Las explotaciones dedicadas a la producción vegetal tienen que luchar contra los agentes nocivos en sus explotaciones. Las condiciones de la agricultura de Menorca, en cuanto a climatología, intensidad y variedad de cultivos, hacen que la problemática de la sanidad vegetal revista una complejidad especial. La reducida estructura de las fincas hace recomendable su asociación en agrupaciones de defensa vegetal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las agrupaciones de defensa vegetal (ADV) son la figura adoptada en España a través de la Ley 43/2002, de 20 de noviembre, de sanidad vegetal, para que la lucha contra las plagas se haga de manera eficiente y, sobre todo, de manera considerada con la salud de las personas y los animales y sean compatibles con el desarrollo de una agricultura sostenible y respetuosa con el medio ambiente, para cumplir con lo establecido en el artículo 55 del Reglamento (CE) núm. 1107/2009, del Parlamento Europeo y del Consejo, de 21 de octubre de 2009.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decreto 52/2013, de 29 de noviembre, regula las agrupaciones de defensa vegetal y crea el Registro Oficial de Agrupaciones de Defensa Vegetal en el ámbito de las Illes Balears. El Pleno del Consejo Insular de Menorca, en sesión de carácter ordinario de 17 de noviembre de 2014, aprobó la creación del Registro Insular de Agrupaciones de Defensa Vegetal de Menorca, regido por lo que establece el Decreto 52/2013, de 29 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas ayudas estarán sometidas a lo que disponen los artículos 22 y 26 del Reglamento (UE) 2022/2472, de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles con el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea. En concreto, el artículo 22 regula las ayudas destinadas a servicios de asesoramiento vinculados a objetivos específicos, entre los cuales se incluye el asesoramiento relativo en el cumplimiento del Reglamento (UE) 2016/2031, sobre medidas de protección contra las plagas vegetales, mientras que el artículo 26 establece las condiciones para la concesión de ayudas destinadas a cubrir los gastos derivados de la prevención, el control y la erradicación de enfermedades o plagas vegetales, así como las destinadas a reparar los daños ocasionados por estas plagas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Plan Estratégico de Subvenciones (PES) para el ejercicio 2025, aprobado por el CEX reunido en sesión de carácter extraordinario de 22 de noviembre de 2024 (BOIB núm. 161 de 12 de diciembre de 2024), establece la previsión de la actividad subvencionadora en la línea de fomento de actividades de interés general, dentro del marco normativo establecido para la concesión de subvenciones. Una de las líneas de subvención incluidas en este PES es una ayuda para el fomento de las asociaciones de defensa vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de estas ayudas para el fomento de las asociaciones de defensa vegetal de Menorca es apoyar a las actuaciones llevadas a cabo desde el 1 de enero al 31 de diciembre de 2025 por las ADV constituidas de acuerdo con el Decreto 52/2013, de 29 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El interés público de esta convocatoria rae en el apoyo a las ADV para la actividad que desarrollan, la cual, en coordinación con las actuaciones llevadas a cabo por la Administración en materia de sanidad vegetal, contribuye a reforzar la eficacia de las medidas de prevención y lucha contra los agentes nocivos de los vegetales, mediante una utilización racional de las técnicas de aplicación, de los productos y de los medios fitosanitarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 6.5 e del Reglamento (UE) 2022/2472, no es necesario que estas ayudas tengan un efecto incentivador cuando se cumplen las condiciones establecidas en el artículo 26 del mismo reglamento. Por lo tanto, las ADV pueden solicitar las ayudas para la ejecución de programas de control o erradicación de plagas vegetales con posterioridad a la realización de las actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El artículo 2.2 de la Ley 8/1999, de 12 de abril, de atribución de competencias a los consejos insulares de Menorca y de Ibiza y Formentera en materia de agricultura, ganadería, pesca y artesanía, dice que son funciones de los consejos insulares de Menorca y Formentera desarrollar en su ámbito territorial, entre otros, las actuaciones en materia de agricultura y ganadería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 30 de la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de autonomía de las Illes Balears, explica que son competencias propias de los consejos insulares, entre otros, la agricultura, ganadería y pesca; así como la calidad, la trazabilidad y las condiciones de los productos agrícolas y ganaderos y de los productos alimentarios que se deriven.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Departamento de Economía y Servicios Generales del Consejo Insular de Menorca manifiesta la voluntad de colaborar activamente con las ADV legalmente constituidas en la isla, en cuanto que entidades colectivas de referencia en la prevención, vigilancia y control de plagas, enfermedades y malas hierbas que afectan los cultivos. Estas agrupaciones han acontecido aliadas estratégicas para el sector agrario menorquín y contribuyen de manera significativa al cumplimiento efectivo de la normativa vigente en materia de sanidad vegetal, a la protección del medio ambiente y a la sostenibilidad del modelo productivo insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dada la propuesta de la consejera ejecutiva del Departamento de Economía y Servicios Generales;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo, por unanimidad de los seis miembros presentes (señor Vilafranca Florit, señora Reynés Calvache, señor Gornés Hachero, señora Taltavull Fernández, señor Pons Torres y señor Delgado Díaz) y en votación ordinaria, adopta el siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar las bases que rigen la concesión de las ayudas del Consejo Insular de Menorca para las agrupaciones de defensa vegetal de Menorca (ADV) correspondientes al periodo comprendido entre el 1 de enero de 2025 y el 31 de diciembre de 2025 y que se transcriben a continuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar, simultáneamente, la convocatoria de las ayudas correspondiente al año 2025, que se rigen por las bases mencionadas anteriormente y de acuerdo con las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Importe global máximo de las ayudas y crédito presupuestario: las ayudas concedidas se tienen que atender con cargo a las partidas presupuestarias y con los importes máximos que se indican más abajo, sin perjuicio de que los importes puedan ser ampliados por aportaciones expresas de terceros para contribuir a la financiación del objeto de la convocatoria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) La instrucción corresponde a la señora Isabel Martín Neira, técnica del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Plan Estratégico de Subvenciones (PES) para el ejercicio 2025, aprobado por el CEX reunido en sesión de carácter extraordinario de 22 de noviembre de 2024 (BOIB núm. 161 de 12 de diciembre de 2024), establece la previsión de la actividad subvencionadora en la línea de fomento de actividades de interés general, dentro del marco normativo establecido para la concesión de subvenciones. Una de las líneas de subvención incluidas en este PES es una ayuda para el fomento de las asociaciones de defensa vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El objeto de estas ayudas es compensar el coste de las actuaciones de las agrupaciones de defensa vegetal de Menorca (ADV) constituidas de acuerdo con el Decreto 52/2013, de 29 de noviembre, que regula las agrupaciones de defensa vegetal en el ámbito de las Illes Balears y crea el Registro Oficial de Agrupaciones de Defensa Vegetal de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas se tienen que conceder de acuerdo con el Reglamento (CE) núm. 2472/2022, de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea. También se tiene en cuenta la Ley 43/2002, de 20 de noviembre, de sanidad vegetal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El periodo subvencionable de las actividades ejecutadas es del día 1 de enero al 31 de diciembre del año de la convocatoria, de acuerdo con lo que establece el artículo 6.5 e del Reglamento UE núm. 2472/2022, que dice que cuando se cumplan las condiciones establecidas en el artículo 26 del mismo reglamento no será necesario que estas ayudas tengan un efecto incentivador. Por lo tanto, las ayudas a las ADV se pueden solicitar después de ejecutar las actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En cumplimiento del artículo 11.1 del Reglamento (CE) núm. 2022/2472, se transmitirá a la Comisión Europea la información resumida relativa a esta ayuda dentro en el plazo de veinte días hábiles a partir de la entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Finalidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria tiene por finalidad la prevención y la lucha contra las plagas y enfermedades vegetales e infestación por especies exóticas invasoras para las cuales haya normas nacionales o de la Unión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Financiamiento e importe máximo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas que se otorguen en el marco de estas bases se tienen que pagar con cargo a las partidas y por el importe máximo que se establezcan en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Actividades subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La actuación subvencionable es el asesoramiento y las medidas de prevención de los daños causados por las plagas vegetales que hace la ADV para sus socios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las actuaciones hechas por las ADV recibirán ayuda si se cumplen las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Las plagas y las enfermedades vegetales e infestación por especies exóticas invasoras para las cuales hay normas nacionales o de la Unión, tanto si están establecidas por ley, reglamento o acción administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Estas normas de la Unión y nacionales se refieren a uno de los aspectos siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Un programa o plan público a escala de la Unión, nacional o regional para la preservación, el control o la erradicación de la plaga vegetal de que se trate.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;ii) Medidas de emergencia impuestas por la autoridad competente del estado miembro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;iii) Medidas para erradicar o contener una plaga vegetal aplicadas de acuerdo con los artículos 17 y 18; el artículo 28, apartados 1 y 2; el artículo 29, apartado 1 y 2; el artículo 30, apartado 1, y el artículo 33, apartado 1 del Reglamento (UE) núm. 2016/2031.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;iv) Medidas para erradicar o contener una especie exótica invasora aplicadas de acuerdo con el Reglamento (UE) núm. 1143/2014.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Se consideran actuaciones subvencionables, en el marco de esta convocatoria, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Los costes derivados de la contratación del personal técnico por parte de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Los gastos asociados a la contratación de servicios de dirección técnica y/o de asistencia técnica necesarios para el desarrollo de las funciones propias de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Los gastos corrientes indispensables para ejecutar la actividad definida en la base 1 de estas bases reguladoras. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Los gastos vinculados a la formación del personal técnico de la ADV, siempre que esta formación sea imprescindible para la realización de los controles, las tareas de vigilancia y las medidas de detección de plagas vegetales. Esta actuación está condicionada al informe favorable del técnico del Consejo Insular de Menorca competente en materia de sanidad vegetal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Los gastos ocasionados por los desplazamientos del personal técnico en el marco de la actividad objeto de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) La adquisición de material destinado a la prevención y a la lucha biológica contra las plagas objeto de actuación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) La adquisición de material y equipación de laboratorio estrictamente relacionado con las finalidades de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Pueden ser subvencionadas las actuaciones ejecutadas y pagadas entre el 1 de enero y el 31 de diciembre del año de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Cuando el importe del gasto subvencionable supere la cuantía de 15.000 euros en caso de suministro de bienes de equipación o prestación de servicios por empresas de consultoría o asistencia técnica, el beneficiario tiene que solicitar como mínimo tres ofertas de proveedores diferentes, con carácter previo a la contratación del compromiso para la prestación del servicio, o la entrega del bien, excepto cuando, por las características especiales de los gastos subvencionables, no haya en el mercado suficiente entidades que lo suministren u ofrezcan, o cuando el gasto se haya realizado antes de la solicitud de subvención, cuando así se haya establecido. La elección entre las ofertas presentadas, que se tienen que aportar como justificación, si procede, a la solicitud de la subvención, se tiene que hacer de acuerdo con los criterios de eficiencia y economía, y se tiene que justificar expresamente la elección en una memoria que no recaiga en la propuesta económica no ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El IVA no se puede subvencionar, salvo de cuando no sea recuperable para el beneficiario (artículo 4.3 RD 81/2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Naturaleza de la ayuda y compatibilidad con otras ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las subvenciones que se rigen por estas bases son de carácter voluntario y eventual y se pueden anular, revocar y reintegrar en cada momento por las causas previstas en la ley o en estas bases; no generan ningún derecho a la obtención de otras subvenciones en años posteriores y no se pueden alegar como precedente. Así mismo, son compatibles con otras ayudas, subvenciones e ingresos o recursos que pueda recibir la entidad beneficiaria para llevar a cabo el mismo proyecto, sin perjuicio de la obligación de los beneficiarios de comunicarlo al Consejo Insular de Menorca de la manera establecida en estas bases, siempre que el cómputo anual no supere el presupuesto de ejecución del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El importe de la ayuda en ningún caso puede superar —aisladamente o en concurrencia con otras subvenciones o ayudas de otras administraciones públicas o entes públicos o privados, nacionales o internacional— el coste total de la actividad objeto de subvención, ni los límites establecidos en el artículo 26.15 del Reglamento (CE) núm. 2472/2022, de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El hecho de recibir una subvención implica la obligatoriedad de llevar a cabo el proyecto subvencionado y, por lo tanto, la entidad beneficiaria tiene que buscar otros fondos de financiación o aportar fondos propios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisitos de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Pueden tener la consideración de beneficiarios directos y pedir las ayudas que prevén estas bases las ADV integradas por productores que cumplan los requisitos del punto 2 de esta base y que, antes de que venza el plazo de presentación de solicitudes, cumplan los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que estén constituidas de acuerdo con el Decreto 52/2013, de 29 de noviembre, por el cual se regulan las ADV en el ámbito de las Illes Balears y crea el Registro Oficial de Agrupaciones de Defensa Vegetal de las Illes Balears, y que estén inscritas en el Registro Insular de Agrupaciones de Defensa Vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Que dispongan, antes de que se dicte la propuesta de resolución, de un programa o un plan para la prevención, el control o la erradicación de plagas vegetales que haya obtenido informe favorable del técnico del CIM responsable en materia de sanidad vegetal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Que estén al corriente de las obligaciones tributarias, con la Seguridad Social y el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Que no estén sujetas a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incompatible con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las explotaciones agrarias integradas en una agrupación de defensa vegetal de Menorca, en las cuales se llevan a cabo las actividades subvencionables, tienen que cumplir los requisitos siguientes (anexo V):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que esté al corriente de las obligaciones tributarias, con la Seguridad Social y el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Que tenga la condición de pyme, de acuerdo con el anexo I del Reglamento (UE) 2022/2472, de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación en los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea. Este requisito de pyme dedicada a la producción primaria de productos agrícolas tendrá que acreditarse antes de la propuesta de resolución de concesión por declaración responsable de los productores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Que no estén sujetas a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incompatible con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Sin embargo, no pueden ser beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Las personas físicas o jurídicas en las cuales concurra alguna de las prohibiciones establecidas en el artículo 13.2 de la Ley general de subvenciones y el artículo 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones, y el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Las personas físicas o jurídicas sancionadas o condenadas por resolución administrativa o sentencia judicial firmes por discriminación salarial, acoso moral o cualquier tipo de trato desigual, por razón de sexo, en el ámbito de las relaciones laborales, de conformidad con el que dispone el artículo 27 de la Ley 12/2006, de 20 de septiembre, para la mujer (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Presentación de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las solicitudes se tienen que presentar formalizadas electrónicamente mediante el modelo normalizado que se adjunta como anexo I de estas bases y que se encuentra en la sede electrónica www.cime.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que se presente más de una solicitud por parte de una misma persona solicitante, se considerará válida, a todos los efectos, la última solicitud presentada, la cual dejará sin efecto cualquier solicitud anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A la solicitud, se tiene que adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Documentación administrativa&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Documento de identificación del representante (DNI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Documento de identificación fiscal de la ADV (NIF).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Escritura de constitución o modificación de los estatutos o del reglamento interno de funcionamiento inscritos en el registro correspondiente. Si fuera necesario, de conformidad con sus estatutos, tienen que aportar certificado del acuerdo adoptado por el órgano de gobierno de la entidad para solicitar la ayuda y para designar representante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Declaración responsable firmada por el solicitante o por su representante legal de no estar sometido a ninguno de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario o entidad colaboradora de las subvenciones públicas recogidas en el artículo 13.2 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276, de 18 de noviembre de 2003), el modelo de la cual se adjunta como anexo II de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Certificado en que se indique que está inscrito en el registro insular de ADV o documento acreditativo de haber solicitado este trámite (se aportará de oficio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Declaración de la cuenta bancaria de la asociación según modelo facilitado por el CIM, salvo que ya conste a la tesorería Generales del CIM, cosa que se tiene que hacer constar expresamente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Certificado en que conste que está al corriente de las obligaciones tributarias y con la Seguridad Social ante la Administración del Estado. Se puede autorizar el Consejo Insular de Menorca a comprobar el cumplimiento de estas obligaciones (veáis el anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Declaración responsable firmada por el solicitante o por su representante legal relativa a las subvenciones o ayudas obtenidas y/o solicitadas otras instituciones públicas o privadas para llevar a cabo la misma actividad (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Documentación específica&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Acta de la Junta General de socios en que se acuerda solicitar la ayuda de la ADV y se designa representante (si fuera necesario, de conformidad con los estatutos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Número de los socios y superficie de cultivo con referencias SIGPAC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k) Certificado del secretario de la agrupación en que se indique la aportación económica hecha por los socios de la organización durante el ejercicio anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l) Plan de actuación de la ADV para la prevención, el control o erradicación de plagas vegetales que haya obtenido informe favorable del técnico del CIM responsable en materia de sanidad vegetal. Por cada una de las actuaciones, se tienen que especificar como mínimo los objetivos, el material y la metodología que se empleará.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;m) Previsión de los gastos subvencionables firmada por el presidente del ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;n) Contrato firmado entre la ADV y el técnico que dirigirá el programa de lucha o presupuesto del coste de la dirección técnica mediante contrato de arrendamiento de servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;o) Declaración responsable acreditativa de cada una de las explotaciones integradas dentro de la ADV en que conste (anexo V): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que están al corriente del pago de las obligaciones tributarias de carácter estatal, insular y local, y con la Seguridad Social, previstas en las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que tienen la condición de pyme, de acuerdo con el anexo I del Reglamento (UE) 2022/2472, de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícolas y forestal y en zonas rurales compatibles en el mercado interior en aplicación en los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea. 	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que no están sujetos a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incompatible con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se exime de presentar la documentación a que hacen referencia las letras a, b, c y f en el supuesto de que esta ya conste en los archivos del Consejo Insular, circunstancia que se tiene que hacer constar expresamente en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el artículo 28.2 de la Ley 39/2015, de 1 de octubre, del procedimiento común de las administraciones públicas; con la disposición adicional octava de la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, y con el artículo 95.1, letra K, de la Ley 58/2003, de 17 de diciembre, general tributaria, el Consejo Insular de Menorca podrá verificar la exactitud de los datos declarados, así como consultar o pedir los documentos elaborados por cualquier administración de forma electrónica mediante sus redes corporativas o consulta a las plataformas de intermediación de datos u otros sistemas electrónicos habilitados al efecto, siempre que no conste en el expediente la oposición expresa a esta consulta o cuando la ley especial que sea aplicable al caso requiera el consentimiento expreso. En este último caso será obligatorio que la Administración lo requiera y que el interesado lo preste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 28.3 y el artículo 53 c de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas (LPACAP), las personas interesadas no tienen la obligación de presentar documentos originales, salvo que, con carácter excepcional, la normativa reguladora aplicable exija el contrario. En cualquier caso, las personas interesadas son responsables de la veracidad de los documentos que presenten (artículo 28.7 de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 28.5 de la LPACAP, excepcionalmente, cuando la relevancia de un documento del expediente aportado por el interesado así lo exija, o haya dudas derivadas de la calidad de la copia, el CIM puede solicitar de manera motivada la autenticación de las copias aportadas por la persona interesada, por lo cual puede requerir la exhibición del documento o de la información original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Por el hecho de presentarse a esta convocatoria la persona interesada presta al Consejo Insular de Menorca los consentimientos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Para consultar y comprobar la veracidad de la documentación y de los datos presentados por el interesado que tengan en su poder de otras administraciones públicas, principalmente mediante las plataformas de interoperabilidad, las redes corporativas u otros sistemas electrónicos habilitados a tal efecto y a los cuales el CIM tenga acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Para consultar la existencia y veracidad de la documentación y de los datos que eventualmente el interesado haya considerado oportuno no presentar acogiéndose al derecho de no hacerlo por el hecho que hayan sido elaboradas por las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los consentimientos mencionados solo se considerarán otorgados cuando no conste en el expediente la oposición expresa a la mencionada consulta o cuando la ley especial que sea aplicable al caso requiera el consentimiento expreso. En este último caso será obligatorio que la Administración lo requiera y que el interesado lo preste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Las solicitudes y toda la documentación transcrita en el apartado 2 de la base 7 se tienen que presentar, dentro del plazo establecido en la convocatoria, de acuerdo con las indicaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por medios electrónicos, por los sujetos legalmente previstos de acuerdo con lo que establece el artículo 14.1 y 2 de la LPACAP al registro electrónico del Consejo Insular de Menorca (www.cime.es) o a cualquier otro registro electrónico de los establecidos en el artículo 16.4 de la mencionada ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si alguno de los sujetos obligados a los cuales hace referencia el artículo 14, apartados 2 y 3, de la LPACAP, presenta la solicitud presencialmente, se le requerirá para que lo enmiende mediante la presentación electrónica. A estos efectos y de acuerdo con lo que establece el artículo 68.4 de la misma ley, se considerará como fecha de presentación de la solicitud aquella en qué haya tenido lugar la enmienda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si la solicitud o la documentación fueran incorrectas o incompletas, el Consejo Insular de Menorca requerirá la rectificación o el complemento necesarios. Si en el plazo de diez días hábiles, contados desde el día siguiente a haber recibido el requerimiento de enmienda de la solicitud, la persona interesada no hace la rectificación reclamada o no presenta la documentación requerida, se entenderá que ha desistido en su petición de conformidad con el artículo 68 de la LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Gastos subvencionables. Presupuesto del proyecto presupuesto subvencionable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Son gastos justificables en el marco de esta convocatoria los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Las nóminas, así como las cuotas de IRPF y de Seguridad Social, relativas al personal técnico contratado por la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Las facturas correspondientes a los servicios de dirección técnica o de asistencia técnica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Las facturas de servicios de gestoría, de suministro de material de oficina, y de servicios de envío y mensajería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) En relación con la asistencia del personal técnico a actividades formativas: gastos de matrícula, desplazamiento y alojamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Los gastos de carburante y de mantenimiento de los vehículos utilizados para la ejecución de las actividades objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) El coste de adquisición del material destinado a la prevención y a la lucha biológica contra las plagas indicadas en el proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Los gastos vinculados al material y la equipación de laboratorio necesario para el desarrollo de las funciones técnicas de la ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De acuerdo con lo que establece el artículo 31 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, es gasto subvencionable y, por lo tanto, forma parte del presupuesto inicial del proyecto que se presente, el que responda a la naturaleza de la actividad subvencionada, sea estrictamente necesaria y se haga dentro del plazo establecido en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Además del cumplimiento de los requisitos establecidos en esta base, sólo se puede considerar como gasto realizado y, por lo tanto, subvencionable, el que se haya pagado antes de finalizar el plazo de presentación de la justificación de la ayuda. La forma de acreditar este pago y el plazo para llevarlo a cabo se regulan en la base decimoquinta (justificación de los gastos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En cualquier caso, no forman parte del presupuesto subvencionable, vista la naturaleza del crédito presupuestario, a pesar de que formen parte del proyecto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Inversiones, obras, compra de equipaciones o de cualquier bien inventariable de naturaleza similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos que no cumplan los requisitos mencionados en el apartado 1 de esta base.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos el importe de las cuales se haya pagado a un precio superior de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Intereses deudores de las cuentas bancarias, los intereses, los recargos y las sanciones administrativas, y los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Impuestos indirectos, cuando sean susceptibles de recuperación o compensación, y los impuestos sobre la renta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Costes indirectos de luz, teléfono e internet.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos relativos a comidas, refrigerios, servicios de comidas u otras de parecidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Determinación del importe de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las ayudas máximas que se pueden conceder para cada ayuda es del 100 % del gasto subvencionable, con los límites siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Apartados a y b hasta un máximo conjunto de 24.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Apartados del c al g hasta un máximo conjunto de 10.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo caso, el importe máximo de la ayuda se limitará a 32.000 para cada agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Criterios que se tienen en cuenta para la concesión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Siempre que se cumplan los requisitos de la convocatoria, se tienen que otorgar las ayudas solicitadas con los límites fijados en la convocatoria y en estas bases, dentro del crédito disponible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si el total de la ayuda solicitada es superior al crédito disponible, éste se tiene que repartir proporcionalmente entre los solicitantes que cumplan los requisitos y hasta el importe máximo establecido en la base octava.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Para la concesión de las ayudas, se tienen que tener en cuenta y priorizar los aspectos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) El número de socios. Hasta diez socios, se darán 5 puntos. Por cada socio de más,1 punto más.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Mayor aportación anual que hagan los socios a la entidad. Hasta una aportación media de 300 €/socio/año se darán 3 puntos, y por cada 100 €/socio/año, 1 punto más.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Formación que se prevé llevar a cabo para los técnicos de la ADV, de acuerdo con las líneas establecidas por el departamento competente en la materia, se otorgarán 2 puntos por cada curso asistido hasta un máximo de 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Se otorgarán 1,5 puntos por cada programa de control de plaga presentado para la que haya normas nacionales o de la unión, tanto si son establecidas por ley, reglamento o acción administrativa, con un máximo de 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El importe de la ayuda se calcula en función de la puntuación obtenida y según los baremos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hasta 15 puntos: 15.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 16 a 29 puntos: se aumentará proporcionalmente hasta un máximo de 31.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;30 puntos o más: 32.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Comisión evaluadora de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Comisión Evaluadora es el órgano colegiado a quien corresponde examinar las solicitudes presentadas y emitir el informe que tiene que servir de base para elaborar la propuesta de resolución que tiene que formular el órgano instructor competente. Su creación y el nombramiento de sus miembros se establece para cada convocatoria, de acuerdo con estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El objeto de la Comisión Evaluadora es examinar los expedientes de ayudas, que tendrán que ir acompañados de un informe técnico, y emitir un informe que tiene que servir de base para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Comisión Evaluadora tiene que estar integrada por personas que cumplan los criterios de competencia profesional y experiencia. La composición tiene que ser la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidente/a: el/la consejero/a ejecutivo/a competente en la materia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretario/a: uno/a funcionario/a del Departamento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocales titulares:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Director/a insular competente en la materia &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Dos técnicos agrícolas del CIM&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Técnico de gestión del CIM&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Para que la Comisión Evaluadora se entienda válidamente constituida, se requerirá la presencia del presidente, del secretario y al menos de la mitad de los miembros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Procedimiento y órganos competentes para la concesión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. De acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, las ayudas se concederán por medio del procedimiento de concurrencia competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El expediente se iniciará con la aprobación de la convocatoria correspondiente, posteriormente las bases y la convocatoria de estas ayudas se comunicarán a la Base de datos Nacional de Subvenciones (BDNS) y se publicará en el BOIB la mencionada identificación, conjuntamente con las bases y la convocatoria, en cumplimiento del art. 20.8 de la Ley general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cumplimiento de lo que dispone el artículo 11.1 del Reglamento (UE) 2022/2472, se transmitirá a la Comisión Europea, a través del sistema de notificación electrónica correspondiente, la información resumida sobre cada medida de ayuda exenta en virtud del Reglamento mencionado, en el formato normalizado establecido en el anexo II. Esta información irá acompañada de un enlace que permita acceder al texto completo de la medida de la ayuda, incluidas las modificaciones, en un plazo de veinte días hábitos a partir de su entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La instrucción corresponde a un funcionario del Departamento de Economía y Servicios Generales, que tiene que llevar a cabo de oficio todas las actuaciones necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de los cuales se tiene que dictar resolución sobre la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Previamente a la tramitación de la concesión de estas ayudas, el instructor tiene que comprobar que son compatibles con otras ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen de la Comisión Evaluadora. Si la solicitud no cumple los requisitos establecidos en la convocatoria o falta la documentación exigida, se tiene que requerir al solicitante para que en un plazo de diez días hábiles enmiende el defecto o aporte la documentación preceptiva, con la advertencia de que, si no lo hace, se lo tendrá por desistido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vez la Comisión Evaluadora ha examinado las solicitudes y después de que haya emitido su informe, el instructor tiene que elevar la propuesta de resolución correspondiente al consejero ejecutivo competente, el cual dictará una resolución sobre la concesión o denegación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Cuando la cuantía de la ayuda propuesta por el órgano instructor sea sustancialmente inferior al solicitado, se podrá instar el beneficiario a reformular la solicitud a fin de ajustar los compromisos y las condiciones de la subvención otorgable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La resolución del expediente de otorgamiento de las subvenciones tiene que ser expresa y motivada, y tiene que fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El plazo máximo para dictar y notificar la resolución expresa de concesión de subvención será de seis meses contados desde la fecha de finalización del plazo de presentación de solicitudes. No obstante lo anterior, este plazo se podrá reducir si se establece expresamente en la convocatoria de las ayudas. El silencio administrativo tendrá carácter desestimatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La resolución del expediente de concesión o denegación de las ayudas se tiene que remitir a la BDNS en cumplimiento del artículo 20.8 de la LGS y se tiene que publicar en el Boletín Oficial de las Illes Balears a los efectos de notificación (artículo 45.1 b de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Modificación del proyecto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Cuando la entidad beneficiaria, por causas de fuerza mayor o por causas imprevisibles y ajenas a su voluntad, tenga que introducir modificaciones irrelevantes en el proyecto, es decir, que no alteren los objetivos ni los aspectos esenciales, éstas se tienen que comunicar al Consejo Insular de Menorca tan pronto sea posible o, en todo caso, en el momento de la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. No se admitirán modificaciones sustanciales del proyecto, es decir, que alteren la naturaleza, las finalidades, las características esenciales o cualquier otro aspecto que pueda desvirtuarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Abono de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las subvenciones se tienen que hacer efectivas en el plazo máximo de 60 días desde el momento en que se compruebe que la justificación presentada se ajusta a los requisitos exigidos en las bases de la convocatoria y siempre que la disponibilidad de tesorería lo permita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el momento del pago, el beneficiario tendrá que acreditar que está al corriente con el cumplimiento de las obligaciones tributarias y de la Seguridad Social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No se podrá hacer el pago de la subvención mientras el beneficiario no esté al corriente en el cumplimiento de las obligaciones tributarias y ante la Seguridad Social y de las obligaciones tributarias con el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Respecto a las obligaciones tributarias y con la Seguridad Social, debe regir lo que establece la base 6. Sin embargo, la entidad beneficiaria puede sustituir los certificados que se señalan por una declaración responsable de estar al corriente en el cumplimiento de las obligaciones mencionadas cuando el importe de la subvención concedida en la convocatoria no supere los 3.000 euros (artículo 11 f TRLGSIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. No se abonarán las ayudas a las personas o entidades sujetas a una orden de recuperación pendiente después de una decisión previa de la Comisión que haya declarado una ayuda ilegal e incontable con el mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Justificación de los gastos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los gastos que son objeto de subvención se tienen que haber efectuado y pagado como máximo el 31 de diciembre de 2025. A estos efectos, solo se consideran subvencionables los gastos que hayan sido efectivamente pagados dentro de este plazo, con lo cual quedan excluidos los que, a pesar de estar comprometidos o facturados, no hayan sido abonados antes de la fecha mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También son gastos subvencionables los pagos llevados a cabo del 1 al 15 de enero del año 2026, relativos al impuesto sobre la renta de las personas físicas (IRPF) y a la Seguridad Social que correspondan a los gastos ejecutados en el último trimestre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La documentación justificativa de la actividad subvencionada se tiene que presentar hasta el día 15 de enero de 2026, incluido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La justificación de este convenio se tiene que presentar en la fecha antes indicada, salvo que haya causas excepcionales que lo impidan y que los beneficiarios tienen que alegar por escrito antes de que finalice este plazo, tal como prevé el artículo 32 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, y el artículo 70 del Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. Con vistas de esto, el CIM podrá ampliar el plazo de justificación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La justificación de la realización del proyecto subvencionado se tiene que hacer de manera individual para cada una de las actuaciones subvencionadas y se tiene que acreditar la consecución de los objetivos de la subvención, así como el cumplimiento de las obligaciones que determine, si procede, el acto de concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con esta documentación, el beneficiario tiene que demostrar que ha ejecutado el proyecto de acuerdo con el modo en que lo solicitó inicialmente o con la introducción de los cambios que previamente ha comunicado al Departamento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificación se tiene que formalizar de acuerdo con lo que establece el artículo 75 del Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, general de subvenciones, mediante la presentación de una cuenta justificativa simplificada, que tiene que incluir el contenido siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Memoria justificativa del cumplimiento de las condiciones impuestas en la concesión de la subvención, con indicación de las actividades ejecutadas y el apoyo documental de estas y otros aspectos que sean relevantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relación con los ensayos hechos o las experiencias llevadas a cabo, se tienen que exponer los resultados obtenidos y las conclusiones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que no se haya ejecutado la totalidad del proyecto por causas ajenas o de fuerza mayor, la memoria tiene que exponer las causas y se tiene que explicar el resto del proyecto elaborado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Relación nominativa de los gastos de la actividad, con identificación del acreedor y documento, importe, fecha de emisión y, si procede, fecha de pago. En caso de que el presupuesto se otorgue de acuerdo con un presupuesto estimado, hay que indicar las desviaciones acontecidas (anexo V, con carácter orientativo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Un detalle de otros ingresos o subvenciones que hayan financiado la actividad subvencionada con indicación del importe y procedencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Un ejemplar, en caso de actuaciones que tengan lugar después de la aprobación de la convocatoria, de la publicidad escrita y gráfica relativa a la actividad subvencionada, en la cual se tiene que hacer constar el patrocinio del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Una declaración responsable de la entidad beneficiaria sobre el hecho de que el gasto justificado no tiene un valor superior al de mercado (artículo 31.1 y 33 LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Si procede, una declaración responsable de la entidad beneficiaria que acredite que no recupera ni compensa el IVA (artículo 31.8 LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Cualquier otra documentación que se derive de las bases o que sea requerida por la entidad beneficiaria con el fin de comprobar la justificación económica del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Si la documentación presentada fuera incompleta o incorrecta, el servicio responsable tendrá que pedir al beneficiario que haga la rectificación oportuna en el plazo improrrogable de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Si el gasto justificado excede del importe concedido, la posible desviación presupuestaria irá a cargo de la entidad subvencionada. Si, por el contrario, el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado se tendrá que reducir proporcionalmente la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En la fase de comprobación del gasto realizado se podrá requerir al beneficiario, mediante técnicas de muestreo, los justificantes de gasto seleccionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Si el beneficiario no adopta las medidas de difusión adecuadas para dar publicidad a la financiación pública del proyecto, de acuerdo con lo que establece el artículo 31.3 b del RLGS, el órgano instructor le hará un requerimiento porque las adopte en un plazo no superior a quince días, con la advertencia de las consecuencias que se pueden derivar de no adoptarlas en aplicación del artículo 37 de la LGS (en caso de actuaciones que tenga lugar después de la aprobación de la convocatoria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Una vez transcurrido el plazo establecido en las bases para la justificación, si ésta no se ha presentado, se tiene que requerir el beneficiario para que la presente en un plazo improrrogable de quince días. Así mismo, este requerimiento tendrá la consideración de inicio de expediente de revocación y reintegro que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los beneficiarios tienen que cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Llevar a cabo las actividades que fundamentan la concesión de las ayudas y justificar la realización en los plazos y en las condiciones establecidas en estas bases y en la resolución de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Comunicar al Consejo Insular de Menorca la aceptación de la subvención en los términos en que esta se concede. En cualquier caso, la subvención se entenderá aceptada tácitamente una vez hayan transcurrido quince días hábiles desde la notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Llevar a cabo las actividades que fundamentan la concesión de las ayudas y justificar la realización en los plazos y en las condiciones establecidos en estas bases y en la resolución de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Comunicar al Consejo Insular de Menorca, en cualquier momento o, en todo caso, a la hora de justificar la subvención, la solicitud o la obtención de otros ingresos, subvenciones o recursos de ayudas para el mismo proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Comunicar inmediatamente al Consejo Insular de Menorca cualquier eventualidad que altere o que dificulte gravemente el desarrollo del proyecto subvencionado, en particular si se pueden derivar retrasos en la ejecución o si pueden afectar el coste total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Las entidades beneficiarias de estas ayudas tienen que mantener la actividad durante un plazo mínimo de un año desde la presentación de la solicitud; en caso contrario, se les podrá exigir la devolución total o parcial de la subvención abonada más los intereses de demora, sin perjuicio de la sanción que pueda corresponder por alteración de la finalidad para la cual la subvención fue concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Acreditar, de acuerdo con lo que establecen estas bases, que se encuentran al corriente de las obligaciones tributarias y con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La acreditación no será necesaria en el supuesto de que se haya autorizado expresamente el Consejo Insular a consultarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Proporcionar la información sobre la actividad subvencionada que le requiera el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Someterse a las actuaciones de comprobación que efectúen el Consejo Insular de Menorca y el resto de organismos competentes para la fiscalización de las cuentas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Dejar constancia de la percepción y la aplicación de la subvención en la contabilidad o en los libros de registro que tenga que llevar la entidad beneficiaria de acuerdo con la normativa vigente y, en caso de no tener esta obligación, en la documentación que lo sustituya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Conservar los documentos justificativos de la aplicación de los fondos percibidos, incluidos los documentos electrónicos, mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Llevar a cabo las medidas de difusión adecuadas para hacer público el apoyo económico del Consejo Insular de Menorca. En este sentido, la difusión se tiene que hacer a través de los medios que sean adecuados de acuerdo con la naturaleza del proyecto. Si se hacen folletos, carteles o cualquier otro material impreso, se tiene que hacer constar, de manera expresa, el apoyo del Consejo Insular Menorca en la realización de las actividades subvencionadas (en caso de actuaciones que tengan lugar después de la convocatoria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Reintegrar los fondos percibidos en los supuestos previstos en el artículo 37 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Revocación y reintegro de las ayudas. Criterios de graduación de posibles incumplimientos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de incumplimiento total o parcial de las obligaciones de los beneficiarios de estas ayudas, se tiene que iniciar el expediente de revocación y consiguiente reintegro de las ayudas segundas corresponda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto a la revocación y el reintegro de las ayudas, se tienen que aplicar los artículos 43 y 44 del TRLS y el resto de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que no sea procedente la revocación total de la ayuda concedida, se puede aplicar un porcentaje de minoración en función de la naturaleza del incumplimiento mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este porcentaje se tiene que fijar en el informe previo del instructor y la notificación al beneficiario y se tendrá que valorar, en todo caso, el grado de incumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la entidad beneficiaria ha cumplido de manera significativa las obligaciones, si de la documentación presentada se deduce que ha tenido voluntad de cumplimiento y que se han conseguido las finalidades de la ayuda, se tiene que llevar a cabo una revocación parcial de la ayuda y, consiguientemente, la pérdida al derecho de cobro parcial de la ayuda, de acuerdo con la aplicación del criterio de gradación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) En caso de que se haya ejecutado totalmente el proyecto pero la documentación justificativa del gasto subvencionable del presupuesto presentara deficiencias porque es inadecuada, porque no se ajusta a los requisitos de las bases o porque no se ha ejecutado la totalidad del presupuesto inicial subvencionable, el importe de revocación parcial de la ayuda tiene que coincidir con el importe de la ayuda no justificada o justificada incorrectamente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) En caso de que la entidad beneficiaria no justifique dentro del plazo establecido el importe de la subvención otorgada, se aplica una penalización del 1 % por cada día de retraso. Esta penalización se llevará a cabo de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la entidad beneficiaria justifica un importe igual o superior a la ayuda concedida, la penalización se calcula sobre el importe concedido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la entidad beneficiaria justifica un importe inferior la ayuda concedida, la penalización se calcula sobre el importe efectivamente justificado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) En caso de que la entidad beneficiaria no haga constar de manera expresa el apoyo del CIM, se aplica una penalización del 5 %. Esta penalización se tiene que llevar a cabo de conformidad con el que se ha establecido en el apartado anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que se hayan hecho unos pagos anticipados, la persona beneficiaria tendrá que reintegrar las cantidades recibidas que hayan acontecido indebidas más el interés de demora, el cual se contará desde el pago de la subvención, total o parcial, hasta la fecha de resolución mediante la cual se acuerde el reintegro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el importe de la suma de la ayuda más el resto otras ayudas, subvenciones, ingresos o fondos propios que hayan financiado la realización del proyecto supera el presupuesto total de ejecución de este, el importe de la revocación parcial de la subvención tiene que ser igual a la cantidad que exceda del presupuesto ejecutado mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las cantidades que se tengan que reintegrar tienen la consideración de ingresos de derecho público y les es aplicable la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La obligación de reintegro establecida en este artículo es independiente de las sanciones que, si procede, sean exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Infracciones y sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el caso de incurrir en esta convocatoria en una actuación que fue informada como incumplimiento muy grave en la convocatoria anterior, se considerará que este hecho constituye una infracción administrativa en materia de subvenciones y será de aplicación lo que establece el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y en título V del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El órgano competente para imponer las sanciones que se deriven de infracciones de lo establecido en estas bases y de la normativa aplicable en materia de subvenciones es el consejero ejecutivo competente por razón de la materia en el caso de infracciones leves y graves, y el Consejo Ejecutivo en caso de infracciones muy graves, de conformidad con el establecido en el artículo 69 de la Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Otras disposiciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Recursos administrativos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los acuerdos del Consejo Ejecutivo por los cuales se aprueban las bases y las convocatorias de las ayudas no agotan la vía administrativa y son susceptibles de interponer un recurso de alzada ante el Pleno del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las resoluciones de los consejeros ejecutivos por las cuales se conceden y deniegan las ayudas no agotan la vía administrativa y son recurribles en alzada ante el Consejo Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Normativa general aplicable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo lo que no se prevé expresamente en estas bases, rigen las disposiciones que son aplicables al Consejo Insular de Menorca en materia de subvenciones, especialmente las contenidas en las normas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decreto Legislativo 2/2005, de 28 de noviembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones de la Comunidad Autónoma de las Illes Balears (BOIB núm. 196 de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reglamento (CE) núm. 2472/2022 de la Comisión, de 14 de diciembre de 2022, por el cual se declaran determinadas categorías de ayuda en los sectores agrícola y forestal y en zonas rurales compatibles en el mercado interior en aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea, modificado por el Reglamento UE 289/2019, de 19 de febrero, y por el Reglamento 2008/2020, de 8 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decreto 52/2013, de 29 de noviembre, mediante el cual se regulan las agrupaciones de defensa vegetal en el ámbito de las Illes Balears y se crea el Registro Oficial de Agrupaciones de Defensa Vegetal de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consta en el expediente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acuerdo, que no agota la vía administrativa, puede interponerse un recurso de alzada ante la Comisión de Gobierno, por delegación del Pleno del Consejo Insular de Menorca (Acuerdo de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el plazo de un mes a partir del día siguiente en que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses des de su interposición. Contra la desestimación del recurso de alzada por silencio administrativo se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
