&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mediante la Resolución del consejero de Empresa, Empleo y Energía de 21 de diciembre de 2024 (BOIB n.º 6, de 11 de enero de 2025), se aprobó la convocatoria para conceder ayudas destinadas a mantener los puestos de trabajo para personas con discapacidad en centros especiales de empleo por medio de la financiación parcial de los costes salariales, la adaptación de los puestos de trabajo y la eliminación de barreras arquitectónicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De acuerdo con el apartado cuarto del anexo 1 de la mencionada Resolución, el crédito total asignado a las ayudas que establece la convocatoria es de diez millones quinientos mil euros (10.500.000&amp;nbsp;€).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los fondos asignados a la convocatoria se financian con cargo a los programas de apoyo al empleo de los presupuestos generales del Estado de acuerdo con la Orden TES/630/2023, de 14 de junio, por la que se distribuyen territorialmente para el ejercicio económico de 2024, para la gestión por las comunidades autónomas con competencias asumidas, créditos del ámbito laboral financiados con cargo a los presupuestos generales del Estado, no financiados con el Mecanismo de Recuperación y Resiliencia (BOE n.º 114, de 17 de junio), y que resulta de aplicación en la distribución para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El crédito total asignado en la convocatoria mencionada es insuficiente para afrontar la previsión de las solicitudes, por lo que resulta necesario ampliar el crédito previsto en la convocatoria en 1.300.000,00 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El punto 4.2 de la convocatoria de ayudas mencionada establece: “Este crédito asignado inicialmente puede ampliarse en función de la disponibilidad presupuestaria del fondo finalista indicado”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En fecha 14 de mayo de 2025 la directora general de Trabajo y Salud Laboral ha emitido un informe justificativo sobre la necesidad de ampliar la dotación presupuestaria de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En fecha 20 de mayo de 2025 el consejero de Empresa, Empleo y Energía ha dictado la Resolución de inicio del procedimiento de modificación de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. En fecha 20 de mayo de 2025 la jefa del Servicio Adjunto al Departamento de Relaciones Laborales ha emitido un informe jurídico favorable sobre la adecuación de la normativa vigente de subvenciones y al Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El Consejo de Gobierno, en la sesión de día 30 de mayo de 2025, ha acordado autorizar con carácter previo, al consejero de Empresa, Empleo y Energía, para ejercer la competencia en materia de autorización y disposición del gasto, en el expediente de gasto correspondiente a la ampliación del crédito asignado a la convocatoria de ayudas, de acuerdo con el artículo&amp;nbsp;10.2 de la Ley&amp;nbsp;12/2023, de 29 de diciembre, de Presupuestos Generales de la Comunidad Autónoma de las Illes Balears para el año 2024, prorrogados para el año 2025 de acuerdo con el artículo 47 de la Ley 14/2014, de 29 de diciembre, de Finanzas de la CAIB y la Orden 1/2025 del consejero de Economía, Hacienda e innovación de 9 de enero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Las subvenciones comprendidas en esta convocatoria están incluidas dentro del objetivo&amp;nbsp;II.1.1 del Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2024-2026, aprobado por acuerdo del Consejo de Gobierno de 19 de abril de 2024 (BOIB n.º&amp;nbsp;52, de 20 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos Jurídicos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Ley 38/2003, de 17 de noviembre, General de Subvenciones (BOE n.º 276, de 18 de noviembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decreto Ley 3/2024, de 24 de mayo, de medidas urgentes de simplificación y racionalización administrativas de las administraciones públicas de las Illes Balears (BOIB n.º 71, de 28 de mayo de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 30 de septiembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Orden del consejero de Trabajo y Formación de 4 de mayo de 2005 (BOIB n.º 73, de 12 de mayo), modificada por la Orden de la consejera de Trabajo y Formación de 16 de julio de 2008 (BOIB núm. 104, de 26 de julio) y por la Orden 39/2024, de 11 de noviembre (BOIB n.º&amp;nbsp;148, de 12 de noviembre), establece las normas reguladoras de las subvenciones en materia de trabajo y formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Acuerdo del Consejo de Gobierno de día 19 de abril de 2024, por el que se aprueba el Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2024-2026 (BOIB n.º 52, de 20 de abril de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El artículo 2.3 del Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, versión consolidada (BOIB n.º 94, de 10 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. La Resolución del consejero de Empresa, Empleo y Energía de 21 de diciembre de 2024 (BOIB n.º 6, de 11 de enero de 2025), por la que se aprobó la convocatoria para conceder ayudas destinadas a mantener los puestos de trabajo para personas con discapacidad a centros especiales de empleo por medio de la financiación parcial de sus costes salariales, la adaptación de los puestos de trabajo y la eliminación de barreras arquitectónicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, y dado que existe crédito presupuestario, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Modificar la Resolución del consejero de Empresa, Empleo y Energía de día 21 de diciembre de 2024 por la que se aprueba la convocatoria para conceder ayudas destinadas a mantener los puestos de trabajo de personas con discapacidad en centros especiales de empleo por medio de la financiación parcial de los costes salariales, de la adaptación de los puestos de trabajo y la eliminación de barreras arquitectónicas, mediante la ampliación del crédito asignado inicialmente en 1.300.000,00 euros, con cargo a las partidas presupuestarias que a continuación se indican de los presupuestos vigentes de la Comunidad Autónoma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Financiación parcial de los costes salariales de las personas con discapacidad severa que prestan servicios en el resto de centros especiales de empleo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— 19601 322A01 47000.00 25021 ............ 290.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Fijar que, con esta ampliación el crédito total asignado a la convocatoria, es de once millones trescientos mil euros (11.800.000,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo&amp;nbsp;124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
