DELEGACIONES Y AVOCACIONES DE COMPETENCIAS&amp;nbsp;&lt;/strong&gt;&lt;strong&gt;TENIENTES DE ALCALDE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;HECHOS Y FUNDAMENTOS DE DERECHO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Yo, Juan Bernardo Ripoll Deyà, alcalde del Ayuntamiento de Deià,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;EN VIRTUD de las atribuciones que me confieren:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;El artículo 23.3 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local&lt;/strong&gt;, cuando no existe Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;El artículo 46 del Real Decreto 2568/1986, de 28 de noviembre, por el que se aprueba el&lt;/strong&gt;&amp;nbsp;Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;El artículo 38 del mismo Real Decreto 2568/1986&lt;/strong&gt;, sobre rendición de cuentas al Pleno.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Y TENIENDO EN CUENTA las facultades aprobadas por el Pleno Municipal en sesión extraordinaria de urgencia del&lt;/strong&gt;&amp;nbsp;15 de abril de 2025,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la propuesta de resolución PR/2025/185 de 22 / de abril / 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.- NOMBRAR entre las regidoras y los regidores (como determina el artículo 23.3 de la&lt;/strong&gt;&amp;nbsp;Ley 7/1985 cuando no existe Junta de Gobierno Local):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como Primera Teniente de Alcalde, a María Cristina López Martí.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como Segunda Teniente de Alcalde, a Gabriele Marianne Poppelreuter.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como Tercera Teniente de Alcalde, a María Henar Arribas Simón.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A las tenientes de Alcalde les corresponderá sustituir a esta alcaldía en la totalidad de sus funciones en casos de ausencia, vacante, enfermedad o impedimento que le imposibilite el ejercicio de sus atribuciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.- ESTABLECER que cuando el Alcalde deba ausentarse del término municipal:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Designará, mediante Decreto, la duración de su ausencia, nombrando al Teniente o Tenienta de Alcalde que deba asumir sus funciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Si no se confiriese esta designación de forma expresa, el Alcalde será sustituido por:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Primera Tenienta de Alcalde; si no fuera posible,&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por el Segundo; si no fuera posible,&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por la Tercera.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En cualquier caso, deberán rendir cuentas ante el resto de la Corporación, sin que durante el mismo día pueda actuar como Alcaldesa o Alcalde accidental más de uno de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.- PUBLICAR, de conformidad con lo dispuesto en el artículo 46 del Real Decreto 2568/1986, de 28 de noviembre, la presente resolución en el Boletín Oficial de las Islas Baleares.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto.- COMUNICAR esta Resolución a las Tenientas de Alcalde afectadas, haciéndoles constar que:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Deberán mantener informado al Alcalde del ejercicio de sus atribuciones como Alcaldesa accidental.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No podrán, durante dicho ejercicio:&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;ol class="nobullet" start="1" style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modificar las delegaciones ya efectuadas por el Alcalde con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Otorgar otras nuevas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinto.- RENDIR CUENTAS al Pleno del Ayuntamiento de esta resolución en la sesión plenaria que se convoque.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RECURSOS/ALEGACIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, podrán interponer:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Recurso de reposición potestativo ante el mismo órgano que ha dictado el acto administrativo en el plazo de un mes a contar desde el día siguiente a la recepción de esta notificación, tal como establece el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Alternativamente, podrán interponer directamente recurso ante el Juzgado Contencioso-Administrativo de Baleares, en el plazo de dos meses contados desde el día de la recepción de esta notificación, de acuerdo con los artículos 8.1, 25.1 y 46.1 de la Ley 29/1998, reguladora de la jurisdicción contencioso-administrativa. Todo ello sin perjuicio de que puedan interponer cualquier otro recurso que estimen más conveniente a su derecho.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Y para que conste, extiendo este certificado firmado electrónicamente en la fecha que aparece en la firma electrónica con el visto bueno del alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
