&lt;p&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima, correspondientes al año 2024.&lt;/p&gt;

&lt;p&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes acabó el día a 31/05/2024, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 465 solicitudes de ayuda.&lt;/p&gt;

&lt;p&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/p&gt;

&lt;p&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho &lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima, correspondientes al año 2024.&lt;/p&gt;

&lt;p&gt;2. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo.&lt;/p&gt;

&lt;p&gt;3 . Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/p&gt;

&lt;p&gt;4 . Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/p&gt;

&lt;p&gt;5 . Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/p&gt;

&lt;p&gt;6 . Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/p&gt;

&lt;p&gt;7. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Propuesta provisional de Resolución de Denegación&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Por todo ello, se informa desfavorablemente y propongo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:&lt;/p&gt;

&lt;p&gt;1. Denegar la ayuda solicitada por los interesados que figuran en el Anexo I, que son un total de 4 expedientes y que comienza con JAIME BOSCO MARQUES BOSCH y termina con JOAN MARC FIOL SASTRE,, relativa a la línea de ayudas “Ayudas por Inversiones en bancales y cierres 2015-2019”, por no cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el mencionado anexo.&lt;/p&gt;

&lt;p&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo I.&lt;/p&gt;

&lt;p&gt;3. Comunicar esta propuesta provisional a los interesados, haciéndoles evidente que disponen de un plazo máximo de 10 días hábiles, a contar desde la notificación de esta propuesta, para presentar alegaciones. En caso de no hacer uso de su derecho para alegar, en el plazo indicado, o si manifiesta su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, y se elevará al vicepresidente del FOGAIBA para que dicte la Resolución de denegación de la ayuda solicitada.&lt;/p&gt;
