    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;En fecha de 28 de mayo de 2025, se dictó resolución 592/2025&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;En fecha de 30 de mayo de 2025, mediante resolución 1380/2025, se dictó la siguiente resolución que se hace pública a los efectos correspondientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;“En relación con el expediente para la adjudicación de puestos de trabajo a las personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso-oposición de personal laboral fijo del grupo C1, categoría/especialidad (profesor de guitarra) del Ayuntamiento de Pollença, y de acuerdo con los siguientes hechos y fundamentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Una vez tramitado por parte del Consell de Mallorca el procedimiento de estabilización, mediante concurso-oposición, para la contratación del profesor de guitarra del Ayuntamiento de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Considerando el BOIB nº 63, de 20 de mayo de 2025, que publica la resolución de la lista definitiva de personas aspirantes por el sistema de concurso-oposición para el ingreso como personal laboral fijo, entre otros del profesor de guitarra del Ayuntamiento de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- En fecha de 21 de mayo de 2025, mediante E-RE 4318/2025, el aspirante ha aceptado el puesto de trabajo ofrecido por el Ayuntamiento de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Resultando la propuesta de resolución PR/2025/1324 de 23/ de mayo/ 2025, fiscalizada favorablemente con fecha de 27/ de mayo/ 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.- En fecha de 28 de mayo de 2025, mediante resolución de alcaldía 1324/2025, se resolvió, entre otros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;“.. 2.CONTRATAR, &lt;/strong&gt;como personal laboral fijo, con la categoría/especialidad profesor de guitarra, a la persona aspirante que ha superado el procedimiento selectivo de estabilización por el sistema de concurso-oposición para la convocatoria de estas plazas, de acuerdo con lo indicado en el anexo 1 de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Conisderando la propuesta de resolución PR/2025/1380 de 29/ de mayo/ 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;1.- Rectificar el error material detectado, especificando en el punto 2 de la resolución que el contracto es por curso escolar, así como en el annexo 1 y, en consecuencia&lt;strong&gt;:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2. ADJUDICAR&lt;/strong&gt; el puesto de trabajo de profesor de guitarra, del subgrupo C1, de acuerdo con lo indicado en el anexo 1 de esta resolución, a la persona aspirante que ha superado el proceso selectivo de estabilización por el sistema de concurso-oposición. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3.CONTRATAR, &lt;/strong&gt;como personal laboral fijo, con la categoría/especialidad profesor de guitarra, por curso escolar, a la persona aspirante que ha superado el procedimiento selectivo de estabilización por el sistema de concurso-oposición para la convocatoria de estas plazas, de acuerdo con lo indicado en el anexo 1 de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;4.ORDENAR &lt;/strong&gt;la publicación de la presente Resolución en el Boletín Oficial de las Islas Baleares, a los efectos oportunos. La firma del contrato del lugar adjudicado se efectuará en el plazo de 3 días hábiles, contado a partir del día siguiente al de la publicación de esta resolución en el Boletín Oficial de las islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Antes de la firma del contrato del puesto adjudicado, la persona interesada debe hacer constar que no ocupa ningún puesto de trabajo ni que realiza ninguna actividad en el sector público de las que se comprenden en el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. Si realiza alguna actividad privada, incluidas las de carácter profesional, debe declararlo en el plazo de diez días hábiles contados a partir del día siguiente de la toma de posesión, para que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;Pie de recurso&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Contra esta resolución, que pone fin a la vía administrativa, y de conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, y 8, 45 y 46 de la Ley 29/1998, de 13 de julio, se podrá interponer uno de los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Con carácter potestativo, recurso de reposición ante el mismo órgano que dictó el acto recurrido, en el plazo de un mes, a contar desde el día siguiente al de la recepción de esta notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La interposición del recurso, salvo en los casos en que una disposición establezca lo contrario, no suspenderá la ejecución del acto impugnado, de conformidad con lo dispuesto en el artículo 117 de la Ley 39/2015, de 1 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Si transcurriera un mes desde el día siguiente al de la interposición del recurso de reposición sin que éste haya sido resuelto, podrá entender que ha sido desestimado e interponer recurso contencioso administrativo ante el Juzgado de lo contencioso administrativo de Palma, en cualquier momento, a contar desde el día siguiente al de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Recurso contencioso administrativo ante el Juzgado de lo contencioso administrativo de Palma, dentro del plazo de dos meses contados desde el día siguiente al de la recepción de esta notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En caso de optar por el recurso potestativo de reposición no se podrá interponer el recurso contencioso administrativo hasta que aquél sea resuelto expresamente o se haya producido su desestimación por silencio administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Todo ello sin perjuicio de cualquier otro recurso o acción que estime procedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
