&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.En fecha 18 de abril de 2023, se publicó el BOIB núm. 49 la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba, para el año 2023, la convocatoria de ayudas destinadas al fomento de producción integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. El órgano gestor del Servicio de Ayudas al Desarrollo Rural llevó a cabo el control administrativo de la solicitud y documentación aportada de acuerdo con las bases reguladoras de estas ayudas; y constató que Josep Nadal Crespí no cumplía con el requisito de la convocatoria establecido en el apartado tercer punto 2.c) disponer de una superficie mínima del grupo de cultivo. En este caso No solicitó la superficie mínima de 2 hectáreas del grupo de cultivo de cereal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. En fecha 14 de abril de 2024 se publicó en la web la propuesta provisional de denegación del interesado Josep Nadal Crespí dándole un período de 10 días para presentar alegaciones. Las que no ha presentado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Punto tercero, 2.c) no llegar a la superficie mínima de cultivo de cereal3. Resolución del presidente del fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se incremente el crédito de la Resolución de la presidenta del FOGAIBA por la que se aprueba la convocatoria, para el año 2023, de las ayudas destinadas al fomento de producción integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. La orden 10/2023 de la consejera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Informe y propuesta de resolución &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, se informa y propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Denegar la solicitud de ayuda Josep Nadal Crespí por no llegar a la superficie mínima de grupo de cultivo por el que solicita la ayuda de Fomento de Producción integrada, convocatoria 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Notificar la resolución a los interesados ​​en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo.
