&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 8 d'abril de 2025, la Comisión Negociadora del Convenio colectivo del sector del sector de las empresas de alquiler de vehículos sin conductor de las Illes Balears aprobó la modificación del Convenio colectivo de la cual cosa se levantó la correspondiente acta de sesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 10 de abril de 2025, José Carlos Sedano Almiñana, en representación de la Comisión Negociadora del Convenio colectivo, solicitó el registro, el depósito y la publicación del el acta mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El artículo 90.3 del Texto refundido de la Ley del Estatuto de los Trabajadores, aprobado por Real Decreto Legislativo 2/2015, de 23 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios y acuerdos colectivos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El artículo 45 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Inscribir y depositar el acta del acuerdo de la Comisión negociadora del Convenio colectivo del sector del sector de las empresas de alquiler de vehículos sin conductor de les Illes Balears, en la cual se acuerda la modificación del Convenio colectivo, en el Registro de Convenios Colectivos de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Notificar esta Resolución a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Hacer constar que la versión castellana del texto es el original firmada por los miembros de la Comisión Negociadora y que la versión catalana es su traducción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

SEDANO &amp;amp; ASOCIADOS” sitos en la calle Nuredunna 10 2º E, de esta ciudad, se reúnen las personas al margen izquierdo relacionadas, a raíz de la convocatoria realizada el día 2 de abril de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;Levanta la presente acta por aprobación de los presentes, D. Alejandro FERNÁNDEZ MONGE, de la firma “C. SEDANO &amp;amp; ASOCIADOS”, asesor laboral de la representación de la FEBT y AEVAB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;El objeto de esta reunión extraordinaria es tratar la petición de modificación del artículo 17 del convenio dirigida al resto de firmantes del Convenio colectivo, el pasado 31 de marzo de 2025, por parte del Secretario de carreteras, urbanos y logística de la FeSMC-UGT, Sr. D. Manuel Vega. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:107%"&gt;Todo ello de conformidad a lo previsto en los artículos 86, 87, 88 y concordantes de la Ley del Estatuto de los Trabajadores, y en concreto con lo dispuesto en el segundo párrafo del apartado 1 del artículo 86 del referido texto estatutario, que señala que durante la vigencia del convenio colectivo los sujetos que reúnan los requisitos de legitimación previstos en los artículos 87 y 88 ET podrán negociar su revisión. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:107%"&gt;En este sentido, la Comisión negociadora está formada por las mismas partes legitimadas constituyentes de la misma, en fecha 18 de febrero de 2022, con el reparto previsto en el apartado 1 del artículo 88 ET y en las mismas proporciones de representación, que mayoritariamente suscribieron el vigente Convenio colectivo que se publicó en el Boletín Oficial de las Illes Balears («BOIB») nº 113, de 27 de agosto de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;Dicho artículo indica lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;“Artículo 17. VACACIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;El periodo de vacaciones anuales retribuidas será de treinta y un días naturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;La planificación de tales vacaciones, cuando se trate de personas trabajadoras fijas ordinarias, se realizará durante el último trimestre del año anterior al que vayan a disfrutarse. Cuando la persona trabajadora no pueda disfrutar su periodo íntegro de vacaciones, por razones del mayor volumen de trabajo, en los meses de mayo a octubre, ambos inclusive, o en los periodos de Navidad y Semana Santa, tendrán un incremento de cinco días naturales a disfrutar fuera de las fechas citadas. Si las disfruta íntegramente de mayo a octubre, pero no en Navidad y Semana Santa, no tendrá derecho a los cinco días de incremento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;Las personas trabajadoras fijas discontinuas y las contratadas a tiempo determinado, disfrutarán las vacaciones correspondientes en el último tramo temporal de su periodo de ocupación, salvo pacto en contrario entre el empresario y la persona trabajadora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;El inicio del periodo de vacaciones no tendrá lugar en un día de descanso semanal.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;Tras una puesta en común y en consonancia con la Sentencia del Tribunal Superior de Justicia de Illes Balears de 26 de febrero (92/2024), se acuerda suprimir el párrafo tercero de dicho artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;De esta forma, procede la modificación del mencionado artículo 17, referente a las vacaciones, que quedaría redactado en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Carlos Sedano Almiñana para que facilite a la autoridad laboral el contenido de esta acta y el nuevo texto resultante del acuerdo adoptado en la misma y realice los trámites de inscripción, depósito y su publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
