    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Gobierno del Ayuntamiento de Palma en sesión de día 21 de mayo adoptó el siguiente acuerdo: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Reglamento de Organización y Funcionamiento de la Mesa General de Negociación Conjunta del Ayuntamiento de Palma, se aprobó en Junta de Gobierno Local de día 13 de octubre de 2016, (BOIB núm. 94, de 1 de agosto de 2017) y modificado por Acuerdo de la junta de Gobierno de día 26 de julio de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 8 del Reglamento regula las reuniones ordinarias y establece que la periodicidad de las reuniones es de una reunión al mes, preferentemente el primer jueves de cada mes.&amp;nbsp;Además establece que las organizaciones sindicales interesadas en incluir asuntos en una reunión ordinaria los tienen que presentar ante el Departamento de Recursos Humanos dentro del plazo máximo de las 14h del &lt;em&gt;jueves&lt;/em&gt; anterior a la reunión. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Se ha detectado un error material en el índice del Reglamento, al incluirse el artículo 13 que no forma parte del reglamento, lo cual comporta la numeración incorrecta de los artículos posteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.&amp;nbsp;Normativa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;El Real decreto legislativo 5/2015, de 30 de octubre, por el cual se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado público.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&amp;nbsp;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los artículos 19 y 20 del Reglamento de organización y funcionamiento de la Mesa General de Negociación Conjunta del Ayuntamiento de Palma, aprobado en Junta de Gobierno Local de fecha 13 de octubre de 2016, (BOIB n.º 94, de 1 de agosto de 2017), en cuanto a la modificación del Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&amp;nbsp;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, dispone que las Administraciones públicas podrán, así mismo, rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.&amp;nbsp;Consideraciones jurídicas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El artículo 8 del Reglamento regula las reuniones ordinarias y establece que la &amp;nbsp; periodicidad de las reuniones será de una reunión al mes, preferentemente el &amp;nbsp;&amp;nbsp; primer jueves de cada mes.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sin embargo, la celebración de las reuniones ordinarias no se está llevando a cabo el primer jueves de cada mes con motivo de problemas logísticos de disponibilidad del lugar de celebración, así como a causa de los conflictos de agenda de la administración al coincidir con la asistencia a otras reuniones que se programan para el mismo día de la semana. Por eso, se considera adecuado cambiar el día de celebración de estas reuniones al segundo martes de cada mes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con lo establecido en el artículo 19 del Reglamento la modificación del mismo tiene que ser aprobada por la Mesa General de Negociación Conjunta con el voto favorable de los representantes del Ayuntamiento de Palma y de la mayoría absoluta de la parte sindical de acuerdo con su representatividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además según el artículo 20 del reglamento, la propuesta de modificación del Reglamento tiene que ir acompañada de los motivos que la justifiquen y de la redacción alternativa que se propone.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otro lado, se ha detectado un error material en el &amp;nbsp;índice del Reglamento, &amp;nbsp;&amp;nbsp; que incluye el artículo 13 que no forma parte de este. Motivo por el cual, se &amp;nbsp; corrige el índice así como la enumeración de los artículos posteriores para&amp;nbsp;reflejar la enumeración correcta, de acuerdo con el artículo 109.2 de la Ley&amp;nbsp;39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo esto, de acuerdo con lo que dispone el artículo 127.1.g) de la Ley 7/1985, de 2 de abril, de bases de régimen local, de conformidad con la modificación atribuida por la Ley 57/2003, de 16 de diciembre de medidas para la modernización de Gobierno local, según las competencias delegadas por el Decreto de Alcaldía n.º 10678, de 10/09/2024 (BOIB n.º 125, de 24/09/2024) y el acuerdo de la Junta de Gobierno, de 05/07/2023 (*BOIB n.º 95 de 11/07/2023) y las titularidades asignadas por el Decreto de Alcaldía n.º 202400797, de 18/01/2024 (BOIB n.º 11, de 23/01/2024), y de conformidad con la base 21.1b) de las Bases de ejecución del presupuesto general municipal vigente, propongo a la regidora del Área de Hacienda, Función Pública y Gobierno Interior que eleve a la Junta de Gobierno la adopción del siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;ACUERDO&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Modificar el artículo 8 del Reglamento de organización y funcionamiento de la Mesa General de Negociación Conjunta del personal funcionario y del personal laboral del Ayuntamiento de Palma, en el sentido de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Allí donde dice: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“Artículo 8. Reuniones ordinarias. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;[...] Esta periodicidad es de una reunión al mes, preferentemente el primer jueves de cada mes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las organizaciones sindicales interesadas en incluir asuntos en una reunión ordinaria los tienen que presentar ante el Departamento de Recursos Humanos dentro del plazo máximo de las 14 h del jueves anterior a la reunión. Lo pueden hacer en papel o en medio electrónico en la sede electrónica que se determine.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Debe decir: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“Artículo 8. Reuniones ordinarias. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las organizaciones sindicales interesadas en incluir asuntos en una reunión ordinaria los tienen que presentar ante el Departamento de Recursos Humanos dentro del plazo máximo de las 14 h del martes anterior a la reunión. Lo pueden hacer en papel o en medio electrónico en la sede electrónica que se determine.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Modificar el índice del Reglamento de organización y funcionamiento de la Mesa General de Negociación Conjunta del personal funcionario y del personal laboral del Ayuntamiento de Palma, en el sentido de eliminar la referencia en el artículo 13 y reenumerar los artículos posteriores:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Allí donde dice:&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;em&gt;CAPÍTULO III. DE LAS REUNIONES Y LAS CONVOCATORIAS&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Artículo 7. Tipo de reuniones&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Artículo 8. Reuniones ordinarias&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Artículo 9. Reuniones extraordinarias&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Artículo 10. Convocatorias&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Proceder a la publicación del texto definitivo del Reglamento en el BOIB, en la Intranet municipal y en el Portal de Transparencia del Ayuntamiento.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que pone fin a la vía administrativa, se puede interponer recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con lo que dispone el artículo 123 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas. El plazo para interponerlo es de un mes a contar desde el día siguiente a la publicación. Es este caso no se podrá interponer recurso contencioso administrativo hasta que se haya resuelto el de reposición. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El recurso potestativo de reposición se debe presentar en el registro general de este Ayuntamiento o en las dependencias a las que se refiere el artículo 16.4 de la Ley 39/2015, de 1 de octubre, antes mencionada, y se considerará desestimado cuando no se haya resuelto ni notificado la resolución, en el plazo de un mes, a contar desde el día siguiente a su interposición. En este caso queda expedita la vía contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si no se utiliza el recurso potestativo de reposición, se puede interponer directamente recurso contencioso administrativo, de acuerdo con lo que establece el artículo anteriormente nombrado, y los 45 y siguientes de la ley 29/98, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, ante el Juzgado Contencioso Administrativo, en el plazo de dos meses a contar desde el día siguiente a la publicación. Esto sin perjuicio de cualquier otro recurso o acción que se considere conveniente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
