&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Mediante la Resolución del consejero de Educación, Universidad e Investigación de 11 de noviembre de 2019 (BOIB núm. 156, de 16 de noviembre) se actualizó la oferta formativa para el curso 2019/2020 de las enseñanzas autorizadas, como consecuencia de la implantación, la supresión y el cambio de perfil o de régimen de los ciclos formativos de formación profesional en centros públicos de educación secundaria. Entre estos centros estaba el IES Mossèn Alcover, que quedó configurado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;*Los programas de mejora del aprendizaje y del rendimiento (PMAR) en 2º y 3º de ESO se impartirán o no, según las necesidades de escolarización del centro.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Este programa de mejora del aprendizaje y del rendimiento (PMAR de 2º y 3º de ESO) desaparece en aplicación de la Ley orgánica 2/2006, de 3 de mayo, de educación, modificada por la Ley orgánica 3/2020, de 29 de diciembre. Estas unidades pasan a ser del Programa de diversificación curricular (PDC de 3º y PDC de 4º).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Mediante la Resolución del consejero de Educación y Formación Profesional de 22 de junio de 2022 (BOIB núm. 87, de 5 de julio) se autorizó la implantación de la modalidad de bachillerato general en todos los centros que tienen autorizadas las modalidades de Humanidades y Ciencias Sociales y Ciencias y Tecnología. Con esta autorización, el bachillerato del centro quedó configurado de la siguiente forma:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modalidad de humanidades y ciencias sociales (presencial continuada y nocturno)&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modalidad de ciencias y tecnología (presencial continuada y nocturno)&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modalidad de artes (presencial continuada y nocturno)&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modalidad general&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En fecha 20 de febrero de 2025, el jefe de Servicio de Inclusión para la Comunidad Educativa (SICE) remitió un informe favorable a la Dirección General de Planificación y Gestión Educativas sobre la creación de una unidad educativa específica en centro ordinario (UEECO) para el próximo curso 2025-2026 en el IES Mossèn Alcover para poder dar respuesta a las necesidades de escolarización de la etapa de educación especial básica 2 (EEB2) del municipio de Manacor y de los municipios de alrededor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. En fecha 21 de mayo de 2025, el arquitecto del Servicio de Infraestructuras Educativas emitió un informe favorable para la implantación de un aula UEECO en el IES Mossèn Alcover. Sin embargo, se especificaba que debía adaptarse un baño, instalar una toma de agua en el aula y habilitar una salida con una rampa en la zona de recreo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. El 26 de mayo de 2025, la jefa del Departamento de Planificación y Centros emitió un informe favorable sobre la implantación de una unidad UEECO de EEB2 en el IES Mossèn Alcover, del municipio de Manacor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. El 28 de mayo de 2025, la directora general de Planificación y Gestión Educativas emitió una propuesta de resolución sobre la autorización de la implantación de una unidad UEECO de EEB2 en el IES Mossèn Alcover, del municipio de Manacor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Estatuto de autonomía de las Illes Balears, aprobado por la Ley orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 1 de marzo), el cual establece, en el artículo 36.2, que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Islas Baleares la competencia de desarrollo legislativo, de competencia modalidades y especialidades.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm. 106, de 4 de mayo), modificada por la Ley orgánica 3/2020, de 29 de diciembre (BOE núm. 340, de 30 de diciembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Ley 1/2022, de 8 de marzo, de educación de las Illes Balears, que establece en el artículo 102.1, la creación, la supresión y la transformación de centros públicos corresponde al Gobierno de las Illes Balears, que debe establecer los tipos de enseñanzas que se van a desarrollar. (BOIB núm. 38, de 17 de marzo).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Decreto 39/2011, de 29 de abril, por el que se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos (BOIB núm. 67, de 5 de mayo de 2011).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Decreto 6/2025, de 2 de junio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 70, de 3 de junio).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, de acuerdo con la propuesta formulada por la Dirección General de Planificación y Gestión Educativas, en fecha 28 de mayo de 2025, dicto la siguiente&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

Autorizar, con efectos del inicio del curso escolar 2025-2026, la modificación de la configuración del IES Mossèn Alcover, del municipio de Manacor, con la implantación de una unidad UEECO de educación especial básica 2 (EEB2), con 7 plazas escolares. Con esta modificación el centro queda configurado de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Enseñanzas deportivas &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico deportivo en baloncesto.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico deportivo en fútbol.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Inscribir y actualizar esta autorización en el Registro estatal de centros docentes no universitarios (RCD) del Ministerio de Educación, Formación Profesional y Deportes y en el Registro autonómico de centros docentes de la Consejería de Educación y Universidades (Repositorio de centros).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Comunicar esta Resolución al centro educativo, a la Dirección General de Personal Docente y Centros Concertados y al Departamento de Inspección Educativa (DIE) para su conocimiento a los efectos oportunos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Universidades en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las &lt;/span&gt;&lt;em&gt;Illes Balears.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las &lt;/span&gt;&lt;em&gt;Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
