Mediante Resolución del consejero de Modelo Económico, Turismo y Trabajo, y presidente de Servicio de Ocupación de las Illes Balears (SOIB), de 19 de septiembre de 2022 (BOIB núm. 125, de 24 de septiembre), se aprueba la convocatoria de becas formativas dirigida a personas desempleadas mayores de 30 años, que estén matriculadas en los cursos de segundo, tercero y cuarto de educación secundaria de personas adultas (ESPA) o en ciclos de formación profesional presencial de grado medio o de grado superior sostenidos con fondos públicos de la CAIB, para el periodo 2024-2025.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En fecha 20 de mayo de 2025 el consejero de Empresa, Ocupación y Energía y presidente del SOIB dictó Resolución por la cual se autoriza y dispone el gasto, se reconoce la obligación y se propone el pago de la&nbsp; concesión, y denegación de becas de la convocatoria de becas formativas dirigida a personas desempleadas mayores de 30 años, que estén matriculadas en los cursos de segundo, tercero y/o cuarto de educación secundaria de persones adultas (ESPA) durante el primer cuatrimestre de octubre de 2024 a febrero de 2025</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Desde el Servicio de Formación para la Ocupación 2 se han detectado una serie de errores en la citada Resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece que “las administraciones públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos».</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- El artículo&nbsp; 56.1 de la Ley&nbsp; 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears establece que “la rectificación de los errores materiales y de hecho en actos y disposiciones administrativas corresponde al órgano que haya dictado el acto o disposición.”</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía y presidente del SOIB en el plazo de un mes contado desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
