como las correspondientes cuotas que hayan de aportar los usuarios, deberán ser aprobadas por el Consejo Escolar del centro y comunicadas a la Administración educativa correspondiente. Estas actividades no podrán formar parte del horario escolar del centro. Las Administraciones educativas establecerán el procedimiento de aprobación de los servicios escolares que presten los centros y de sus correspondientes cuotas.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El cobro de ambos tipos de actividades podrá contribuir al mantenimiento y mejora de las instalaciones</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">4. Las Administraciones educativas regularán las actividades escolares complementarias, extraescolares y los servicios escolares de los centros concertados, que en todo caso tendrán carácter voluntario.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El artículo 7 del Decreto ley 5/2023, de 28 de agosto, de medidas urgentes en el ámbito educativo y en el sanitario, determina lo siguiente:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Artículo 7. </span></strong></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Conciertos educativos de primer ciclo de educación infantil.</span></strong></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. La financiación de las aulas de primer ciclo de educación infantil de los centros privados que prestan un servicio público de educación se podrá instrumentalizar a través del concierto educativo.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">2. El establecimiento de los conciertos de primer ciclo de educación infantil deberán regirse por este Decreto y por las correspondientes resoluciones de convocatoria para el establecimiento y la renovación de conciertos educativos que se dicten al efecto, así como por el resto de normativa de aplicación.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3. Los conciertos educativos subscritos al amparo de este artículo se formalizarán en documento administrativo en el que se harán constar los derechos y obligaciones reciprocas, y, el resto de circunstancias derivadas de la normativa de aplicación. </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">4. El concierto debe establecer la gratuidad del servicio educativo del primer ciclo de educación infantil por un mínimo de cuatro horas.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">[...]</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">9. El establecimiento de percepciones para la prestación de los servicios complementarios que ofrezcan los centros educativos que suscriban conciertos educativos de primer ciclo de educación infantil requiere la autorización de la Consejería de Educación y Universidades.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">A tal efecto, se consideran servicios complementarios el comedor, el transporte escolar, el gabinete médico o psicopedagógico y cualquier otro de naturaleza análoga, así como las horas de orientación a los niños no financiadas por el concierto educativo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Los centros concertados de primer de educación infantil han suscrito los correspondientes conciertos educativos, la cláusula 2 sobre compromisos de la Consejería de Educación y Universidades y del titular del centro establece en el apartado 3 lo siguiente: </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. El titular del centro se obliga a impartir las enseñanzas objeto de este Concierto singular tal como se indica a continuación:</span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Dentro del horario del primer ciclo de educación infantil, dar el servicio de escolarización básica de un mínimo de cuatro horas, sin incluir las comidas, con carácter gratuito. Se tiene que hacer constar así en todas las publicaciones e informaciones a las familias. Este horario de escolarización básica debe tener lugar entre las 8 h y las 14 h de los días laborables, desde el mes de septiembre hasta el mes de junio. En caso de que por causas justificadas el titular del centro quiera establecer la escolarización básica en un horario diferente, tendrá que contar con el informe favorable de la Consejería de Educación y Universidades.</span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Los centros no pueden percibir de las familias aportaciones económicas asociadas a la actividad objeto de concierto ni establecer la obligatoriedad de hacer ingresos para fundaciones o asociaciones ni otros servicios que puedan contravenir el principio de gratuidad y no estén autorizados, si corresponde, por la Consejería de Educación y Universidades.</span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) El establecimiento de percepciones por la prestación de los servicios complementarios que ofrezcan los centros educativos que subscriban conciertos educativos de primer ciclo de educación infantil serán voluntarias, no tendrán carácter discriminatorio para los alumnos, no podrán formar parte del horario de escolarización básica, no tendrán carácter lucrativo y requieren la autorización de la Consejería de Educación y Universidades de acuerdo con el establecido en el artículo 51 de la LO 8/1985 y los artículos 15 y 56 del Real Decreto 2377/1985.</span><span style="font-family:Times New Roman,Times,serif; font-size:12px"> </span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A tal efecto, se consideran servicios complementarios el comedor, el transporte escolar, el gabinete médico o psicopedagógico y cualquier otro de naturaleza análoga, así como las horas de atención a los niños no financiadas por el concierto educativo.</span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Impartir los enseñanza de acuerdo con los currículums vigentes y con los reglamentos de la Consejería de Educación y Universidades aplicables en la Comunidad autónoma de las Islas Baleares. </span><span style="font-family:Times New Roman,Times,serif; font-size:12px"> </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los artículos 61 y 62 de la LODE regulan la Comisión de conciliación y los incumplimientos del concierto educativo.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En definitiva, es necesario establecer el procedimiento para que los centros privados concertados de primer ciclo de educación infantil soliciten la autorización en relación con los servicios escolares complementarios que ofrecen.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Por otro lado, dado que es la primera vez que se establece este procedimiento resulta necesario determinar los importes máximos de las cuotas de los diferentes servicios escolares complementarios que los centros concertados de primer ciclo de educación infantil ofrecen. Estos importes se fijan para el curso 2025-2026 tomando como referencia los que cada centro concertado percibió de las familias el curso 2024-2025, incrementado en un 2,5%, correspondiendo al Índice de Precios al Consumo de enseñanza de mayo 2024 a mayo 2025. No obstante esto, para el caso que con esta referencia determinados importes superaran el anterior, se establecen unos importes máximos que se consideran razonables partiendo de la media de los importes percibidos, en función de las diferentes islas, por los centros concertados por cada servicio escolar complementario, incrementado en un 10%.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La competencia para dictar esta Resolución corresponde al consejero de Educación y Universidades, de acuerdo con el que establece el artículo 10.1.y) y 20.2 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y de acuerdo con el Decreto 6/2025, de 2 de junio, de la presidenta de las Illes Balears, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Por todo el anterior, dicto la siguiente:</span></span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>R<span style="color:black">esolución</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. Establecer el procedimiento para que los centros concertados de primer ciclo de educación infantil soliciten la autorización en relación con los servicios escolares complementarios que ofrecen, que figura como anexo 1 de esta Resolución.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Aprobar el anexo 2, que contiene el modelo de solicitud de autorización de servicios escolares complementarios y de las cuotas correspondientes.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Aprobar el anexo 3, que contiene el modelo de certificación del acuerdo del Consejo Escolar sobre los servicios escolares complementarios.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. Aprobar el anexo 4, que contiene el modelo de memoria económica justificativa de los servicios escolares complementarios.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. Aprobar el anexo 5, que contiene el modelo de comunicación y prórroga de la autorización de cuotas de los servicios escolares complementarios para los cursos escolares posteriores.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">6. Publicar esta Resolución en el Boletín Oficial de las <span style="color:black">Illes Balears</span>.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">7. Notificar esta Resolución a los centros concertados de primer ciclo de educación infantil mediante la aplicación para la gestión educativa de las Illes Balears.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Interposición de recursos</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Universidades en el plazo de un mes, contador desde el día siguiente a la publicación de esta Resolución, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y con el artículo 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las <span style="color:black">Illes Balears</span>.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">También se puede interponer directamente un recurso contencioso-administrativo ante el Juzgado de lo contencioso-Administrativo de Palma en el plazo de dos meses, a contar desde el día siguiente a la publicación de esta Resolución, de acuerdo con los artículos 8 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) El gabinete médico o psicopedagógico y cualquier otro de naturaleza análoga</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Las horas de atención a los niños no financiadas por el concierto educativo</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Los servicios escolares complementarios deben tener carácter voluntario para las familias y deben ser autorizados por la Dirección General de Personal Docente y Centros Concertados.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Los centros concertados pueden percibir cuotas por la prestación de estos servicios, que deben ser autorizadas por la Dirección General de Personal Docente y Centros Concertados.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. No obstante lo anterior, la prestación del servicio no puede tener carácter lucrativo, lo cual implica:</span></span><span style="line-height:115%"><span style="line-height:115%"> <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Que las cuotas que perciba el centro por la prestación de los servicios no pueden ser superior al coste soportado por el centro para su prestación.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Que, en caso de que las cuotas sean superiores al coste soportado, la diferencia puede contribuir al mantenimiento y mejora de las instalaciones del centro educativo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Para el cálculo del coste soportado del servicio a efectos de la consideración del precio como no lucrativo, la memoria económica justificativa puede imputar los costes directos del servicio más un porcentaje de costes indirectos. Este porcentaje tiene que respetar los principios y normas de contabilidad y, en todo caso, tiene que corresponder al periodo en que efectivamente se realiza la actividad.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Tercero</span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Información a las familias</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los centros tienen que exponer públicamente el listado de servicios escolares complementarios que ofrecen, con los precios autorizados por la Administración educativa, y con indicación expresa de su carácter voluntario. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Mientras el centro no tenga la autorización de la Administración puede cobrar, por anticipado, las cuotas solicitadas a las familias. En el supuesto de que las cantidades que apruebe la Administración sean inferiores a las que el centro haya percibido, el titular del centro tiene que devolver los importes cobrados de más, pudiendo descontarlos de los recibos posteriores, y sin perjuicio de la responsabilidad en la que hubiera podido incurrir.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Cuarto </span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Solicitud de autorización de cuotas por los servicios escolares complementarios</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El titular o el representante del centro tiene que presentar la solicitud al Registro de la Consejería de Educación y Universidades o a cualquier de los lugares que determina el artículo 37.1 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La solicitud se tiene que ajustar al modelo normalizado que figura como anexo 2 de la Resolución y tiene que ir acompañado de la documentación siguiente:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Certificación del Acuerdo del Consejo Escolar sobre los servicios escolares complementarios (anexo 3) para aquellos centros que tengan Consejo Escolar.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Memoria económica justificativa de los servicios escolares complementarios donde quede constancia del coste de la prestación del servicio, con indicación del importe de la cuota que se cobra a las familias (anexo 4).</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. Corresponde al director general de Personal Docente y Centros Concertados autorizar los servicios escolares complementarios y las correspondientes cuotas, mediante resolución. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. El plazo máximo para resolver es de tres meses. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Si transcurrido este plazo la Administración no ha notificado resolución expresa, el solicitante puede entender estimada su solicitud y, en consecuencia, autorizados los servicios escolares complementarios y las correspondientes cuotas. </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. La autorización de los servicios y de las cuotas tiene que estar referida a un curso escolar.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">5. Las resoluciones que no autoricen un servicio escolar complementario y/o una cuota tienen que ser motivadas.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Noveno</span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="line-height:115%"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Comunicación y prórroga de la autorización</span></strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. En caso de que, para los cursos escolares posteriores a aquel en que se haya autorizado el servicio escolar complementario y la correspondiente cuota, el centro mantenga el servicio escolar y la cuota autorizada es suficiente comunicar esta circunstancia a la Dirección General de Personal Docente y Centros Concertados, mediante el modelo de comunicación que figura como anexo 5 y el trámite telemático habilitado al efecto.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En caso de que el importe de la cuota autorizada se incremente, como máximo, en el porcentaje que fije, para cada curso escolar, el consejero de Educación y Universidades mediante resolución es suficiente presentar la comunicación a que hace referencia el punto anterior.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Una vez comprobado que la comunicación se ajusta a lo que disponen los puntos anteriores, el director general de Personal Docente y Centros Concertados dictará una resolución por la cual se prorrogará, por un curso escolar, la autorización concedida.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Décimo</span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Incumplimiento</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Es causa de incumplimiento leve del concierto por parte del titular del centro percibir cantidades por servicios complementarios escolares que no hayan sido autorizados por la Administración educativa (arte. 62.1.a) LODE).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Es causa de incumplimiento grave del concierto educativo por parte del titular cuando resulte que el incumplimiento se produzca con ánimo de lucro, con intencionalidad evidente, con perturbación manifiesta en la prestación del servicio de la enseñanza o de forma reiterada o reincidente (arte. 62.2.a) LODE).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Es causa de incumplimiento muy grave del concierto educativo la reiteración o reincidencia de los incumplimientos graves (arte. 62.2.bis LODE).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. El incumplimiento del concierto educativo dará lugar a la constitución de la Comisión de Conciliación y, si se tercia, a la aplicación de las sanciones que prevé el artículo 62.4 de la LODE.</span></span></span></p>
