CAIB CAIB es ![CDATA[<p><span style="display: none">&nbsp;</span><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">De conformidad con lo establecido en el artículo 20.8a de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y en el punto 4º de la Resolución de 15 de junio de 2020, de la Intervención General de la Administración del Estado, por la cual se regula el proceso de registro y publicación de convocatorias en el <em>Sistema Nacional de Publicidad de Subvenciones y Ayudas Públicas</em>, el texto del extracto de la Convocatoria de ayudas para la recuperación, el mantenimiento y la consolidación del entorno agrario y agrodiversidad en la isla de Ibiza para el año 2025, remitido a la <em>Base de Datos Nacional de Subvenciones</em> (BDNS), es el siguiente: </span></span></p> <p style="text-align: center"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Extracto Convocatoria de ayudas para la recuperación, el mantenimiento y la consolidación del entorno agrario y agrodiversidad en la isla de Ibiza para el año 2025</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>1. Normativa reguladora</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">La presente convocatoria se rige al amparo de lo que disponen las Bases reguladoras de las ayudas para el desarrollo del ámbito rural, ganadero, pesquero y cinegético en la isla de Ibiza, publicadas en el Boletín Oficial de las Islas Baleares (BOIB núm. 51, de 15-04-2008, y su modificación publicada en el BOIB núm. 100 Ext., de 30-06-2011), y las bases reguladoras de las subvenciones del Consell Insular d&apos;Eivissa y las Bases generales de subvenciones, aprobadas en el marco de las Bases de ejecución del presupuesto para el ejercicio 2025 (BOIB núm. 37, de 25-03-2025); de conformidad con el vigente Presupuesto del Consell Insular d&apos;Eivissa para el año 2025 (BOIB núm. 6, de 11-01-2025) y con el Plan estratégico de subvenciones para los años 2023-2025 (aprobado por acuerdo del Consejo Ejecutivo en fecha 23-01-2023 y publicado en el BOIB núm. 12, de 26-01-2023); así como supletoriamente por el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones de la CAIB, por la Ley 38/2003, de 17 de noviembre, general de subvenciones; por el Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones; por el Real decreto 130/2019, de 8 de marzo, por el que se regula la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y otras ayudas públicas; por la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; y por la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>2. Objeto de las ayudas y ámbito de aplicación</strong></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">El objeto de esta convocatoria de ayudas es establecer las normas que tienen que regir las subvenciones destinadas a compensar los gastos superiores que supone el manejo de explotaciones extensivas en la isla de Ibiza y así mantener y consolidar el entorno agrario y su agrodiversidad.</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">El ámbito territorial de aplicación de estas ayudas es la isla de Ibiza.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>3. Consignación presupuestaria</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">La cantidad máxima que se destina a la presente convocatoria será por un importe de 1.068.274,56 €, con cargo a la aplicación presupuestaria 4100 47900 del vigente Presupuesto del Consell Insular d&apos;Eivissa para el año 2025. </span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><strong>4. </strong></span><span style="color: rgb(0, 0, 0)"> </span><span style="color: rgb(0, 0, 0)"><strong>Iniciación, instrucción y resolución de los expedientes.</strong></span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">a) El órgano competente para aprobar la presente convocatoria es el Consejo Ejecutivo</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">b) El Departamento competente en materia de agricultura instruirá el procedimiento de tramitación de los expedientes de solicitud de las ayudas reguladas en esta convocatoria.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><strong>5. </strong></span><span style="color: rgb(0, 0, 0)"><strong>Actuaciones objeto de ayuda</strong></span></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">Las actuaciones a subvencionar son las siguientes:</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><strong>a)</strong></span><span style="color: rgb(0, 0, 0)"> </span><span style="color: rgb(0, 0, 0)"><strong>Laboreo</strong></span><span style="color: rgb(0, 0, 0)"> de los terrenos de uso agrario</span><span style="color: rgb(0, 0, 0)"> </span><span style="color: rgb(0, 0, 0)"> La ayuda se medirá en € / Ha.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><em><strong>b)</strong></em></span><span style="color: rgb(0, 0, 0)"> </span><span style="color: rgb(0, 0, 0)"><strong>Siembra</strong></span><span style="color: rgb(0, 0, 0)"> de los terrenos de uso agrario Las unidades de esta medida serán €/ha.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><em><strong>c)</strong></em></span><span style="color: rgb(0, 0, 0)"> </span><span style="color: rgb(0, 0, 0)"><strong>Mantenimiento de frutales</strong></span><span style="color: rgb(0, 0, 0)">. Personas beneficiarias. Requisitos y obligaciones</strong></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><em>A)</em></span><span style="color: rgb(0, 0, 0)"> Requisitos</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">1. Podrán solicitar la ayuda prevista en esta convocatoria las personas físicas o jurídicas que reúnan los requisitos siguientes:</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">a) Que en la fecha de presentación de la solicitud de ayuda sean</span><span style="color: rgb(0, 0, 0)"> titulares de explotaciones agrarias en la isla de Ibiza.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><em>B)</em></span><span style="color: rgb(0, 0, 0)"> Obligaciones</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">1. Las personas (físicas o jurídicas) beneficiarias deben cumplir las obligaciones previstas en el artículo 14 de la Ley 38/2003, de 17 de noviembre, general de subvenciones</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">2. </span><span style="color: rgb(0, 0, 0)">Las personas beneficiarias estarán obligadas a cumplir con las buenas prácticas agrarias</span><span style="color: rgb(0, 0, 0)">.</span></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)"><strong>7. </strong></span><span style="color: rgb(0, 0, 0)"><strong>Solicitudes y documentación</strong></span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">Para solicitar la ayuda hay un impreso de solicitud que consta en el Anejo I, disponible en la sede electrónica del Consell Insular d&apos;Eivissa (</span><span style="color: rgb(0, 0, 128)"><span style="color: rgb(0, 0, 0)">https://seu.conselldeivissa.es</span></span><span style="color: rgb(0, 0, 0)">)</span><span style="color: rgb(0, 0, 0)">. El período para presentar esta solicitud es desde el día siguiente de la publicación de la presente convocatoria en el BOIB</span><span style="color: rgb(0, 0, 0)"><strong> hasta el 31-07-2025.</strong></span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">Las solicitudes se deberán formular según lo previsto en las Bases reguladoras de las ayudas para el desarrollo del ámbito rural, ganadero, pesquero y cinegético en la isla de Ibiza (BOIB núm. 51, de 15-04-2008, modificación en el BOIB núm. 100 EXT., de 30-06-2011)</span><span style="color: rgb(0, 0, 0)">.</span></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>8. Régimen de ayudas</strong></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">1. </span><span style="color: rgb(0, 0, 0)">La concesión de las ayudas de esta convocatoria se llevará a cabo mediante régimen de procedimiento de concurrencia no competitiva. En el supuesto que las solicitudes con derecho a ayuda superen la cuantía prevista de esta convocatoria, se podrá ampliar la consignación presupuestaria siempre que haya crédito suficiente y adecuado en la aplicación presupuestaria correspondiente, ampliación que se publicará en el BOIB. En el caso de que no sea posible el incremento del crédito, se reducirán todas y cada una de las solicitudes con derecho a ayuda en el mismo porcentaje unitario resultante del ajuste presupuestario, de acuerdo con el articulo 10 que se prevé en las Bases reguladoras de las ayudas para el desarrollo del ámbito rural, ganadero, pesquero y cinegético en la isla de Ibiza.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">Las ayudas reguladas por esta convocatoria son compatibles con otro tipo de ayuda o subvención que por los mismos conceptos otorgue esta u otra administración pública, o entidades privadas. El importe de las subvenciones o ayudas que se concedan no podrán superar en ningún caso, de forma aislada o en concurrencia con otras ayudas, el coste de la actividad subvencionada</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">2. </span><span style="color: rgb(0, 0, 0)">Las cuantías que vienen reflejadas en el Anejo II podrán incrementarse en función de la naturaleza de los terrenos donde se han realizado las actividades objeto de ayuda en los siguientes términos:</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">1. Parcelas calificadas como ANEI, ARIP, LIC o ZEPA, un incremento hasta el 20% en función de las actuaciones que se ejecuten y que se sumen: un incremento del 5% para actuaciones de labrar terrenos agrarios; 5% para siembra; 5% por mantenimiento de frutales y 5% para pasto con ganado de ovino/caprino.</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">2. Parcelas que presentan una pendiente superior al 8% o localizadas en un área de prevención de riesgos por erosión (APR-Erosión): la ayuda se incrementará en un 5% si se realizan actuaciones de laboreo y un 5% adicional, si se realizan siembras.</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">3. Parcelas con ganado ovino/caprino en pastoreo: el mantenimiento o la implantación de la cabaña ganadera con razas autóctonas supondrá a la cuantía de ayuda para ganadería extensiva un aumento del 25%.</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">3. El importe máximo de subvención es de 3.000,00€ por persona titular de explotación agraria y convocatoria, y hasta un máximo de 9.000€ por persona beneficiaria y programa (3 años).</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">En el caso de que la ayuda resultante sea inferior a 300 euros, se desestimará su concesión ya que el coste de su tramitación es superior a esta cuantía, a causa de ser 300 € el coste mínimo que se considera para la tramitación de cada expediente de concesión.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>9. Justificación y pago de la subvención</strong></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">Para el pago de la subvención se tendrá que presentar la solicitud de pago que consta en el Anejo IV de esta convocatoria, disponible en la sede electrónica </span><span style="color: rgb(0, 0, 0)">del Consell Insular d&apos;Eivissa (</span><span style="color: rgb(0, 0, 128)"><span style="color: rgb(0, 0, 0)">https://seu.conselldeivissa.es</span></span><span style="color: rgb(0, 0, 0)">), </span><span style="color: rgb(0, 0, 0)"><strong>en el plazo comprendido desde el 1-08-2025 al 31-08-2025</strong></span><span style="color: rgb(0, 0, 0)">, a la que se adjuntará la declaración responsable de cumplimiento de actuaciones.</span></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">El Consell Insular inspeccionará el cumplimiento de las actuaciones declaradas emitiendo a tal efecto el correspondiente informe técnico. Así, para una mayor eficacia y eficiencia en la gestión y el control de las ayudas, se inspeccionará como mínimo un 30% de las solicitudes de aquellos beneficiarios que lo fueron en</span><span style="color: rgb(0, 0, 0)"> las cinco convocatorias anteriores dentro del I Proyecto para la protección y recuperación del medio natural de la isla de Ibiza y su agrobiodiversidad</span><span style="color: rgb(0, 0, 0)"><em>,</em></span><span style="color: rgb(0, 0, 0)"> y un 100 % respecto de los nuevos en virtud de esta convocatoria.</span></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>10. Revocación de la subvención, reintegro y régimen sancionador</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">Será procedente la revocación de la subvención cuando, posteriormente a la resolución de concesión o a la resolución de pago válidas y ajustadas </span><span style="color: rgb(0, 0, 0)">a derecho, la persona beneficiaria incumpla total o parcialmente las obligaciones o los compromisos</span><span style="color: rgb(0, 0, 0)"> adquiridos a los que se encuentra condicionada la eficacia del acto de concesión o el acto de pago de la subvención, respectivamente. </span><span style="color: rgb(0, 0, 0)">Como consecuencia de la revocación de la subvención queda sin efecto, total o parcialmente</span><span style="color: rgb(0, 0, 0)">, el acto de concesión o el acto de pago, y, en este último acto, </span><span style="color: rgb(0, 0, 0)">es procedente el reintegro de las cantidades recibidas indebidamente, teniendo en cuenta lo dispuesto en el título II de la Ley 38/2003, de 17 de noviembre, general de subvenciones referente al reintegro de subvenciones, y lo que prevé su título IV referente al régimen sancionador; supuestos de igual manera previstos en los artículos 43, 44 y 45 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, así como en su título V referente al régimen sancionador.</span><span style="color: rgb(0, 0, 0)"> </span></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><strong>11. Criterios de graduación de los incumplimientos materiales</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">1. Si con posterioridad a la concesión de las subvenciones se observasen incumplimientos parciales o totales en los proyectos o actividades de las que son objeto, la cantidad concedida puede ser objeto de disminución, y en el supuesto de que se hubiera pagado el importe de la subvención, se reintegrará su exceso sobre el nuevo importe calculado mediante la aplicación de los criterios previstos en el apartado siguiente.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">2.
