    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública dictada por delegación del Consejo Ejecutivo, según el Acuerdo de 28 de septiembre de 2022, BOIB nº. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el BOIB nº. 99, de 30 de julio de 2022, nº. 119, de 10 de septiembre de 2022, nº. 113 de 10 septiembre de 2022 y Convenio nº. 120 de 13 de septiembre de 2022 se publicaron los convenios firmados con el Ayuntamiento de Maria de la Salut por los cuales el Consejo de Mallorca se encargaba de la aprobación de las bases, la convocatoria y la gestión de los procesos de estabilización del empleo temporal que establece la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público, que derivan de las ofertas de empleo público aprobadas por el mencionado Ayuntamiento de Maria de la Salut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023 y BOIB nº. 19, de fecha 11 de febrero de 2023), y por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB nº. 121, de 30 de agosto de 2023), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del subgrupo C2, del Ayuntamiento de Maria de la Salut,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En esta resolución se convocó una plaza de la categoría auxiliar de biblioteca (tiempo parcial 85% jornada) del Ayuntamiento de Maria de la Salut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Por Acuerdo del Tribunal Calificador competente de este proceso selectivo de estabilización, una vez concluidas la revisión y baremación de los méritos de los aspirantes, en fecha 20 de marzo de 2025 se publicó, en el tablón electrónico de anuncios y en la sede electrónica del Consejo Insular de Mallorca, la lista definitiva de puntuaciones obtenidas, así como el listado de puestos correspondientes a las plazas convocadas, dando un plazo de 4 días hábiles para comunicar el orden de preferencia de los puestos ofrecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De conformidad con el punto 8.8 de las bases específicas de la convocatoria, una vez asignados los puestos de trabajo ofrecidos, el Tribunal tiene que elevar al consejero ejecutivo de Hacienda y Función pública la propuesta de personas aspirantes que han superado el proceso selectivo de concurso de méritos, con asignación de puestos de trabajo, desglosada, en su caso, por turnos de acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En fecha 8 de mayo de 2025, por Resolución del consejero ejecutivo de Hacienda y Función Pública, la aspirante Catalina Maria Coll Morro, con opción a la adjudicación de la plaza de auxiliar de biblioteca (tiempo parcial 85% jornada) del Ayuntamiento de Maria de la Salut, fue declarada por decaída en su derecho al trámite y excluida definitivamente a la participación en la convocatoria correspondiente. por lo que el Tribunal Calificador propuso la asignación del puesto de trabajo, a la siguiente persona de la lista definitiva de puntuaciones de méritos del proceso, la señora Francisca Cardona López.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 91.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 68 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de les Illes Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 20/2021 de 28 de diciembre de medidas urgentes para la reducción de la temporalidad en el empleo público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Ley 4/2022, de 28 de junio de consejos Insulares.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El artículo 4 del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023 y BOIB nº. 19, de fecha 11 de febrero de 2023), y por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB nº. 121, de 30 de agosto de 20230), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral (BOIB nº. 158, de 6 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicta la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. APROBAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del subgrupo C2 de la categoría auxiliar de biblioteca tiempo parcial 85% jornada (código ELCOC2/302), del Ayuntamiento de Maria de la Salut de acuerdo con lo que se indica al anexo 1 de este documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. ASIGNAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el puesto de trabajo correspondiente al subgrupo C2, a las personas aspirantes que han superado el procedimiento selectivo de estabilización por el sistema de concurso excepcional para la convocatoria de auxiliar de biblioteca tiempo parcial 85% jornada (código ELCOC2/302), de acuerdo con el trámite de manifestación de orden de preferencias efectuado y la puntuación obtenida en el proceso selectivo. En caso de que no se haya efectuado este trámite por parte de la persona aspirante, el puesto de trabajo se asigna de oficio. Esta información se recoge en Anexo 1 de este documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. ORDENAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; la publicación la publicación de esta resolución y su anexo en el tablón de edictos, la Sede electrónica del Consejo Insular de Mallorca y en el Boletín Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acto, que no pone fin a la vía administrativa, puede interponer el recurso de alzada en el plazo de un mes, contador a partir del día siguiente de recibir esta notificación. El recurso se puede interponer formalmente ante el Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa de este recurso de alzada, puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante el anterior, puede interponer, si procede, cualquier otro recurso que considere oportuno. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
