&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROPUESTA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO. APROBAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el convenio de colaboración entre el Consejo Insular de Ibiza, el Ayuntamiento de Ibiza, el Ayuntamiento de Sant Antoni de Portmany, la entidad Ferias, Congresos y Eventos de Ibiza M.P. S.A.U. y la entidad «Ibiza Pride, S.L.» para la promoción y coorganización del evento «Ibiza Pride 2025», que consta en el expediente con CSV. 15706073366630327134.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO. PUBLICAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el convenio de referencia en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vicente Alejandro Marí Torres, presidente del Consejo Insular de Ibiza (en adelante el Consejo), en el ejercicio de las facultades atribuidas por el artículo 21.1 de la Ley 4/2022, de 28 de junio, de consejos insulares, y el artículo 52 del Reglamento orgánico del Consejo Insular de Ibiza, y en representación de esta entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Rafael Triguero Costa, alcalde del Ayuntamiento de Ibiza por nombramiento del Pleno de 17 de junio de 2023, en nombre y representación de esta entidad, actuando en virtud de las facultades previstas en el artículo 21.1.b) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Marcos Serra Colomar, alcalde del Ayuntamiento de Sant Antoni de Portmany por nombramiento del Pleno de 17 de junio de 2023, en nombre y representación de esta entidad, actuando en virtud de las facultades previstas en el artículo 21.1.b) de la Ley 7/85, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Daniel Marí Marí, director gerente de la sociedad mercantil pública Ferias, Congresos y Eventos de Ibiza, M.P. S.A.U. con NIF A07837602 en nombre y representación de esta entidad, actuando en virtud de escritura de nombramiento de cargo de fecha 27 de septiembre de 2023, firmada ante el notario D. Juan Acero Simón, Notario del Ilustre Colegio de Notarios de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Antonio Sánchez Balibrea, con DNI núm. *768V, en representación de la sociedad IBIZAGAYPRIDE, S.L. con NIF. B 87155610, con domicilio en Plaza de la Constitución, 10, 3&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;er &lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;A, de la ciudad de Ibiza, de conformidad con la escritura de protocolización de acuerdos sociales, de fecha 15 de abril de 2016, con número de protocolo 539.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El artículo 148.1.18.a de la Constitución Española de 1978 establece que las comunidades autónomas pueden asumir competencias en materia de promoción y ordenación del turismo en su ámbito territorial, y en esta línea, el artículo 24 del Estatuto de Autonomía de las Islas Baleares, dispone que los poderes públicos de la comunidad autónoma tienen que reconocer la actividad turística como elemento económico estratégico de las Islas Baleares y que el fomento y la ordenación de la actividad turística se tienen que llevar a cabo con el objetivo de hacerla compatible con el respeto al medio ambiente, al patrimonio cultural y al territorio, y con políticas generales y sectoriales de fomento y ordenación económica que tengan como finalidad favorecer el crecimiento económico a medio y a largo plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Las competencias en materia de promoción turística se ejercen por el Consejo Insular de Ibiza como propias de conformidad con lo dispuesto en el artículo 70.3 de la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares, en relación al Decreto 45/2015, de 22 de mayo (BOIB núm. 77, de 23 de mayo de 2015), en virtud del cual se traspasaron al Consejo Insular de Ibiza las funciones y los servicios inherentes a las competencias propias de esta institución insular en materia de promoción turística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mediante el Decreto 7/2018, de 23 de marzo, de traspaso a los Consejos Insulares de Mallorca, Menorca y Formentera de las funciones y los servicios inherentes a las competencias propias de estos consejos insulares que hasta el momento ejercía la Administración de la Comunidad Autónoma de las Islas Baleares en materia de promoción turística, y de ampliación, adaptación y realización de las funciones y los servicios en esta materia traspasados al Consejo Insular de Ibiza mediante el Decreto 45/2015, de 22 de mayo, se amplían las funciones y los servicios traspasados al Consejo Insular de Ibiza mediante el decreto antes mencionado en relación a su ámbito territorial en cuanto a la creación, administración y puesta en valor del producto turístico, entre otros. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El Pleno del Consejo Insular de Ibiza, en la sesión ordinaria de 27 de junio de 2017, aprobó disolver la Fundación de Promoción Turística de Ibiza, entidad que había estado gestionando la promoción turística de la isla de Ibiza, y acordó la gestión directa por parte del Consejo Insular de Ibiza de las competencias que, en materia de promoción turística, se refiere el Decreto 45/2015, de 22 de mayo, sobre el traspaso al Consejo Insular de Ibiza de las funciones y los servicios inherentes a las competencias propias de esta institución insular en materia de promoción turística (BOIB núm. 77, de 23 de mayo de 2015), estableciendo que las actuaciones promocionales se puedan llevar a cabo a través de la entidad mercantil denominada Ferias, Congresos y Eventos de Ibiza, SAU (en adelante FECOEV M.P. S.A.U.), el capital social de la cual corresponde íntegramente al Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En fecha 25 de octubre de 2024, el presidente del Consejo Insular de Ibiza firmó el Plan de acciones y objetivos 2025: Acciones de Promoción Turística de la isla de Ibiza y para la promoción nacional y/o internacional de la isla de Ibiza como un destino referente en turismo deportivo, elaborado según la estrategia de promoción turística definida como máximo responsable del Departamento de Promoción Turística de la institución con un importe total de 7.906.778,40 €, que contempla una aportación del Consejo Insular de Ibiza de 7.684.303,40 €, documento que fue notificado a FECOEV M.P. S.A.U. en la misma fecha con referencia núm. CI/00000004/0005/000057082. El Plan de acciones y objetivos 2025: Acciones de Promoción Turística de la isla de Ibiza y para la promoción nacional y/o internacional de la isla de Ibiza como un destino referente en turismo deportivo forma parte del expediente del presupuesto del Consejo Insular de Ibiza para la anualidad 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La coorganización de la edición 2025 del evento «Ibiza Pride» está incluida en el Plan de acciones y objetivos 2025: Acciones de Promoción Turística de la isla de Ibiza y para la promoción nacional y/o internacional de la isla de Ibiza como un destino referente en turismo deportivo con una dotación económica máxima de 72.000 € (impuestos incluidos). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El Pleno del Consejo Insular de Ibiza, en sesión de fecha 5 de diciembre de 2024 aprobó con carácter inicial el expediente del Presupuesto del Consejo Insular de Ibiza para el ejercicio 2025 (BOIB núm. 159, de 7-12-2024). La aprobación definitiva del presupuesto del Consejo Insular de Ibiza para el ejercicio 2025 fue publicada en el BOIB núm 6, d'11-01-2025. El Plan de actuaciones a realizar por FECOEV M.P. S.A.U. en materia de Promoción Turística forma parte del expediente del presupuesto del Consejo Insular de Ibiza para la anualidad 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Los Ayuntamientos de Ibiza y Sant Antoni de Portmany, así como el Consejo Insular de Ibiza han mostrado su interés en la coorganización de la edición 2025 del evento «Ibiza Pride».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Los Ayuntamientos de Ibiza y Sant Antoni de Portmany gozan de la naturaleza de ente local y tienen plena capacidad y personalidad jurídica independiente para el cumplimiento de su finalidad propias y se rigen por el principio de cooperación y colaboración, y en su actuación por los criterios de eficiencia y servicio a la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así mismo, por lo que respecta a la competencia de los municipios en materia de desarrollo económico local, el artículo 29 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, prevé: «1. Además de las competencias derivadas de la legislación básica del Estado y del ejercicio de las que puedan ser delegadas por el Estado, por la comunidad autónoma, por los consejos y por otras administraciones, esta ley garantiza a los municipios un núcleo de competencias propias que tienen que ser ejercidas por estas entidades con plena autonomía, sujeta nada más al control de constitucionalidad y legalidad. 2. Los municipios de las Islas Baleares, en el marco de las leyes, tienen en todo caso competencias propias en las materias siguientes, entre otras: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;s)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Regulación del establecimiento de autorizaciones y promociones de todo tipo de actividades económicas, especialmente las de carácter comercial, artesanal y turístico, en su territorio; &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;t)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Desarrollo económico local y promoción turística de su territorio».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Ferias, Congresos y Eventos de Ibiza M.P. S.A.U. es una sociedad mercantil de capital público del Consejo Insular de Ibiza, que adopta la forma de sociedad anónima i fue constituida por parte del Consejo Insular de Ibiza y Formentera el día 30 de junio de 1997, con la denominación inicial Ferias y Congresos de Ibiza y Formentera S.A. Los Estatutos de la mercantil prevén que esta ostentará la condición de medio propio del Consejo, siempre que se cumplan los requisitos legales al efecto. Así mismo, el artículo 2.3 de los Estatutos de la mercantil prevé como parte del objeto de la sociedad, la promoción turística de la isla de Ibiza. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La entidad IBIZAGAYPRIDE, S.L es miembro de pleno derecho de la Asociación Europea de Organizadores Pride (EPOA) hecho que hace posible que el evento «Ibiza Pride» forme parte del circuito internacional de eventos &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Gay Prid&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;e y tiene, así mismo, registrada la marca &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Ibiza Gay Pride &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;en el ámbito nacional con núm de registre 3533027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La primera edición del evento «Ibiza Pride» tuvo lugar el año 2015 en la ciudad de Ibiza, celebrándose desde aquel momento, de forma anual, con la excepción del año 2020, en el que el evento se celebró de forma telemática debido a las restricciones impuestas para evitar la propagación de la pandemia de la Covid-19. Está prevista la celebración de su edición 2025 los días 7 a 14 de junio de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El evento «Ibiza Pride» forma parte del calendario oficial de eventos internacionales &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Gay Pride&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que se puede consultar en la página web https://www.iglta.org/Events&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, establece en su artículo 47.1 que son convenios los acuerdos con efectos jurídicos adoptados por las administraciones públicas, los organismos públicos y entidades de derecho público vinculados o dependientes o las universidades públicas entre si o con sujetos de derecho privado para una finalidad comuna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La mencionada Ley 40/2015, de 1 de octubre, dispone en el artículo 3 que las administraciones públicas, en sus relaciones, se rigen por los principios de cooperación, colaboración y coordinación, y en su actuación por los criterios de eficacia y servicio efectivo a la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las partes desean establecer la colaboración para promoción y la organización del evento «Ibiza Pride 2025» y se reconocen la capacidad legal necesaria para formalizar este convenio de colaboración, de acuerdo con las siguientes &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cláusulas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primera. Objeto del convenio de colaboración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de este convenio es la promoción y coorganización del evento «Ibiza Pride 2025» estableciendo un mecanismo de colaboración y control entre las partes firmantes para conseguir el óptimo desarrollo de los compromisos que asume cada una de las partes, en el marco del presente convenio, y que se detallen en la cláusula siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segunda. Obligaciones de las partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las partes nos comprometemos con carácter general a ejecutar los compromisos que seguidamente se establecen, de conformidad con los principios de buena administración, buena fe y de conformidad con la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.1 El Consejo Insular de Ibiza, mediante el Departamento de Promoción Turística, a través de su mercantil FECOEV M.P. S.A.U. se compromete a:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Destinar dentro el Plan de actuaciones de Promoción Turística de la entidad FECOEV M.P. S.A.U., el importe necesario para la promoción y organización del evento «Ibiza Pride 2025» y asumir gastos generales de su promoción y organización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El presupuesto máximo que asumirá el Consejo Insular de Ibiza, mediante la mercantil FECOEV M.P. S.A.U. en el marco de la coorganización de la edición 2025 del evento «Ibiza Pride» será de 72.000 € (impuestos incluidos), importe que consta debidamente consignado en el Plan de actuaciones a desarrollar por FECOEV M.P. S.A.U. en materia de promoción turística durante el ejercicio 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Insular mediante la mercantil FECOEV M.P. S.AU., destinará una parte de la dotación económica a gastos de carácter general (35.000 €) y una parte a los gastos vinculados directamente con las actuaciones que se lleven a cabo en cada uno de los municipios (37.000 €), con el siguiente desglose, que se ha calculado en aplicación de los criterios de reparto acordados por unanimidad en el Consejo de alcaldes celebrado en fecha 4 de agosto de 2020, en base a la extensión territorial con una ponderación del 37,5 % y de la población, con una ponderación del 62,5 %:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Coordinar las actuaciones a realizar por las diferentes partes en relación con el objeto del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Promocionar el evento «Ibiza Pride 2025» en los mercados y mediante los canales que se consideren oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.2 Los Ayuntamientos se comprometen a:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Ceder gratuitamente los espacios, de su titularidad y dentro de sus posibilidades, que sean necesarios para la correcta ejecución de las actuaciones que conformen el objeto del presente convenio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Ceder gratuitamente el material, de su propiedad y dentro de sus posibilidades, que sea necesario para la correcta ejecución de las actuaciones que conformen el objeto del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.3 La entidad IBIZAGAYPRIDE, S.L. se compromete a:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Ceder el uso de la marca «Ibiza Pride» en el marco de la promoción y organización conjunta de una edición anual del evento «Ibiza Pride». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Mantener su filiación a la asociación EPOA (European Pride Organisators Association) durante toda la vigencia del presente convenio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Mantener su filiación a la asociación IGLTA (International LGTBQ+ Travel Association) durante toda la vigencia del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Contar con la documentación técnica preceptiva para llevar a cabo el evento de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Recabar todos los permisos necesarios para llevar a cabo el evento de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Subscribir los seguros necesarios para llevar a cabo el evento de referencia y que hagan frente a las posibles responsabilidades que se puedan derivar de la organización y celebración del evento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercera. Mecanismos de seguimiento de la ejecución y cumplimiento de los compromisos de las partes. Comisión técnica y de seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 49, apartado f), de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, el seguimiento, vigilancia y control de la ejecución de este convenio de colaboración así como la resolución de los problemas de interpretación cumplimiento que puedan plantearse, se realizará por parte de una comisión técnica y de seguimiento. En este sentido, cualquiera de las partes podrá promover una reunión de la comisión cuando así se estime oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Comisión estará integrada por dos representantes de cada una de las entidades que firmen el convenio, siendo uno de los representantes del Consejo Insular el presidente de la misma, con el correspondiente voto de calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Corresponde a la Comisión de seguimiento la valoración de las acciones derivadas del convenio, así como la resolución de los problemas de interpretación y de cumplimiento que puedan plantearse.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El funcionamiento de esta Comisión se regirá por lo que se dispone en este convenio y por las normas aplicables a los órganos colegiados de las administraciones publicas en la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Comisión se reunirá para realizar el seguimiento de las actuaciones realizadas para cada una de las partes, determinará los posibles incumplimientos que puedan derivar en la resolución del convenio respecto a la parte incumplidora realizando los requerimientos que se estimen pertinentes, y valorará la idoneidad de incluir en la programación de las diferentes entidades implicadas, la promoción y coorganización del evento «Ibiza Pride» en posteriores anualidades, hecho que en cualquier caso, tendrá que seguir la tramitación administrativa oportuna. Así mismo, la Comisión podrá recabar asesoramiento externo en caso de considerarlo necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta Comisión extenderá un acta donde se hará constar el resultado motivado de sus valoraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conformarán esta Comisión técnica y de seguimiento los miembros siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por parte del Consejo Insular de Ibiza:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las partes que subscriben este convenio de colaboración se comprometen a intentar resolver en común las diferencias que puedan surgir en la aplicación y la interpretación del mismo y a resolver de manera amistosa cualquier desacuerdo que pueda surgir en su desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si eso no es posible, las cuestiones litigiosas que puedan afectar la interpretación y la ejecución de este convenio tienen que ser del conocimiento y de la competencia del orden jurisdiccional contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarta. Modificación del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquier modificación que altere las condiciones establecidas en este convenio de colaboración se tiene que pactar por acuerdo escrito de las partes y requiere unanimidad de las mismas. En cualquier caso, el documento donde se formalice la posible modificación se tiene que adjuntar en este convenio de colaboración como una adenda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinta. Resolución del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Este convenio de colaboración se podrá extinguir por el cumplimiento total de las actuaciones que constituyen su objeto o por incurrir en causa de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Son causas de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) El transcurso del plazo de vigencia del convenio de colaboración sin que se haya acordado su prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) El acuerdo de las partes, que se tiene que formalizar por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) El incumplimiento de las obligaciones y los compromisos asumidos por parte de alguno de los firmantes. En este caso, cualquiera de las partes lo comunicará a la comisión técnica y de seguimiento, la cual podrá requerir a la parte incumplidora para que cumpla en un determinado plazo con las obligaciones o los compromisos que se consideren incumplidos. Si, una una vez transcurrido el plazo indicado en el requerimiento, el incumplimiento persiste, la comisión técnica y de seguimiento notificará a la parte incumplidora la concurrencia de la causa de resolución y se entenderá resuelto el convenio de colaboración respecto de la parte incumplidora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) La imposibilidad material o legal de cumplir las obligaciones que se deriven del objeto del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Denuncia de cualquiera de las partes, manifestada por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) El resto de las causas previstas en la normativa de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexta. Plazo de vigencia del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La vigencia del presente convenio finalizará el día 31 de diciembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
