&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La señora&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Andrea Ginez García&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;interpuso un recurso contencioso administrativo (&lt;/span&gt;&lt;span style="color:#000000"&gt;PO 321/2025, tramitado ante el Tribunal Superior de Justicia de las Islas Baleares) contra:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Resolución del director general del Servicio de Salud de las Islas Baleares de 13 de febrero de 2025 (corregida con posterioridad por resolución de 20 de febrero de 2025, que fue publicada en el BOIB nº. 24 de 22 de febrero de 2025) por la que “se nombra personal estatutario fijo y se adjudican plazas a las personas que han superado el concurso oposición para cubrir plazas vacantes de la categoría enfermero/enfermera del Servicio de Salud convocado por medio de la Resolución de 12 de diciembre del director general del Servicio de Salud de las Islas Baleares”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Resolución que por la que se acuerda “Excluir a las personas que se indican en el anexo tercero por no cumplir los requisitos exigidos en las bases de la convocatoria”, en concreto por no acreditar el nivel B2 de catalán (BOIB nº. 22 de 18 de febrero de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Resolución dictada el 28 de febrero de 2023 &lt;/span&gt;por el director general del Servicio de Salud de las Islas Baleares “por la que se corrigen diferentes errores y se modifican con motivo de la estimación de varios recursos de reposición de las resoluciones de 1 de diciembre de 2023 del director general del Servicio de Salud de las Illes Balears por&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;las que se aprobaron las bases generales y el baremo de méritos que rigen las convocatorias de los procesos de selección por medio de las modalidades de concurso oposición y concurso extraordinario derivadas de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares” &lt;span style="color:#000000"&gt;(BOIB nº. 27 de &lt;/span&gt;&lt;span style="color:#000000"&gt;2 de marzo de 2023&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Resolución dictada el 17 de marzo de 2023 por el director general del&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;de Salud de las Islas Baleares por la que se “corrigen diferentes errores y se modifican con motivo de la estimación de diversos recursos de reposición de las resoluciones de 20 de diciembre de 2022 del director general del Servicio de Salud de las Islas Baleares por las que se aprobaron las convocatorias específicas de procesos selectivos por el sistema de concurso extraordinario y/o concurso oposición derivadas de la oferta de empleo público adicional de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;estabilidad ordinaria y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares que afectan a todas las categorías profesionales” (BOIB nº37 de 23 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Resolución dictada por el director general del Servicio de Salud el 7 de febrero de 2023 por la que, al parecer, se estimaron parcialmente los recursos de reposición interpuestos por la Obra Cultural Balear y el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;sindicato STEI contra las Resoluciones de 1 de diciembre de 2022 del director general del Servicio de Salud de las Islas Baleares estableciendo las categorías profesionales y/o especialidades de personal estatutario sanitario que mantenían la exención del requisito de nivel de catalán. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. De manera directa o indirecta este recurso puede resultar relevante para diversas personas que podrían tener la condición de interesadas en el procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. El artículo 49 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. El artículo 45 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Emplazar a las personas interesadas en el recurso contencioso administrativo interpuesto por la señora &lt;/span&gt;&lt;span style="color:#000000"&gt;Andrea Ginez García&lt;/span&gt;&lt;span style="color:#000000"&gt;, para que puedan personarse como demandadas ante el &lt;/span&gt;&lt;span style="color:#000000"&gt;Tribunal Superior de Justicia de las Islas Baleares, en el plazo de nueve días, a partir del día siguiente de la publicación de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Comunicar a las personas interesadas que si se personan fuera del plazo establecido se las considerará como parte, sin que por ello se tenga que retrotraer ni interrumpir el curso del procedimiento y que, si no se personan, el procedimiento continuará y no será procedente hacerles ninguna otra notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Ordenar la publicación de esta resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
